Court details long, strange road to “Easy Rider” sequel

LOS ANGELES (Hollywood Reporter) – Considering the lack of courtroom success that Hollywood studios have had lately, perhaps the best legal strategy is to hide.

Consider Polestar Entertainment, a film production company that has just escaped a $700,000 default judgment for allegedly defrauding a man who invested in a sequel to the 1969 cult fave “Easy Rider.” The company was able to get out of the penalty on the grounds that it didn’t know a trial was going on. A Missouri appeals court has ruled that the court award was a violation of the defendants’ due process rights.

The decision marks the latest strange turn on the road to creating an “Easy Rider” sequel.

The plaintiff in the case was the estate of Al Kerth III, perhaps most infamous in Hollywood for helping relocate the Rams from Los Angeles to St. Louis. In 1999, Kerth invested $125,000 with Polestar, run by Glenn Tobias, for a planned sequel to “Easy Rider.”

Tobias ran into problems and had his assets foreclosed, including rights to the franchise.

Kerth committed suicide in 2002, and in sorting his affairs, lawyers for the estate discovered the agreement. In 2004, the estate filed a lawsuit against Tobias and two of his companies, Polestar and Besdine Management Company, alleging fraud and breach of contract.

Tobias hired a lawyer to represent him, but the counsel withdrew from the case. At the time, Tobias was dealing with other lawsuits in California, Taiwan, Europe and the Bahamas and decided to give priority to those other lawsuits. He didn’t hire a replacement to his Missouri counsel.

Meanwhile, the plaintiff moved to have the case put on the trial docket, and a judge set trial for July 9, 2007. The plaintiff, though, never mailed notice of the trial setting to the defendants. At the trial, the Kerth estate presented its evidence, and the trial court entered a judgment of $188,000 in compensatory damages, $135,360 in pre-judgment interest, and $376,000 in punitive damages.

According to the decision by the Missouri appeals court, reviewing the lower court’s awarded judgment, a year and a half passed before Tobias learned from his attorney in California that a collection proceeding had initiated. He then filed a motion to set aside the verdict. And … he won.

So what happened to that sequel to “Easy Rider”?

The man who seized the assets of Tobias sold the rights to a group that included Philip Pitzer, a lawyer from Ohio who wanted to fulfill his life-long dream of making the sequel. It took some doing on his part.

The film was going to be called “Easy Rider: The Search Continues” and was going to include clips from the original film. According to a story three years ago in the New York Times, the plan went haywire when Pitzer found out they didn’t really acquire rights to the old clips. Pitzer sued in Santa Monica Superior Court, claiming fraud and deceit in the sale of the sequel rights.

Kerth/Tobias failed to make the film (and let’s not forget the “Easy Rider: A.D.” attempt either), but Pitzer was finally able to pull it off. It was called “Easy Rider: The Ride Back” and we can hardly blame anyone for missing it.

Three Men And A Baby 3rd instalment in the pipeline

London, June 4 (ANI): Tom Selleck has admitted that there is a sequel in the offing for the movie ‘Three Men and a Baby’.

The 65-year-old actor starred in the 1987 film along with Ted Danson and Steve Guttenberg and followed it up with ‘Three Men And A Little Lady’ in 1990.

The third part, evidently, is titled ‘Three Men And A Bride’.

“It is true that Disney checked my availability, and I know they checked Ted”s and Steve”s, and then had a script written, I think tentatively called Three Men And A Bride, which kind of says it all,” The Mirror quoted him as telling MTV.

Steve had revealed last year that another movie might be in the works.

Tom added, “I hope it”s a good script, and if it is a good script I hope they do it, because it would be really fun to get back with Ted and Steve. The strongest of the two movies I think is the first one. It had more heart, and that”s what I hope this third one would have if we do it.” (ANI)

Sarah Jessica Parker’s joy at SATC sequel’s Morocco stint

London, May 20 (ANI): Actress Sarah Jessica Parker says she’s glad that the shooting of ‘Sex And The City’ sequel tool place in Morocco – as none of the locals recognized the cast.

