Rashtriya Janata Dal celebrates good show in Bihar by-polls

Patna, Sept 20 (ANI): The activists of the Rashtriya Janata Dal (RJD) here celebrated the party’s good show in the by-election for 18 legislative assembly seats.

The RJD-Lok Janshakti Party (LJP) won eight seats in the by-election for 18 legislative assembly seats, a major set back to ruling Janata Dal-United (JD-U).

The JD (U) bagged three seats while its ally the Bharatiya Janata Party (BJP) won two seats.

The activists burst crackers and distributed sweets to celebrate the win at the party office.

RJD leader Lalu Prasad termed the results as referendum on the ruling government.

“It is not possible for the Bihar Government-led by Nitish Kumar to return. The RJD alliance will return to power. The people of Bihar have welcomed us with open arms,” said Yadav.

The RJD failed poorly in Lok Sabha election in April-May this year, winning just four seats out of the total 40 in Bihar. (ANI)

MJ’s mother wins will ruling

London, September 19 (ANI): Michael Jackson’s mother Katherine can challenge the administrators of the singer’s estate without any threat to her 40 per cent stake, a judge has ruled.

The 79-year-old’s legal team said that she wants to have more say over the manner in which the 400 million dollar estate is handled.

According to the ruling, the King of Pop’s mum will not breach a ‘no contest’ clause in the family trust if she sets up a challenge before the executors over Jackson’s will, reports the Sun.

Katherine is the legal guardian of the star’s children, Prince Michael, 12, Paris, 11, and seven-year-old Prince Michael II, after his sudden death on June 25.

She will receive more than 1 million dollars a year from his estate including a sum of 26,804 dollars a month for herself apart from a monthly allowance of 60,000 dollars for the three kids, as per the court’s order. (ANI)

SC extends stay on Kanshi Ram memorial construction

New Delhi, Sep. 18 (ANI): Expressing dissatisfaction over the Mayawati Government’s plea, the Supreme Court on Friday extended the stay order on its earlier ruling for stoppage of work at Kanshi Ram Memorial Sthal in Lucknow.

“The affidavit is not satisfactory. The question here has many, many burning issues,” it observed during a brief hearing in the case,” a Bench comprising Justices B N Agrawal and Aftab Alam noted.t said the question was whether one could spend so much of money from the state or public exchequer for the purpose.

“Suppose today the legislature decides that 80 per cent of budgetary allocation should be spent on such works of memorials and statues…is it not justiciable,” the Bench asked.

“Serious questions arise in this petition…the cabinet and the legislature have to act under the Constitution,” the Bench added.

The next hearing in the case is on October 5th, and the parties are asked to file their responses to the affidavit by September 29th.

In a detailed affidavit filed in response to the show cause notice issued on September 11, the state government had claimed it had the highest regard for the apex court and that it believed in carrying out its directions in “letter and spirit.”

On September 8, the apex court had ruled that no further construction activities should take place at the memorials which have cost the exchequer 2,600 crore rupees.

However, media reports said construction activities were going on in full swing despite the court’s directive, following which the bench had issued a show cause notice. (ANI)

The RJD-Lok Janshakti Party (LJP) won eight seats in the by-election for 18 legislative assembly seats, a major setback to ruling Janata Dal-United (JD-U).

RJD activists gathered at the party office and burst crackers and distributed sweets to celebrate the win.

Rabri Devi, leader of opposition in Bihar legislative assembly, termed the results as referendum against the ruling government.

“Bihar government led by Nitish Kumar is fooling the public. The people of Bihar have understood it and that’s why they have rejected the ruling party. I congratulate the people of Bihar. I am sure that people will keep on voting for Rashtriya Janata Dal alliance,” said Devi.

S. African athlete Semenya tries to gloss over gender controversy

Johannesburg, Sep.9 (ANI): South African athlete Caster Semenya has completed her transformation from gender troubled sporting champion into national celebrity with a photo shoot in the country’s leading gossip magazine.

While the controversy rumbles on over whether the teenage runner is really male or female, her handlers have sought to end the debate with the aid of a costume change, make up and some studio lights.

With the front cover headline: “Wow, look at Caster now!” You magazine proudly boasts that it has turned her from “power girl” into “glamour girl” and apparently, “she loves it”.

Inside, the 800 m world champion – whose gender is being tested by the international athletics authorities – says the whole issue is a joke.

“It doesn’t upset me. God made me the way I am and I accept myself. I am who I am and I’m proud of myself,” The Sun quoted Semenya, as saying.

In the magazine, Semenya poses in skinny jeans, stilettos and a black and white evening dress.

