Supreme Court asks judge to frame issues in N.D. Tiwari paternity suit

New Delhi, May 10 (ANI): The Supreme Court on Monday asked a trial judge to frame issues in a paternity suit filed against former Andhra Pradesh Governor N D Tiwari.

The suit has been filed by Rohit Shekhar, who claims to be his biological son.

The Chief Justice K G Balakrishnan headed bench said the issues should be framed without being influenced by observations made by single judge or the division benches of the Delhi High Court.

The Delhi High Court had on March 17 rejected Tiwari”s plea for quashing Shekhar”s paternity suit.

A division bench of the high court had hinted that Tiwari might have to undergo a DNA test to decide the issue. It set aside a single bench order that had dismissed Shekhar”s paternity suit on grounds that it was time barred and non-maintainable.

Justice S N Dhingra had on November 3, 2009 said the suit filed by Shekhar was non maintainable and allowed the plea of 84-year-old Tiwari, who had sought dismissal of the petition.

Supreme Court to hear N.D. Tiwari”s paternity suit appeal

New Delhi, May 10 (ANI): The Supreme Court will hear former Andhra Pradesh Governor N D Tiwari”s petition challenging the paternity case filed against him by Rohit Shekhar who claims to be his biological son.

The Delhi High Court had on March 17 rejected Tiwari”s plea for quashing Shekhar”s paternity suit.

A division bench of the high court had hinted that Tiwari might have to undergo a DNA test to decide the issue. It set aside a single bench order that had dismissed Shekhar”s paternity suit filed by Shekhar”s on ground that it was time barred and non maintainable.

Court dismisses Tiwari’s plea over paternity suit

New Delhi, March 17 (IANS) The Delhi High Court Wednesday dismissed former Andhra Pradesh governor N.D. Tiwari’s plea challenging the paternity suit filed by a 34-year-old man who says the Congress leader is his biological father.

Justices Vikramjit Sen and Manmohan Singh said there was ample evidence to prove that the suit filed by Rohit Shekhar could be filed in Delhi – a ground on which Shekhar’s plea was dismissed earlier by a single bench.

According to the division bench, as Tiwari is not the governor of Andhra Pradesh any more and has an official residence in Delhi, the case could be heard by the Delhi High Court.

The single bench, while refusing to admit Shekhar’s plea earlier, had said that since Tiwari was the governor of Andhra, the suit against him should be filed in that state.

On Wednesday, the court checked Tiwari’s counsel when he submitted that Shekhar’s plea was not maintainable. It said it may consider ordering a DNA test if the issue of maintainability was raised by Tiwari, now 86.

Shekhar’s plea will now come up before a single bench April 7.

Senior advocate P.S. Patwali, who argued for Shekhar, stressed that Tiwari’s denial in accepting him as his son was the reason for filing this civil suit.

Welcoming the court order, Ujwala Sharma, mother of Shekhar, said: ‘I am very happy and it is a big victory for us.’

Shekhar said the purpose of filing the suit was to know who his biological father was. ‘It’s my fundamental right,’ he told reporters.

Shekhar said he was seeking a DNA test to know if Tiwari was his father. He indicated that he wanted an apology from the veteran Congressman if the test proved him to be so.

According to Shekhar’s petition, Tiwari began neglecting Shekhar and his mother Ujjawala Sharma after 1995 and refused to meet him after becoming the Uttranchal chief minister.

Tiwari’s five-decade-old political career came to a virtual end after a news channel last year showed clippings of an elderly man purported to be Tiwari in bed with three young women.

A few days later, Tiwari resigned as the Andhra Pradesh governor citing health grounds.

N D Tiwari in fresh trouble over paternity suit

New Delhi, Mar 17 (ANI): The Delhi High Court on Wednesday declined the plea of former AP Governor N D Tiwari on a paternity suit filed by a youth, who is claiming to be his biological son

The court will now hear the paternity filed by the youth Rohit Shekhar on April 7, who had earlier challenged a single bench order of November 2009 that had dismissed the case on jurisdictional grounds.

The court had on March 11 reserved its order on the paternity suit filed by Shekhar.

A Bench comprising Justices Vikramajit Sen and Manmohan Singh reserved the order after the octogenarian politician opposed the court entertaining such a petition, which was filed 31 years after Shekhar”s birth.
Shekhar had filed an appeal before a Division Bench challenging a single-bench order, which had dismissed his petition on the ground that it was not maintainable.

Justice S N Dhingra had on November 3, 2009 said the suit filed by Shekhar was not maintainable and allowed the plea of 84-year-old Tiwari who had sought dismissal of the petition.

Tiwari had quit as Andhra Pradesh Governor following allegations of his involvement in a sex scandal inside Raj Bhavan. (ANI)

Patna, May 24 (ANI): Elections are over, but its bitterness may perhaps take time to end. It was visible when Bharatiya Janata Party leader and veteran film actor Shatrughan Sinha on Sunday described his rival TV actor-turned-politician Shekhar Suman of the Congress party as a ‘monkey’.

“Those people who were behaving like a monkey on screen as well as off screen….. I have always said that the people’s welfare and progress are more important than name and fame. I was surprised to see that some people who were earlier seen in the election campaign of Narendra Modi, whatever might be the reason, it might be commercial reasons, who were seen in the oath-taking ceremony of Narendra Modi, all of a sudden started talking about secularism and started saying that their family belongs to Congress and that they belong to Congress too,” said Sinha.

Shekhar contested election on Congress ticket against Shatrughan Sinha of the BJP. Both represent the Kayastha community whose members account for over 500,000 votes in the urban constituency of Patna Saheb.

