Ex-defence secretary takes over as CVC today

NEW DELHI: Pradeep Kumar, the outgoing defence secretary and the next Chief Vigilance Commissioner, says corruption remains a very major challenge and would have to be dealt at all levels.

Kumar will be sworn in as the CVC on Thursday, almost four months after PJ Thomas's appointment was quashed by the Supreme Court because of a pending chargesheet against him. The President will administer the oath of office to the 62-year-old IAS officer at Rashtrapati Bhavan at 11 am, officials said.

“Corruption is a very major challenge,” Kumar said on Wednesday, discussing the challenges of heading the country's anti-corruption watchdog at a time when a spirited debate over several scandals and the efficacies of the present anti-corruption mechanisms has gripped the nation.

Kumar, a Haryana cadre IAS officer who was set to complete his mandated two-year term as defence secretary on July 31, was unanimously chosen as the next CVC by a panel comprising Prime Minister Manmohan Singh, home minister P Chidambaram and Leader of Opposition in Lok Sabha Sushma Swaraj. He will have a tenure of little over three years.

Meanwhile, PJ Thomas on Wednesday moved the Delhi High Court demanding a stay on the appointment of Kumar. Through his writ petition, Thomas sought a direction to the President not to issue the warrant of appointment to Kumar since she was yet to decide on Thomas's represe

ntation to her against the judgment of the apex court.

Government sources said that Rashtrapati Bhavan had referred Thomas's petition within days to the Department of Personnel and Training for appropriate action.

In his representation to the President on March 16, Thomas had requested her to refer the decision of the apex court to a constitution bench, arguing the SC bench had no jurisdiction to cancel his appointment as only a five-judge bench could have adjudicated the case. The President cancelled Thomas's appointment as CVC on March 15, 11 days after the apex court order.

“The warrant of appointment of Thomas was cancelled only on the basis of the said judgment. When the legality and the validity of the judgment itself is disputed, it is our humble view that only after reaching conclusion on the legality and validity of the judgment, the respondent (President) should go ahead with the appointment of new CVC,” the petition argued, urging the HC to intervene.

The petition cites Article 145 (3) of the Constitution, saying issues connected with the interpretation of the Constitution have to be decided by a minimum five-judge bench and therefore assails the SC three-judge bench verdict.

The SC had quashed the appointment of Thomas as CVC as a chargesheet was pending against him in the palmolein corruption case in Kerala. Thomas was appointed as CVC in September 2010.

Gadkari’s remarks on discipline evoke discussion at BJP meet

Uttan (Maharashtra), June 6 (IANS) Bharatiya Janata Party president Nitin Gadkari’s blunt remarks on party discipline at the two-day party conclave here became a topic of discussion Sunday – the concluding day of the event.

The party chief’s observations on ego clashes among different party workers and leaders – whom he did not name – led to intense speculation over who he was referring to or even targeting.

‘I once thought very highly of some party leaders, but after becoming BJP president, I realised that some of them were short-sighted,’ Gadkari said Saturday at the ‘National Convention on Good Governance’.

He also urged all party workers and leaders to work with good team spirit under the leadership of the chief ministers and deputy chief ministers of states where the party was in power and avoid ego clashes. He also expressed concern over bickering in the party at various levels.

Surprisingly, the chief ministers present on the occasion were hardly seen interacting with each other though the convention was all about sharing their own experiences in good governance, including party manifesto agendas in governance and inspiring other state heads to learn from their examples.

Gadkari also emphasised the spirit of nationalism which defined its political character and shunned sycophancy in any form – be it large garlands, erecting huge hoardings or touching the feet of leaders – as part of Congress ‘traditions’.

Meanwhile, Leader of Opposition in Lok Sabha Sushma Swaraj would deliver the concluding remarks at the end of the meet as senior leader L.K. Advani was indisposed and skipped the convention. BJP’s deputy leader in Lok Sabha Gopinath Munde was also absent from the crucial meet.

The chief ministers of the BJP-ruled Gujarat, Madhya Pradesh, Uttarakhand, Himachal Pradesh and Karnataka were present at the convention. Chhattisgarh’s Raman Singh was absent owing to his father’s death a day before the meet.

Besides deputy chief ministers of two states and party presidents of eight states, 73 ministers were also present at the meet — which was a closed-door affair — conducted in the sylvan surroundings of Uttan, a village on the Arabian Sea coast, around 40 km north of Mumbai.