News that the athlete would have to undergo testing was leaked before the 800m final at the world championships in Berlin, putting her under enormous pressure.

Following her victory, the ruling African National Congress seized upon her case to score political points, with left-wing firebrands such as Winnie Madikizela Mandela and ANC Youth League president Julius Malema accusing the athletics authorities of racism.

They have also sought to use Semenya to stir up populist feeling against what is seen as the right wing of the ANC, represented by Trevor Manuel, President Jacob Zuma’s planning chief.

Semenya received a heroine’s welcome in her home village in South Africa’s impoverished Limpopo province at the end of August, with VIPs and a 200-strong crowd singing a version of the Communist Party anthem, which included the lyrics: “My mother was a kitchen girl, my father was a garden boy, that’s why I’m a champion, that’s why I’m a champion.”

The cover shoot has reignited the debate in South Africa over the athlete’s appearance, with radio talk shows inundated with callers.

The 18-year-old has refused to be drawn on what she is going through at present, telling the magazine: “I don’t want to talk about the tests – I’m not even thinking about them.” (ANI)

Transsexual killer wins right to be in women’s prison

London, September 5 (ANI): A transsexual killer, who attempted to rape a female shop assistant, is moving to a women’s prison after getting the green light from a judge.

The 27-year-old won an argument in the court when it was ruled that keeping her in a men’s prison breached her human rights.

The murderer, named only as ‘A’, was given a life sentence for crimes committed while a man, reports the Sun.

She was sentenced to five years in jail for manslaughter after strangling a boyfriend with a pair of tights. Some time later her release, she tried to rape a woman shop assistant after tying her with a suspender belt.

‘A’, who grew breasts after undergoing hormone treatment and wears skirts and make-up in her cell, has also been allowed to have full sex-change surgery, from which she was previously banned while in a male prison.

Deputy Judge David Elvin QC said ‘A’ had endured gender dysphoria from an early age, and Justice Secretary Jack Straw’s decision to keep her in a male prison breached the European Convention on Human Rights.

Attorneys said ‘A’ was “a woman trapped in a man’s body” and the ruling “gave her hope”. (ANI)

Four-member team set up to probe Air India fire incident

Mumbai, Sep 5 (ANI): A four-member in-house committee has been set up to probe the Air India fire incident that took place at Mumbai International Airport on Friday.

Nearly 200 passengers were onboard on Riyadh bound Air India flight (AI-829) while the aircraft’s left engine caught fire while taking off.

Many passengers suffered bruises and cuts while sliding down from the chutes but were taken to the Mumbai International Airport Pvt Ltd (MIAL) casualty centre and given first aid.

Ruling out the possibility of a technical snag leading to the grounding of the aircraft at Mumbai Airport, aviation experts said the fuel leaked onto the heated engines of the aircraft and that had caused the fire.

They said that timely information provided by a passenger led the crew to stop the flight from taxing off the runway for Saudi Arabian capital Riyadh.

Flight 829 was immediately grounded when sparks were detected flying out of one of the engines.

The 213 passengers onboard were evacuated by slides to safety. Four fire engines were rushed to the spot, as also other equipment and personnel. (ANI)

DGCA recommends derostering of Air India maintenance engineer for fuel leak

Mumbai, Sep.4 (ANI): The Directorate General of Civil Aviation (DGCA) has ordered the derostering of the maintenance engineer who was working on Air India flight 829 after it developed a fuel leak.

The DGCA has ordered a detailed probe into the fuel leak from the wings of an Air India flight that caused one of the engines to catch fire.

Ruling out the possibility of a technical snag leading to the grounding of the aircraft at Mumbai Airport on Friday morning, aviation experts said the fuel leaked onto the heated engines of the aircraft and that had caused the fire.

Canadian Govt to challenge racial refugee status decision

Ottawa, Sep. 4 (ANI): The Canadian Government has decided to challenge a decision by the country’s Immigration and Refugee Board, which granted refugee status to a white South African because of the colour of his skin.

Brandon Huntley, 31, who had been illegally staying in Canada from 2006, argued that his safety would be in danger if he returned to South Africa, The Globe and Mail reports.

He also claimed he’d been the victim of seven attempted robberies and called a “white dog” and “settler.” He did not report any of the incidents to police, saying he did not trust them.

His refugee claim was accepted by lone board member William Davis, who noted that Huntley had scars on his body to support his account of the attacks.

The panel’s decision infuriated South African officials who labelled Canada as “racist.”

South Africa’s top diplomat has been urging Canadian officials all week to challenge the decision in court.

