In the case filed in the Supreme Court, Zakiya stated that Modi and 62 others had conspired during the riots, and that senior ministers had ordered bureaucrats and policemen not to respond to calls for help. Over a thousand people died in the Gujarat communal riots.

New Delhi, Mar 15 (ANI): Noted advocate Ram Jethmalani on Monday filed an application before the Supreme Court seeking recall of its directions ordering a probe by a Special Investigation Team (SIT) into the 2002 Gujarat riots incidents.

Jetmalani moved the plea while appearing on behalf of former Bharatiya Janata Party (BJP) MLA, Kalu Marwari who was also summoned by the SIT along with Gujarat Chief Minister Narandra Modi for their alleged role during 2002 Gujarat riots.

Activists who are fighting for the 2002 Gujarat riots victims opined that it’s an attempt by Modi to legally question SIT’s intentions.

On Thursday, the SIT issued summons to Modi asking to depose before it on March 21.

The SIT led by former Central Bureau of Investigation (CBI) Director R K Raghavan would question Modi on his alleged role in Gulbarg Society carnage where over 60 people were killed on February 28, 2002.

The summons to Modi is in connection to a petition submitted by Zakia Jaffrey, the widow of Ehsan Jaffrey, a former Congress Member of Parliament, who was murdered during the Gulberg Society riots.

The Gulberg case is totally separate from the nine other cases related to the Gujarat pogrom.

Zakia Jaffrey had filed a 100-page complaint alleging the involvement of Modi and 62 others. (ANI)

Gujarat riot cases trials will come to end in less than a year: SIT chief

New Delhi, May 1 (ANI): Expressing happiness over the Supreme Court’s decision on Gujarat riots cases, the apex court-appointed Special Investigation Team (SIT) chief, R K Raghavan, on Friday said the trial of the cases would come to an end in less than a year.
“I cannot give a fixed deadline. I can only say that no time will be lost. I am hoping that these trials will come to a conclusion in about less than a year,” Raghavan said.

Raghavan’s reaction came after the apex court lifted the stay on the trials of the 2002 Gujarat riots cases.

“I am certainly happy with the judgement. I think it is going to facilitate the work of the SIT in Gujarat. I look forward to further work in that direction,” a former CBI director added.

Earlier in the day, the apex court ordered a retrial of the Gujarat riots cases by fast track courts.

The apex court also directed that the trial would not be shifted out of Gujarat.

Besides, it also ordered he filing of additional chargesheets against new accused named by the Special Investigating Team (SIT).

On April 27, the apex court asked the SIT to probe the role of 64 people, including that of Gujarat Chief Minister Narendra Modi in the cases. (ANI)

Raghavan panel reaches Himachal to probe ragging death

Shimla, April 9 (IANS) A three-member commitee of the Supreme Court Thursday reached Himachal Pradesh to probe the death of a first-year medical student last month allegedly due to ragging.

Aman Kachru, 19, died March 8, a few hours after being allegedly ragged by four final-year students of the Rajendra Prasad Medical College at Tanda town in Kangra district.

The magisterial inquiry as well as the police report pointed out that Kachru succumbed to his injuries caused during the ragging by the four senior students.

‘A three-member team of the Raghavan Committee this (Thursday) evening reached the medical college to investigate into the death of the first-year student,’ Anil Chauhan, the new principal of the medical college, told IANS on phone.

He said the committee members included A.K. Aggarwal, dean of the Maulana Azad Medical College in New Delhi, and Rajindra Prasad, principal of Ramjas College, Delhi.

‘They (the team) will study in detail ragging incidents in the college and the alleged negligence on the part of college authorities in treating the victim (Kachru),’ he said.

‘The team will remain here till Friday.’

The Raghavan panel will submit its report to the apex court before the next hearing in the case.

Earlier, a team of the Medical Council of India (MCI) had completed its probe and submitted it to the apex court.

The team had recorded the statements of doctors from various departments, staff of the college, Kachru’s friends and students.

State Principal Secretary (Health) Deepak Sanan said the government had initiated action on the report of the magisterial probe.

‘Show-cause notices have been issued to 40 persons, including two former principals of the college, in whose tenure ragging incidents had taken place from 2001 onwards. Their names cropped up in the magisterial inquiry report concerning the death of Kachru,’ he said.

They have been asked to file their replies by April 23, he said.

Former principal S. Shankayan was suspended on the directions of the apex court March 30.

A bench of Justice Arijit Pasayat and Justice Asok Kumar Ganguly ordered immediate suspension of Shankayan after the MCI and the Himachal Pradesh government, in their separate reports to the court, disclosed that he had ignored the incidents of ragging despite being informed about these by the security guards of the hostel.

Soon after Kachru’s death March 8, the state government divested him of the post of the college head, but let him continue as the head of the Department of Forensic Medicine in the college.

But infuriated over Shankayan’s inaction, the bench ordered his suspension, saying: ‘Don’t let him even enter the college premises.’

The bench observed that deaths and suicides by students ‘due to ragging is a national tragedy’.

Plea to junk elevated expressway project

CHENNAI: Beach-goers, fisherfolk, environmentalists and residents of Foreshore Estate, Olcott Kuppam and Orur Kuppam in Besant Nagar on Friday
demanded that the state government abandon its proposed 7.5-km six-lane elevated expressway along the beach from Marina to East Coast Road.

Under a newly formed forum, Save Chennai Beaches, an awareness and protest rally was held on Eliots beach. Members of the forum alleged that the project would disrupt fishing activity, displace coastal residents, disturb nesting turtles and damage ecologically sensitive areas such as the Theosophical Society and Adyar estuary, besides changing the face of residential areas.