Advani skips party convention

Uttan (Maharashtra), June 6 (IANS) Senior Bharatiya Janata Party (BJP) leader L.K. Advani Sunday skipped the ongoing two-day party convention being held here due to ill health, a party official said.

Advani was scheduled to make a concluding speech Sunday afternoon but his trip was postponed at the last minute, the official told IANS.

In his place, opposition leader in the Lok Sabha Sushma Swaraj was to make the concluding remarks on the charter of ‘National Convention on Good Governance’.

The convention has been a closed-door affair, conducted in the sylvan surroundings of Uttan, a village on the Arabian Sea coast, around 40 km north of Mumbai.

The morning session Sunday was addressed by senior party leaders M. Venkaiah Naidu and Ananth Kumar, among others.

A total 83 delegates were invited for what is billed as the ‘first of its kind convention involving so many state leaders on the vital issue of good governance’.

Besides party president Nitin Gadkari, who was present on the opening Saturday, the convention was attended by five chief ministers of BJP-ruled states. However, Chhattisgarh Chief Minister Raman Kumar could not make it as he lost his father a day before the event.

Two deputy chief ministers, including Sushilkumar Modi from Bihar and 73 ministers, besides the party chiefs of eight states also marked their attendance.

This is the first major convention of the BJP being held in Maharashtra after Gadkari, who hails from Nagpur, took over as party chief last year.

Not Mayawati, Akhilesh framed me in fraud case: Amar

Expelled Samajwadi Party leader Amar Singh on Sunday mounted a frontal attack against SP chief Mulayam Singh Yadav’s son and Lok Sabha MP Akhilesh Yadav, alleging that he was behind the case of Rs 500 crore financial fraud registered against him in Kanpur last year.

“First of all, I want to apologise to UP CM Mayawati because it was not she but the brother and son of the SP supremo (Mulayam Singh Yadav) who got me framed in the case lodged at Babupurva police station (in Kanpur),” Amar Singh wrote in his latest blog post, without naming Ram Gopal Yadav (Mulayam’s brother) and Akhilesh.

Amar Singh was referring to an FIR lodged against him and his wife Pankaja in Babupurva police station (in Kanpur) in October last year in connection with a financial fraud. The complainant, advocate Shiv Kant Tiwari, had alleged that the couple had amassed nearly Rs 500 crore between 2003 and 2008.

“A functionary of my old party (SP) was given Rs 5 crore in first tranche and then Rs 2 crore in second trance, a total of Rs 7 crore, to frame me,” he alleged, claiming that one Dhirendra Sahay, whom he describes as Akhilesh Yadav’s friend, among others, which included a Congress Member of Parliament and a senior bureaucrat in Mayawati administration, were aware of the conspiracy from the very beginning.

Mamata should quit as railway minister: CPI-M

New Delhi, May 31 (IANS) Railway Minister Mamata Banerjee should quit on account of her ‘good relationship’ with Maoists, the Communist Party of India-Marxist (CPI-M) said Monday.

Accusing the minister of having a ‘good relationship’ with those who derailed a train in West Bengal killing at least 145 people, CPI-M leader Basudeb Acharia asked the Trinamool Congress chief to resign from the cabinet on moral grounds.

‘She (Mamata) has no moral right to continue as a member of the union cabinet. She enjoys good relations with the Maoists as well as the leaders of the People’s Committee Against Police Atrocities (PCAPA), the frontal organisation of the Maoists,’ Acharia told IANS.

He accused Banerjee of protecting the Maoist leaders, who he said were to blame for the derailment of the Howrah-Kurla Gyaneshwari Express in Jhargram in West Bengal Friday.

‘It is the duty of the Railway Protection Force to oversee the safety of the tracks in Maoist areas. They failed to do it. The minister failed to act on time. I’ve not seen such a dismal performance by any other railway minister,’ said Acharia, who heads the CPI-M in the Lok Sabha.

‘Mamata is the worst railway minister the country has ever seen.’ he said.

‘Now the media has interviewed the real mastermind, a PCAPA leader, who has admitted his role in the accident.’

On Saturday, Banerjee demanded a Central Bureau of Investigation (CBI) probe into the train disaster, calling it a political conspiracy ahead of Sunday’s civic polls.

The CPI-M leader, who was chairman of the parliamentary standing committee on railways in the first United Progressive Alliance (UPA) government, said the railways failed to provide security to its passengers.

A day after municipal elections in West Bengal, the veteran MP claimed that the Left Front, which suffered a huge setback in West Bengal in the 2009 general elections, would improve its tally in the civic polls.