On Thursday, a spokesperson for Immigration Minister Jason Kenney confirmed Ottawa will seek leave to appeal the decision that allowed Huntley to live in Canada as a refugee.

“The government is going to be seeking leave to appeal the IRB’s decision to grant Huntley refugee status [to] the Federal Court,” spokesman Alykhan Velshi said.

“Our department’s lawyers, as well as those from the Department of Justice reviewed the IRB ruling over the last several days and we’re going to seek leave to appeal and we’ll be making submissions to the court in the fullness of time, and it would be inappropriate to comment further because the matter will be before the courts.” (ANI)

Nation would seek mid-term polls if govt. fails to prosecute Musharraf : PML-N leader

Islamabad, Sep.2 (ANI): Pakistan Muslim League-Nawaz (PML-N) leader Zafar Ali Shah has said the whole nation would demand mid-term term elections if the PPP-led government fails to try former President General Pervez Musharraf under Article Six of the Constitution.

Criticising the Gilani government for not taking any substantial action against Musharraf, Shah said he would again move a petition seeking Musharraf’s trial in the Supreme Court.

“I would again submit a petition seeking a Supreme Court ruling for the government to initiate criminal proceedings against Musharraf for high treason,” The Daily Times quoted Shah, as saying.

Shah, however, said that he had filed the petition earlier in his personal capacity and his party (PML-N) has nothing to do with it.

Meanwhile, PML-N Senior Vice President Javed Hashmi ruled out any possibility of mid-term polls in the country.

Hashmi said the PML-N respects people’s mandate and supports President Asif Ali Zardari.

“We will not support any move for mid-term elections and our party has always given due respect to President Zardari and his party’s mandate,” Hashmi said.

He termed the minus-one formula as the ‘approach of a sick mind’.

When asked about Zafar Ali Shah’s views, he said it was his personal opinion to demand for mid-term elections. (ANI)

One call from Saudi Arabia would seal Musharraf trial seekers’ mouth: PML-Q

Lahore, Sep.2 (ANI): Pakistan Muslim League-Quaid (PML-Q) Secretary General Mushahid Hussain Sayed has said that former President General Pervez Musharraf had left the country after inking a deal with the present government regarding not being prosecuted under high treason charges, and that one call from Saudi government would silence Musharraf’s trial seekers.

Speaking on a television chat show, Sayed said only a single telephone call from Saudi Arabia would stop demands for Musharraf’s trial.

While ruling out any involvement of the Armed Forces in the present crisis, he said Musharraf’s trial under Article Six was impossible.

“The present system had no problem from the army or the Inter-Services Intelligence or any so-called secret agencies,” The Daily Times quoted Sayed, as saying.

Commenting on the PML-N chief Nawaz Sharif’s threat to hold a long march demanding Musharraf’s trial, he said Pakistan could ill-afford midterm elections or long marches against the ‘democratic’ government.

Sayed said the country’s leadership should have the courage to decisions on their own rather than depending upon calls from British Secretary of State for Foreign Affairs David Miliband or US Special Representative for Afghanistan and Pakistan Richard Holbrooke. (ANI)

India’s football federation seeks legal solution in Bhutia-Bagan club row

New Delhi, Aug 31 (ANI): India’s football federation on Sunday sought a legal solution to the row involving national soccer skipper Bhaichung Bhutia and country’s oldest sport club Mohun Bagan.

Mohun Bagan handed the 32-year-old striker a six-month ban in May after he missed training to appear on a celebrity-based dancing show on television and accused him of lacking commitment during the league season.

The All India Football Federation (AIFF), which met on Sunday, decided to refer the dispute to an arbitrator after a meeting between the two parties failed to break the deadlock.

“Both sides have a very firm view on the issue. So we need to have a kind of a legal solution to the issue because we cannot take a ruling… based on what both sides have stated. We feel it is better that we take a legal opinion and we will solve the issue. But it is being dragged that much, especially in this case because Bhaichung Bhutia is our national captain and a very respected player. So we want to settle it and resolve it at earliest,” said Praful Patel, acting president of the AIFF.

Bhutia is regarded as the player who can inspire India in the 2011 Asian Cup, which has been seen as vital to reviving the game in the country. (ANI)

Nepal Vice President’s position defunct from today

Kathmandu, Aug 31 (ANI): Paramananda Jha’s position as Nepal Vice President has become defunct from Monday with Jha’s refusal to take oath in Nepali within the deadline given by the Supreme Court.

Rejecting the Supreme Court ruling that ordered him to take fresh oath in Nepali, Vice President Jha has declared that he will decide whether to retake the oath only if the Constitution is amended.