Arun from Students Sea Turtle Conservation Network (SSTCN), a voluntary group, said that the construction of the expressway would disrupt the nesting spots of the Olive Ridley turtles, an endangered species listed in Schedule I of the Wildlife Act. SSTCN has been working since 1980 along the coastline, spreading awareness about the species and the need to conserve it. “We have so far saved more than 8,000 turtle hatchlings and released them safely into the sea. The proposed expressway will make it hell here,” he said.

After consultant Willbur Smith Associates Pvt Ltd, appointed by the highways department, conducted a detailed feasibility study last year, the government planned to start work on the corridor construction, from the Lighthouse to Foreshore Estate, crossing Adyar estuary and beyond, up to Ururkuppam. The alignment joins Besant Nagar Fifth Avenue Road near Eliots Beach, before the second phase in Kottivakkam takes over.

According to Madras high court senior advocate Sriram Panchu, both phases violated environmental rules and the coastal regulation zone (CRZ) notification, 1991. He added: “The proposal is a subversion of the masterplan, as it finds no mention in the document. Given the magnitude of the legal issues, I only hope and trust the government should realise the legal implications and withdraw the project.”

Theosophical Society general manager S Harihara Raghavan said the expressway would badly affect the fragile ecology in the Society grounds. “There were more than 160 migratory and native birds in the society, but it has come down to 80 now. The population of birds will be further affected in case the elevated expressway takes shape. The government should also think about the broken bridge near Srinivasapuram, which was washed away 30 years ago due to soil condition.”

M G Devasahayam, managing trustee, SUSTAIN, an NGO, said that various plans proposed by government agencies to reduce traffic congestion – upgradation of roads near Foreshore Estate, linking Greenways Road to Durgabai Deshmukh Road, reclamation of the four-lane carriageway on L B Road by removing encroachments and construction of a grade separator-cum-subway at the Tiruvanmiyur junction – should be implemented soon.

Members of Save Chennai Beaches plan to make a representation to the state government soon

Maya takes on Cong, SIT; says riot probe biased

Dr Maya Kodnani, former minister in the Modi government and an accused in the 2002 Naroda Patiya riot case, on Thursday alleged that the investigation carried out by the Supreme Court-appointed Special Investigation Team was biased. Terming her arrest as a political conspiracy, Kodnani accused the SIT of working at the behest of the Congress.

Kodnani levelled these allegations while talking to the media after she was produced before the Metropolitan Court by the SIT. The court extended her police remand for three more days along with that of former VHP general secretary Jaydeep

Patel.

Giving a political tone to her arrest, Kodnani said she has been subjected to atrocities, and that the people of the country, particularly the women, would give a fitting reply to this in the Lok Sabha elections.

She further said: “Yesterday, SIT chief R K Raghavan and C V Satpathy (an SIT member) were in their office. We tried to represent certain issues to Raghavan thrice, but he refused to meet us. This shows the prejudice with which the SIT is functioning.” “However, we have full faith in judiciary and are confident that we’ll come out of the case innocent,” she added.

Even Patel accused the SIT of conducting one-sided investigation. He also expressed his faith in judiciary, saying he was confident of coming out clean in the case.

The two leaders were produced before the magistrate in a packed courtroom.

When they were brought out, a number of people shouted slogans in their support.

Kodnani and Patel are accused of leading rioting mobs in the Naroda Patiya and Naroda Gam areas on the city’s outskirts, where 106 people were killed on February 28, 2002.

A number of witnesses in the case have stated to have seen them Patel near the rioting site, distributing inflammable material and weapons to the rioters.

Cong hits back at arrested minister, says state govt picked SIT members

REACTING to Maya Kodnani’s allegations that the Special Investigation Team (SIT) is working at the behest of the Congress, party’s Gujarat unit president Siddharth Patel said she levelled these charges to hide names of the ‘real people’ behind her arrest.

Patel said: “The SIT, probing some of the post-Godhra riot cases afresh, was constituted by the Supreme Court. The Gujarat government selected officers to SIT. So, how can the Congress be responsible for that?”

“The affidavit against Kodnani in the Sessions and Gujarat High Court was filed by the SIT. Also, her anticipatory bail was cancelled after SIT’s petition in the high court,” he said, adding: “So, it is quite obvious who are the real people behind this. Where does the Congress have a hand in this? Everything has been done by the Gujarat government.”

Kodnani, a BJP MLA, had resigned from the post of state minister after the Gujarat High Court cancelled her and co-accused Jaideep Patel’s anticipatory bail last week.

SC suspends Amann college principal

The Supreme Court on Monday ordered the immediate suspension of the principal of Rajendra Prasad Medical College in Kangra, Himachal Pradesh, for dereliction of duty in connection with the death of medical student Amann Kachroo. Kachroo reportedly died after suffering relentless ragging by his seniors.

The apex court also took note of a similar incident in a college in Guntur, Andhra Pradesh, in which a girl attempted suicide after being forced by seniors to dance in the nude. The court directed the Himachal Pradesh government to put principal Suresh Sankhayan under suspension.

Sankhayan, who quit immediately after Kachroo’s death, continues to teach in the college. “It would not be in the interest of the institution and the student community if the principal is allowed to be in the college,” Justice Pasayat said.

The order came after Additional Solicitor General Gopal Subramanium apprised the bench of the additional district magistrate’s report indicting the college administration for the incident and the lapses leading to Kachroo’s death. The bench also asked the Raghavan Committee to inquire into the incident and submit a report within two weeks.

The matter will heard again on April 20. Kachroo’s father Raj said, “I am happy with today’s proceedings but we have to ensure such incidents don’t happen in future.

” The court also sought an explanation from the Andhra government as to why no case has been registered against the principal of Bapatla Agriculture and amp; Engineering College.
