Lawsuit against Apple, AT&T can remain as class action:AP

(Reuters) – A monopoly abuse lawsuit against Apple Inc (AAPL.O) and AT&T Inc’s (T.N) mobile-phone unit can continue as a class action against the two companies, the Associated Press reported, citing a federal judge.

AT&T, the biggest U.S. phone company by revenue and the exclusive U.S. provider for iPhone, has come under withering criticism from iPhone users over its network quality since the smartphone went on sale in 2007.

The agency said an amended complaint filed in June 2008 deals with Apple’s practice of “locking” iPhones with AT&T’s network and its control over the applications that can be installed on its smartphone. The lawsuit also consolidates those filed by iPhone buyers starting in late 2007.

Parts of the lawsuit that deal with violations to antitrust law can continue as a class action, Judge James Ware of the U.S. District Court for the Northern District of California said in court documents filed on July 8, AP said.

Reuters was not able to contact Apple and AT&T out of regular U.S. office hours.

The lawsuit — which includes any iPhone buyer with a two-year AT&T agreement since June 2007 — also says Apple secretly made AT&T its exclusive iPhone partner in the U.S. for five years, dampening competition and driving up prices.

Early in June, AT&T announced plans to stop offering its unlimited pricing plan for new subscribers to its mobile data services, in an effort to improve the speed of its network by cutting down on network-clogging downloads. [ID:nN02173229]

According to the lawsuit, consumers found themselves locked into a five-year relationship with AT&T, AP said.

The lawsuit seeks an injunction to keep Apple from selling locked iPhones in the U.S. and from determining what iPhone programs people can install. Nigerian Sunrise offers $4.8 bln Exxon JV stakes -FT

(Reuters) – Nigerian energy company Sunrise has offered $4.8 billion to buy a stake in Exxon Mobil’s (XOM.N) joint venture in the country, the Financial Times said, citing people familiar with the matter.

The company is aiming at a 29 percent stake in the venture — with estimated reserves of 1.6 billion to 2 billion barrels and potential for more — in which Exxon holds a 40 percent stake and the rest by the Nigerian government, the paper said.

While the government is willing to part with a 19 percent stake in the venture, Sunrise is said to be attempting to gain an additional 10 percent from Exxon.

Exxon could not immediately be reached for comment by Reuters, outside regular U.S. business hours.

UPDATE 1-MDS posts wider Q2 loss on charges

(Reuters) – Canadian health sciences company MDS Inc (MDS.TO) reported a wider second-quarter loss from continuing operations, hurt by a restructuring charge and foreign exchange revaluation losses.

The company — which recently completed the sale of its analytical technologies and pharma services businesses — posted a loss of $52 million, or 51 cents a basic share, compared with a loss of $6 million, or 6 cents a share, a year ago.

It said the latest quarter’s loss includes a $14 million corporate restructuring charge and a $27 million non-cash foreign exchange revaluation loss.

Revenue for the quarter dropped 13 percent to $56 million, hurt by foreign exchange valuation.

Analysts, on average, were looking for a loss of 4 cents a share, before items, on revenue of $47.6 million, according to Thomson Reuters I/B/E/S.

Costco May same-store-sales lower than Street view

* Says May sales helped by extra day from holiday shift

(Reuters) – Costco Wholesale Corp (COST.O) said it saw May sales in stores open at least a year rise 9 percent, slightly less than Wall Street forecasts for the period, which included an extra day compared with a year ago due to the shift in the Memorial day holiday.

Analysts had expected the largest U.S. warehouse club operator to post sales of 9.7 percent, according to Thomson Reuters data.

For the four weeks ended May 30, the company said its net sales rose 11 percent to $6.09 billion from the previous year.

The shift in the Memorial Day holiday, which fell on May 31 this year, helped the May 2010 total and comparable sales by about 2 percent, the company said.

Including the benefit from the inflation in gasoline prices and strengthening foreign currencies, Costco said same-store-sales at U.S. locations climbed 7 percent, while international sales jumped 17 percent.