“The situation is that the mother language of Nepalis people so far has not been respected by the previous decisions of the Supreme Court and the government level. Thus, I can think about the issue of oath-taking only after the government and the Constituent Assembly (CA) honours the mother languages,” Nepalnews quoted him as, saying.

He also criticized the Supreme Court’s order to him to re-take oath in Nepali or else vacate his post.

He called the Supreme Court’s verdict ‘prejudiced’ and against the tenet and spirit of the interim Constitution and said it serves no purpose other than to start a “language war” as it is against the basic right of the people “to take oath in his own mother tongue”.

He also complained that some political parties supported the “anti-constitution” decision by staying quiet.

Supreme Court had issued a verdict on August 25 ordering him to take oath in Nepali within a week and that failure to do so would render his position defunct.

Taliban commander says Baitullah alive, wants new TTP chief

Wana, Aug 24 (ANI): Tehreek-e-Taliban Pakistan (TTP) chief Baitullah Mehsud wants the Taliban council to choose their new head within THE next five days, according to commander Waliur Rehman.

Talking to a foreign news agency, Tehreek-e-Taliban Pakistan (TTP) South Waziristan Amir Waliur Rehman said, “We have thousands of suicide attackers, who can destroy their targets anywhere.”

Waliur Rehman added that Baitullah Mehsud is alive; but is seriously ailing.

“Baitullah Mehsud had deputed the organization’s affairs to me two months back,” he said, adding US President Obama and his allies are Taliban’s foremost enemies.

The security forces’ operation in Swat had no effects on Taliban, as they are still present there who moved aside to save the people from any possible damage, The News quoted Waliur Rehman, as saying.

Ruling out any reports regarding the conflicts in Taliban movement, he said: “Our movement is active and effective with no rifts or difference within.”

Waliur Rehman said Taliban has mujahids on all the fronts in South Waziristan for any possible operation there. (ANI)

Ruling UPFA wins Jaffna, but loses Vavuniya in Lanka post-war polls

Colombo, Aug.9 (ANI): President Mahinda Rajapaksa’s ruling United People’s Freedom Alliance (UPFA) has won Jaffna but lost Vavuniya in the first polls after the civil war against the Liberation Tigers of Tamil Eelam (LTTE) concluded in May this year.

According to the BBC, the turnout for the polls has been low and ballots are still being counted in the southern province of Uva.

The local elections came a day after the defence ministry said it had arrested the new head of the Tamil Tigers, Selvarasa Pathmanathan.

According to preliminary results, the UPFA secured 13 of the 23 seats available in Jaffna on Saturday. he Tamil National Alliance, a fractious but broadly pro-LTTE parliamentary grouping, came second with eight seats.

In Vavuniya, where turnout was 52 percent, the UPFA was pushed into third place, winning only two seats. The TNA came first with five of the 11 seats on the council, followed by a moderate Tamil grouping.

It was generally believed that the government would do well, having a broad coalition led in the north by a powerful and stridently anti-Tiger Tamil party, and having promised a “northern spring” of major development projects that would gradually return the region to normality.

As a result of its victory in the war, the government is expected to have done well in the Sinhalese-dominated southern province of Uva. (ANI)

Winehouse, Fielder-Civil ‘to be given quickie divorce today’

London, July 16(ANI): Amy Winehouse and husband Blake Fielder-Civil will be given a quickie divorce today after a two-yearlong tumultuous relationship.

The couple are to be granted Decree Nisi (non-absolute ruling) in the Family Division of the High Court.

However, they need to wait six weeks and one day before their divorce is officially finalised and a Decree Absolute is granted.

The development is expected to relieve the ‘Back to Black’ singer whose marriage was marked with violence.

In fact on one occasion Amy was spotted with her ballet slippers soaked in blood after a fight with Blake at the Sanderson hotel in August 2007.

“She is ready to move on following the end of the marriage. She has not had any contact with Blake for months and is focusing on the future. She’s finishing off her album and in good health,” the Mirror quoted her spokesman as saying.

Meanwhile, on being asked if she was happy to return to England after her long stay in St. Lucia, the Grammy Award winning singer replied “I don’t give a f***.”

The couple had first met in a pub in Camden, North London, in 2005 before they eloped to Miami to get married. (ANI)

Radio Pakistan’s Dalit propaganda exposed

Abohar, July 14(ANI): Radio Pakistan, in its recent Punjabi Durbar programme, has said Scheduled Castes (SCs) children are being denied admission in schools in India, but nothing can be further from the truth.