The four leading ladies shot for the film in the deserts of the African country – which doubled as Abu Dhabi in the movie – after producers failed to get filming permission from Dubai officials.

But Parker insists that they were lucky they came to Africa for their movie instead to the Middle East – because the production was completely undisturbed in Africa.

“We were in a country that had no interest in us. It was our job to stay out of their way and be respectful of their turf,” the Daily Star quoted Parker as telling the Sun.

“They were in the middle of their lives, jobs and work, so when we were in the market standing in front of their stalls it was our responsibility to integrate into their lives.

“They had little or no interest in us and it was a virtue because it allowed us to tell our story in an open environment and capture everything we wanted on screen,” she added. (ANI)

She plays writer Carrie Bradshaw in the series and also acts as executive producer on the film, which is set to hit cinemas around the world later this month (may 10).

But she”s worried about the response the film will get, reports the Daily Star.

“I”m excited, but this is also the period when I tend to be very nervous and I worry and I fret and over think. I”m in a state of turmoil. I fret about everything. I worry that it”s not good enough. I worry that no one will show up… What if the audience isn”t happy?” Parker told ETOnline.com. (ANI)

Carey Mulligan falls for Manhattan

London, May 12 (ANI): British actress Carey Mulligan has fallen for Manhattan.

Mulligan, who is about to appear in the sequel to Wall Street, says she is ‘happiest there’, reports the Telegraph.

“I love New York – maybe more than Los Angeles or London, I could live in New York. I think I’m happiest [there].

“In London, people can be so … well, it’s not even a case of people being unkind or unfriendly. You just don’t make any contact. You go from A to B with your eyes on the pavement,” she said.

She added: “New York is more social, and I didn’t expect that. If you’re walking down the street in LA, people do sort of look at you like you’re a hooker because it’s so rare to see someone just walking.” (ANI)

Marquez and Diaz in “2009 fight of the year” rematch

Five-times world champion Juan Manuel Marquez will defend his WBA and WBO lightweight titles against Juan Diaz in Las Vegas on July 31 in a rematch of their furious slugfest last year.

Mexican Marquez stopped Diaz in the ninth round in Houston in February 2009 to claim the vacant WBA and WBO belts.

Diaz dominated the early rounds before Marquez turned the tide, swarming after his opponent in the eighth and ninth until the referee halted the contest.

“Our fight was the fight of the year in 2009 and it may be the fight of the year again in 2010,” Marquez (50-5-1, 37 knockouts) told a news conference at the MGM Grand Hotel & Casino on Saturday.

“A lot of people are asking me why Juan Diaz again? Number one, he is a great fighter and deserves a rematch. Number two, the people deserve a great fight like this.”

Diaz (35-3, 17 KOs) viewed his sequel with Marquez as a chance for redemption.

“It’s no secret my loss to Marquez is the one I want to get back the most,” he said.

“I was dominating the first fight but I didn’t finish (it off). This time that won’t be the case.”

Marquez, widely regarded as the world’s top lightweight, has not been in the ring since he lost a non-title welterweight bout to Floyd Mayweather Jr in September after moving up two weight classes.

Diaz, who held the world lightweight title from 2004 to 2007, has lost three of his last five fights.

The July rematch will take place at the Mandalay Bay Events Center.

Phantom sequel delayed in US

Andrew Lloyd Webber’s sequel to the hit musical Phantom Of The Opera will reach Broadway later than planned due to ongoing problems after the composer’s surgery for prostate cancer.

Love Never Dies, which opened recently in London, was to have opened in New York in November. It will now open early next year.

Plans to stage the show in Australia next year will not be affected.

“Although the cancer has been eradicated, there have been post-operative problems,” the show’s organisers said in a statement regarding Lloyd Webber’s health.

“These have been aggravated by recent air travel and Lloyd Webber’s doctors have requested that he does not take any further long-haul flights for the time being and until the problem has been investigated.”

Lloyd Webber, 62, says he is “extremely frustrated” about the delay and will focus his time on producing The Wizard Of Oz in London.