‘We are expecting an improvement over the Lok Sabha election,’ he said. The civic poll results will be declared Wednesday.

RJD MP delays President Patil’s flight in China

Beijing/Luoyang, May 29 (IANS) President Pratibha Patil’s flight from Beijing to Luoyang was delayed by 20 minutes Saturday as Lok Sabha MP Raghuvansh Prasad Singh arrived late to board the special Chinese aircraft.

Singh, who is from the Rashtriya Janata Dal (RJD) party of Lalu Yadav, however, blamed mismanagement for the delay, saying he had not been informed about the boarding time.

President Patil was to take the flight at 9 a.m. but was delayed by 20 minutes.

‘There was confusion and mismanagement. That is why I got delayed and couldn’t be a part of the cavalcade that was taking the president to the Beijing airport,’ Prasad said.

‘I was not informed about what time I had to board the plane and I couldn’t handle the electronic key to the lift and the room,’ the former rural development minister said.

Since the special Chinese flight could not take off on time, other flights at the busy Beijing airport also got delayed, officials said.

Patil is on a six-day visit to China. The visit ends May 31.

In Luyoang, President Patil dedicated an Indian-style Buddhist temple, inspired by the Sanchi Stupa, to the Chinese people.

Munde’s nephew gets Council ticket

Mumbai, May 29 — Senior Bharatiya Janata Party leader Gopinath Munde has managed to get a poll ticket for a member of his family. His nephew, Dhananjay Munde was on Friday made an official candidate for the State Legislative Council polls to be held on June 10.

The BJP gave the second seat from its quota to ex-minister and ex-Member of Legislative Assembly (MLA) Shobhatai Fadnavis. The single Rajya Sabha seat will go to the party’s national treasurer, Piyush Goyal.

The BJP’s Parliamentary Board, which met in New Delhi on Friday, also announced the candidature of ex-youth wing president Suhas Pharande for the council polls from the graduates constituency. This poll will be held next month.

This will be the third political representation in the Munde family. Gopinath is the party’s deputy leader in the Lok Sabha and his elder daughter Pankaja won the 2009 Assembly elections for Parli in Marathwada.

When Munde didn’t get Dhananjay an Assembly ticket last year, he managed one for Madhusudan Kendre, the son-in-law of Munde’s elder brother. But Kendre lost the elections.

Jaya snubs SP, sides with Amar

New Delhi, May 28 — Actress-turned-politician Jaya Bachchan on Friday snubbed the Samajwadi Party (SP) by declining its offer for a Rajya Sabha seat, barely two days after the party appeared to have weaned her away from old friend, Amar Singh. A stunned SP leadership confirmed that Jaya informed them about her decision “to take a break from politics”, in a move being seen as a victory for Singh, who was expelled from the party in February. Top SP leaders, including party chief, Mulayam Singh Yadav, were at a loss of words to explain why the actress was nominated for the Upper House, given her close ties with Amar Singh. Asked by reporters in Lucknow whether Jaya’s husband, Amitabh could be behind her decision, a disappointed Yadav replied : “Amitabh Bachchan has never liked politics. He was elected for the Lok Sabha but after a brief period, he resigned from there.” Indications of SP having miscalculated the situation came in the form of Jaya’s silence following the announcement on Wednesday. Her renomination to Rajya Sabha was being seen as a reward by the party for not siding with Singh, after his expulsion. However, the Bachchan family’s decision not to desert their decades-old family friend Singh appeared to be a result of the meeting between Amitabh and Singh in Mumbai on Thursday. There were reports of relations being strained between the two recently, after Singh made his displeasure public on Jaya’s continuation in the SP.

Having lost out in this round, the SP hurriedly announced party spokesperson Mohan Singh’s name in Jaya’s place, a known Amar Singh baiter.

Despite deadlock, Patil hopeful about passage of Women’s Reservation Bill

On Board Air India One, May 26 (ANI): Despite the deadlock in the Lok Sabha over the passage of the Women’s Reservation Bill, President Pratibha Devisingh Patil has said that she is hopeful about its passage.

Speaking to reporters enroute to Beijing on Wednesday, Patil said: “I wish that the Women’s Reservation Bill is passed in the Lok Sabha.”

Now, it is to be seen how the UPA Government, which has still four years in power, manages the requisite support for the passage of the Bill,” she added.

The Bill was passed in the Rajya Sabha with help of marshals who prevented some members of the opposition from disturbing the process.