Shyam Lal Arora, the district president of the Recognised and Affiliated Schools Association, Punjab termed the report false and malicious propaganda.

“The Dalits are not being discriminated or ill treated here in India. The Dalit children have been given equal rights and status in every school, college, office and department. Pakistan is making such statements to create tension in this country,” said Arora.

“In villages also, Dalit children are being given admission without any discrimination. Pakistan’s statement that the Dalit community is being stopped from taking water from community taps in the country is completely wrong. Here, people of all religions and Dalits take water from the same tap,” Arora added.

Pakistan is trying to create a divide in this country by asserting that casteism is dominant in India.

Radio Pakistan’s propaganda on casteism in India stands exposed by the fact that since independence, the Indian Government has taken several initiatives to improve the socio-economic and literacy conditions of the less-privileged in the country.

For instance, the strategy of the Scheduled Castes Sub-Plan (SCSP), which was evolved in 1979, is one of the most important interventions through the planning process for social, economic and educational development of Scheduled Castes and for improvement in their working and living conditions.

As far as reservation of seats in educational institutes are concerned, the Central Government has reserved 27 per cent of higher education seats, and individual states have been given freedom to legislate further reservations.

In 2008, the Supreme Court had upheld the law that provides for 27 per cent reservation for Other Backward Castes (OBCs) in educational institutions supported by the Central Government, while ruling that the creamy layer among the OBCs should be excluded from the quota.

This shows that the caste system as it existed in the past has been formally abolished.

Radio Pakistan, therefore, needs to study the Indian Constitution before airing baseless allegations about India. (ANI)

PM says court’s verdict on Article 377 to be discussed with cabinet

On Board special flight, July 11 (ANI): Prime Minister Dr. Manmohan Singh has said the matter related to the Delhi High Court’s ruling on gay sex legalization will be discussed with his cabinet colleagues to seek their views in this regard.

Addressing a press conference onboard after attending the G8-G5 Summit at L’Aquila in Italy, Dr. Singh said, “I haven’t discussed the matter with my cabinet colleagues. Therefore, when I will go back, I will seek their views as to which anything further needs to be done or said in this regard.”

In a landmark verdict on July 2, the Delhi High Court legalized the homosexual behavior of consensual youths, which received a lot of opposition from the religious leaders.

It was earlier a criminal offence under Section 377 of Indian Penal Code (IPC).

On July 9, a two-judge Bench of the Supreme Court comprising Chief Justice K. G. Balkrishnan and Justice P Sathasivam issued notice to the Union Government to explain its stand on a petition challenging the Delhi High Court’s ruling.

The apex court posted the matter for hearing on July 20.

The Bench said that any interim order against the High Court verdict, if necessary, would be considered only after hearing the parties concerned.

The Bench also said they would hear the opinions of all the parties concerned before giving any interim order in this matter.

The apex court was hearing a plea filed by Suresh Kumar Kaushal, an astrologer. Notices were also issued to NAZ Foundation, and other respondents who were parties before the Delhi High Court. By Naveen Kapoor (ANI)

Supreme Court issues notice to center to reply on gay sex verdict by July 20

New Delhi, July 9 (ANI): A two judge bench of the Supreme Court comprising Chief Justice K. G. Balkrishnan and Justice P Sathasivam today issued notice to the Union Government, to explain its stand on a petition challenging the Delhi High Court’s ruling to legalize gay sex among consenting adults.

The apex court was hearing a plea filed by astrologer Suresh Kumar Kaushal against the Delhi High Court’s verdict.

Posting the next hearing to July 20, the bench said they would hear the opinions of all the parties concerned before giving any interim order in this matter.

Notices were also issued to NAZ Foundation, and other respondents who were parties before the Delhi High Court.

Now, the ball is in government’s court as it has to make its stand clear on the matter before the apex court when it take up the matter for hearing on July 20.

Except the Communist Party of India-Marxist (CPM), no political party has made its stand clear on the Delhi High Court’s ruling to quash Section 377 of the Indian Penal Code (IPC).

When the counsel appearing for Kaushal drag the attention of the bench about seven cases of gay marriages reported after Delhi high court’s verdict, the Bench made it clear that they have not changed the definition of marriage.

The Bench said the police had not been registering cases under Section 377 of IPC, and no body has been prosecuted. Thought the clause is in place since 1860 there have been a few cases under the penal provision except those of paedophile cases, the Judges said.

In the petition Kaushal said, homosexual behavior is against the Indian societal norms, if such abnormality is permitted, it will lead society towards a wrong path. (ANI)