Shares in the Issaquah, Washington-based company closed at $58.95 Wednesday on Nasdaq.

London, June 4 (ANI): Queen of Pop Madonna has cast actor James D”arcy as King Edward VIII in her upcoming royal biopic W.E.

The singer is set to direct the film, based on the story of the former monarch, who abdicated the throne after falling in love with American divorcee Wallis Simpson.

Actress Andrea Riseborough, best known for her TV portrayal of former Prime Minister Margaret Thatcher, will play the woman who rocked the royal family, while Aussie beauty Abbie Cornish will star as a modern wife who compares herself to Wallis.

And now, Madonna has picked D”Arcy to take on the role of King Edward.

London, May 19 (ANI): Georgian singer Katie Melua has teamed up with Queen of Pop Madonna’s former producer William Orbit, who shot to fame for his work on the superstar’s album ‘Ray of Light’.

Melua, 25, admits that she was surprised when the dance producer expressed an interest in teaming up with her after he quit the industry.

“I was so lucky when he heard my new tracks and responded so well to them,” Sky News quoted her as saying.

“I didn’t actually that know he was in retirement and then we sent him the new songs and he got back to us straight away.

“He didn’t just like the up-tempo songs that I would have expected him to like. He also loved the acoustic, more personal songs,” she added. (ANI)

New York, May 15 (ANI): Elton John touched thousands of hearts, including Vanessa Redgrave’s – when he dedicated a song to her during his performance at Carnegie Hall.

Elton dedicated his famous “I Guess That”s Why They Call It the Blues” to Redgrave, who recently lost her daughter, Natasha Richardson, sister Lynn Redgrave and brother Corin Redgrave.

“She”s had a hell of a year. Vanessa, this is to you with love from me and all the artists on the stage,” The New York Post quoted him as saying.

Her brother died in April, and her sister died earlier this month. Vanessa was “nearly in tears” at the tribute and was ushered backstage during intermission.

New York, May 13 (ANI): Only two years ago Naomi Campbell compared kabbalah to Alcoholics Anonymous, but the supermodel is now reportedly meeting Madonna”s kabbalah mentor, Eitan Yardeni.

According to sources, Campbell met Yardeni at Manhattan”s Kabbalah Center shortly before flying to Europe with her Russian billionaire boyfriend, Vladimir Doronin, reports the New York Post.

In 2008 Campbell had criticised the sect, saying, “I knew about kabbalah before Madonna got involved. Kabbalah is not a religion, it”s a program. I don”t like to get hooked on things like that. It re minds me of AA, but just with differ ent words.

Madonna cancels auction of her journals on eBay

London, May 6 (ANI): Madonna has cancelled the sale of journals written by her on eBay.

The Material Girl star sent her representatives to take her journals off the auction after an unknown man alleged that he had placed 12 personal tomes allegedly written by Madonna between 1988 and 1992 on the website, and was hoping to earn millions of pounds for the possessions, reports The Daily Star.

The eBay user claims that he bought the journals and other personal items that include the superstar’s photos, for just 100 pounds in a blind auction from a storage facility in Chatsworth, California.

Madonna’s representatives however, insisted that ‘they’ were the rightful owners of the periodicals and convinced the auctioneers to take them off the website, according to TMZ.com.

A spokesperson for the auction website has confirmed the cancellation after the singer”s reps contacted them to make a claim.

However, the unnamed seller is still reportedly insisting the items belong to him. (ANI)

New York, May 6 (ANI): Queen of Pop Madonna has flaunted her toned body, wearing a variety of ensembles, ranging from an eye-patch to lacy lingerie for a magazine photoshoot.

Madonna, 51, seductively tugged at her underwear in one photo, while in another she sensually rested a crucifix on her mouth, as she posed for the May issue of Interview magazine.

She also spoke to film director Gus Van Sant about how she balances work and life as a single mother.

“I tend to write during the day so I can see my children at night,” the New York Daily News quoted her as saying.

“But if my kids aren’t with me and I have a chunk of time when I’m a single woman living in my house for a miraculous week, I will get to write at different hours.

