(“FTC”) and the Courts have taken affirmative steps to restrict the ability of
consumers and businesses to create or deliver “unverified” checks. G7, a leading
marketer of check printing and delivery solutions, has been a co-defendant in a
precedent setting case before the United States District Court in San Diego that
resulted in a Final Order (“Final Order”) which is hereby published. The Final
Order was recently affirmed by a panel of the Ninth Circuit Court of Appeals and
appoints G7 to implement new verification procedures associated with the
creation or delivery of checks. The FTC contends that any creation or delivery
of checks for existing and prospective customers is prohibited under the Final
Order unless G7 has first performed authentication of the customer`s identity
and the customer`s control over any bank account used in connection with the
check creation or delivery.

The provisions of the Final Order provide that Industry partners, participants
and publishers who are involved in the “creation” or “delivery” of a check for
an existing or prospective customer may be permanently restrained and enjoined
from allowing the creation or delivery of any checks unless the prospective
customer`s identity and account control have been verified through G7.

UPDATE 1-Pacific Ethanol units to emerge from bankruptcy

NEW YORK, June 9 (Reuters) – Pacific Ethanol Inc (PEIX.O), a producer of low-carbon renewable fuels, said on Wednesday that the plan of reorganization for its Pacific Ethanol Holding Co LLC unit had been confirmed, allowing the unit to emerge from bankruptcy.

The largest West Coast-based producer and marketer of ethanol had put its unit that operates production plants in California, Oregon and Idaho into bankruptcy in May 2009, to help restructure and eliminate about $290 million of debt. The company’s marketing arm, which buys and sells ethanol, did not file for Chapter 11.

In March, Sacramento, California-based Pacific Ethanol said it expected the unit to exit Chapter 11 near the end of the second quarter.

The ownership of Pacific Ethanol Holding and its four wholly owned ethanol production facility subsidiaries will be transferred to a newly formed holding company, the company said in a release.

Pacific Ethanol has an option to buy as much as 25 percent of the new company for up to $30 million in cash.

“Holding an option to purchase an equity interest in the facilities at a significant discount to replacement costs is a valuable opportunity for Pacific Ethanol,” Chief Executive and President Neil Koehler said in a statement.

Koehler added that the lower debt levels will allow the company to improve the two facilities currently running, and as market conditions permit, resume operations at two idled facilities.

The company, through its other subsidiaries not in bankruptcy, will continue marketing ethanol for third parties.

Pacific Ethanol shares were up 7 cents, or 9.6 percent, at 80 cents in afternoon trading on Nasdaq.

“Blade Runner”

LOS ANGELES (Reuters) – A blaster gun used by actor Harrison Ford to hunt down and kill futuristic humanoids in 1982 sci-fi film “Blade Runner” will be put on the auction block in an upcoming sale of Hollywood memorabilia.

Auctioneer Profiles in History expects about $3 million in total sales from the auction, which will include the collection of horror and science fiction promoter Forrest Ackerman and an animation puppet used in director Tim Burton’s 2005 movie “Corpse Bride.”

The “Blade Runner” blaster, with an estimated sales price of between $100,000 and $150,000, comes from Hollywood marketer and producer Jeff Walker, and Profiles in History called it the “holy grail” of sci-fi weapons.

The movie, directed by Ridley Scott, takes place in the year 2019 when Rick Deckard (Ford) is reluctantly drawn back to being a “blade runner” who tracks down and kills humanoid “replicants” that are revolting against real humans.

The movie was a critical success, but failed to ignite a great deal of excitement at box offices, earning just under $33 million. On video and DVD, however, it has gained a large following and become a cult classic.

Other items from Walker’s “Blade Runner” collection being sold include costumes that Ford wore in the 1982 movie.

Ackerman, who edited the now defunct magazine Famous Monsters of Filmland and spent a lifetime collecting props from science fiction and horror movies, died in December at age 92.

Items to be sold from his massive collection include a ring worn by actor Bela Lugosi when he played Count Dracula on screen, and a monocle that director Fritz Lang used when he made the 1927 science fiction movie “Metropolis.”

Other items include actress Rita Hayworth’s dress from 1946 movie “Gilda.”

Profiles in History will hold its spring sale April 30 and May 1 in Calabasas, California, allowing participants to bid live online from anywhere in the world.