Indian IT industry unperturbed by Bangalore-Buffalo remark by Obama

Bangalore, May 7 (ANI): Undaunted by US President Barack Obama’s Bangalore-Buffalo remark and proposal to extend tax benefits to those creating job opportunities to Americans, experts in the Indian IT industry said the comments had nothing to do with outsourcing or with India.

It is an instance of Obama’s views being misinterpreted, said Som Mittal, President of Nasscom, while speaking to media persons here on Wednesday.

It may be recalled that Obama had vowed on Monday to overhaul tax policies vis-’-vis shifting of US jobs overseas and allowing wealthy people to evade taxes using offshore accounts.

“I think it’s not an issue of India. It is about how US companies are there, how the US subsidiaries are structured and what is the taxation that US has followed over the years. So it’s got nothing to do with India or somewhere. I think even this mention of Buffalo and Bangalore. I think its being misinterpreted,” Mittal said.

“President Obama actually said that the additional taxes that he would get he is going to invest some of that money to do research,” Mittal added.

Mittal further added that the Indian IT industry provides solution so as to enable the United States to become more competent.

The total generation of annual revenue from IT is 40 billion US dollars which is 5.8 per cent of the GDP.

Bangalore alone is a host for 750 thousand employees who are directly or indirectly dependent on IT outsourcing.

As noted by Kartik Shekhar, General Secretary, Union of ITES Professionals (Unites), approximately 14 billion dollars is generated as revenue annually.

“Actual on ground what’s going to happen will actually be known in times to come. But as news this is a wrong time for India. We are trying to recover from recession showing slow indicators coming up. When these indicators come up then such bad news come up dropping sentiments. So it is more on sentiments rather actual realities,” said Shekhar.

Further he added to say that all these will now be a far away dream for some IT experts. Yet some still are hopeful that this will not happen as companies will arbitrate with the US President. (ANI)

Nepal Maoists get boost in by-election

Shirish B. Pradhan Kathmandu, Apr 11 (PTI) Nepal’s ruling Maoist party, which had appeared isolated, has received a boost in the by-elections, winning two out of five declared seats, including one from the stronghold of the main Opposition party. UCPN-Maoist won Kanchanpur constituency from the Nepal Congress while retaining the Kaski constituency.

In Rolpa constituency vacated by Prime Minister Prachanda, the UCPN-Maoist’s candidate is being challenged by its own break-away faction. The Maoists have done well despite growing public criticism of their seven-month-old government.

The ruling Maoists have performed better than expected in the aftermath of severe criticism from the opposition for resorting to violence and intimidatory tactics. Of the five seats declared so far, three have been bagged by the leftists with one each being won by the Nepali Congress and Terai based Madhesi People s Rights Forum.

Former Prime Minister G P Koiral’s nephew Shekhar Koirala was elected from Morang 7 constituency. Maoists leader Krishna Bahadur Gurung has won the Kaski constituency, which was earlier won by the Maoist Law Minister Dev Gurung.

Counting for the sixth and last Rolpa 2 constituency is, however, still in progress, the EC said. PTI.

Nepal bypolls boost ruling Maoists

Kathmandu, April 11 (IANS) Nepal’s ruling Maoist party has received a boost in by-elections to six seats, with the results coming in Saturday indicating it was poised to win three, including an opposition stronghold.

Nepal’s biggest opposition party, the Nepali Congress (NC), suffered setbacks in two seats in Friday’s bypolls. The Maoists have done well despite growing public criticism of their seven-month-old government.

The Kanchanpur seat had been a stronghold of former NC prime minister Sher Bahadur Deuba and returned him to parliament in the 2008 election. Vacated after Deuba won from a second constituency as well, the bastion fell to the Maoist grassroots leader whom Deuba had humbled, Harish Thakulla.

Thakulla, also known as Kamal Chhetri during the Maoists’ 10-year ‘People’s War’, who had lived in India’s Mumbai city for several years, supporting himself by hawking newspapers, pulled off a surprise victory over NC candidate Ek Raj Joshi.

The NC also lost its Dhanusha citadel, which had voted for the party in 2008.

NC lawmaker Ram Baran Yadav had resigned from the seat after being elected the first president of the republic of Nepal, replacing deposed King Gyanendra as the head of state.

Though Yadav’s son, radiologist Chandra Mohan Yadav, was fielded by the NC, the debutant politician floundered in third place with the regional party, Terai Madesh Loktantrik Party, and the ruling Communist Party of Nepal-Unified Marxist Leninist, which is a member of the Maoist-led coalition government, fighting neck and neck.

The NC however got a shot in the arm when its candidate Shekhar Koirala won from Morang district in eastern Nepal.

Koirala, nephew of NC chief and former prime minister Girija Prasad Koirala and uncle of Bollywood diva Manisha Koirala, had been humbled in the same constituency last year by the new regional party, Madhesi Janadhikar Forum. This time however he clawed back, with the blessings of his octogenarian uncle who was among the first few to cast their votes, winning by a slender margin of 692 votes.

In the other seat in Morang, there were no surprises. Won last year by the Forum, it voted for the same party’s Jay Ram Yadav, with the Maoists coming a close second.

Counting will start late for the seat in Rolpa, regarded as the cradle of the Maoist movement and won last year by Maoist supremo Pushpa Kamal Dahal Prachanda.

It is likely to be retained by the ruling party despite a dissenter contesting as an independent candidate.

Besides Kanchanpur, Maoist contestant Krishna Bahadur Gurung won from Kaski, the district that last year voted for Maoist Law Minister Dev Gurung.