Madonna’s Glee album tops US chart

London, April 30 (ANI): Madonna’s album for American musical-comedy drama Glee is at the number one spot in the US album chart.

Official figures reveal that the album, named Power of Madonna, sold 98,000 copies in its opening week. AC/DC came second with their latest album for Iron Man 2, reports BBC.

Nielsen SoundScan said that about 3/4th sales of the album were through downloads.

Two previous releases from the TV show, the music from its first two seasons, made the top five.

The new album includes Madonna’s hits including Like a Prayer and Vogue. (ANI)

Madonna to continue to be face of Dolce & Gabbana

London, April 29(ANI): Madonna’s contract with Dolce and Gabbana, as the face of the company, has been renewed.

She is apparently the only one to remain a face of the top clothing brand at the age of 51.

The singer will feature in the clothing company’s autumn/winter 2010 ad campaign.

“The shooting is going very well!!!… She”s beautiful… Love this!!!” Sky News quoted Stefano Gabbana, D&G”s co-founder, as writing on Twitter.

He added: “Madonna… She”s always the best!!!!”

After Madonna, “Glee” creator wants Britney

New York, April 28(ANI): Musical television series ‘Glee’ creator Ryan Murphy is hoping to devote an entire episode to the music of Britney Spears.

A similar episode dedicated to Madonna had been aired earlier.

Murphy’s manager floated the idea via Twitter following the Queen of Pop episode.

“I”m interested in the Britney Spears idea. I”ve always loved her,” the New York Post quoted Murphy as telling Entertainment Weekly.

He added: “I”m entertaining it. I think young kids would like that.”

Murphy also hopes to do similar shows on Led Zeppelin, Billy Joel and Courtney Love.

Hockeyroos beat Chile, Cup hopes unclear

Hockeyroos captain Madonna Blyth admits it is hard having the side’s hopes of reaching the women’s World Cup clouded by the travel crisis caused by a volcano eruption in Iceland.

The Australian team is in Chile awaiting teams from Ireland, Scotland and Malaysia to join it for a five-nation qualifying tournament, where the winner will secure a berth at the World Cup, to be held in Argentina later this year.

The Irish and Scottish teams cannot leave Europe because of the huge shroud of dust in the air across the continent caused by last week’s eruption of the Eyjafjoell volcano.

Malaysia was originally set to travel to Chile via Europe, but is understood to be making changes to its travel plans.

The Hockeyroos beat Chile – the other nation in the qualifying tournament – 4-0 in a warm-up game on Tuesday (AEST), and are likely to play another scratch match against the host nation this week while officials determine what shape the tournament takes.

The tournament is scheduled to start on Saturday, and played on a round-robin basis before a May 2 final.

Australia’s first tournament game is scheduled for Sunday, against Chile.

Blyth said the uncertainty was a worry for all five teams, but all the Hockeyroos could do was hope for the best and prepare like they were playing.

“The hardest thing is not knowing, you’re not really sure what’s going to happen,” she said.

“But we just have to prepare for whatever happens and I think our group’s quite good at that.

“Hopefully we play the tournament that we’re supposed to play and those teams arrive, but if it changes slightly we’re ready no matter what for the first game, ready to play.”

Australia is desperate for Ireland, Scotland and Malaysia to arrive in Santiago, as Hockey Australia has indicated it cannot afford to pay for more expensive flights and accommodation costs if the tournament is relocated to another country.

The Hockeyroos and Chile were locked 0-0 at half-time, but after the break Nicole Arrold and Kobie McGurk converted from penalty corners and Claire Messent and Amy Korner scored field goals to seal a comfortable win.

“We did quite well, we haven’t played Chile before and we haven’t seen a lot of them, so we weren’t sure what to expect,” Blyth said.

“But considering it was our first game over here I think it was quite good and to get used to the conditions will be an advantage going into the tournament.”

McGurk’s goal capped a sound return to the international ranks after 10 months out through a serious knee injury.

Australia was forced to qualify through this tournament because it lost to New Zealand in Oceania qualifying last year, but are a warm favourite to win in Santiago.