Parliamentarians of the ruling party and the opposition, however, have said that they are against its forceful passage.

It has been more than a decade since the Bill was first introduce in Parliament (1996-97).

Last month, Union Finance Minister Pranab Mukherjee presided over an all-party meeting to discuss the Bill, but failed to reach or arrive at a consensus on it.

Rashtriya Janata Dal chief Lalu Prasad and Samajwadi Party chief Mulayam Singh Yadav proved to be the main opponents of the Bill in its present form.

Lalu Prasad has demanded a quota for Muslim and Dalit women, and women of other backward castes.

At that time Lalu said he was grateful to the government for calling an all-party meeting on the issue, but reiterated his commitment to have Muslim, backward and Dalit women included in the ambit of the Bill

After the meetiing, Railway Minister Mamata Banerjee said the Bill would look after the interests of the minorities.

Janata Dal (United) President Sharad Yadav also demanded a quota within a quota.

Congress president Sonia Gandhi is demanding that the Bill be passed in its present form.

The Rajya Sabha had last month passed a Constitution Amendment Bill that provides for 33 per cent reservation of women in Parliament and state assemblies.

President Patil is visiting China from May 26-31 and will hold discussions with the Chinese leadership.

Commenting on her visit, which coincides with the 60th anniversary of the establishment of diplomatic relations between India and China, President Patil said her visit is part of the process of high-level contacts between the two countries.

President Patil said that Chinese President Hu Jintao’s state visit to India in 2006 had generated a great deal of goodwill between the two countries, and added, that during the visit of Prime Minister Manmohan Singh to China in 2008, the two countries concluded a “Shared Vision for the 21st Century” which forms the basis for bilateral cooperation on global issues.

She also said that India and China are two large and populous countries and both of them are focussed on enhancing economic growth and social progress, so there are many areas in which the two countries can exchange views and learn from each other”s experiences. (ANI)

Army Hospital provides proper treatment to Cobalt-60 exposed patients

New Delhi, May 14 (ANI): The Army Hospital (Research and Referral) would soon discharge the two patients exposed to radiation from nuclear scrap.

“The two patients have shown good recovery over the last few weeks and their condition is near normal. Their condition is clinically stable and free of any infection or bleeding,” said Lt. General Naresh Kumar, Commandant, Research and Referral Hospital.

Thirty-two year old Deepak Jain and forty-year old Ajay Jain were admitted to the hospital last month with low blood counts due to bone marrow suppression following accidental radiation exposure to Cobalt-60 at a scrap shop in the Mayapuri area of the city.

“Despite being released from the hospital in a day or two, the doctors would continue to closely monitor the condition of the two patients. Ajay Jain”s wound is healing well,” said Lt. General Naresh Kumar.

“Volunteer donors having 100 percent matching Human Lymphocyte Antigen (HLA) have been kept on standby for bone marrow transplant if their condition worsens,” he added.

Delhi University has reportedly come under the scanner after it was let known that the laboratory of the varsity”s Chemistry Department had disposed off the radioactive metal as scrap resulting in one death and critical injuries to a couple of other persons.

The Union Government on Friday said that Delhi University had violated rules by selling scrap containing radioactive material.

Making a statement in the Lok Sabha, Union Minister of State for Science and Technology Prithviraj Chavan assured members that those responsible for the violation would not be spared.

Delhi Chief Minister Sheila Dikshit had earlier said that the experts from the Department of Atomic Energy are probing and analysing the entire issue.

“We are doing that. Even the university people are looking after it. We have also received a statement from the Vice Chancellor. Apart from this, people from the Department of Atomic Energy are looking into it as well, as we don”t have such expertise,” Dikshit added.

The Delhi Police is investigation at “criminal negligence” part in the radiation caused by Cobalt-60.

Rajender, 35, a worker at a shop in Mayapuri scrap market, had died due to multiple organ failure this week at All India Institute of Medical Sciences (AIIMS) after being exposed to the radiation.

Ten sources of Cobalt-60 had later been discovered in the Mayapuri scrap market.

Cobalt-60 is a radioactive isotope of cobalt, which is a hard, lustrous, grey metal. It is used in cancer therapy machines and other medical equipment. (ANI)

BJP to form government in Jharakhand with JMM, AJSU support

New Delhi, May 8 (ANI): Bharatiya Janata Party (BJP)-led National Democratic Alliance (NDA) government will head the coalition government to be formed with the support of Jharkhand Mukti Morcha (JMM) party in Jharkhand.

On Saturday morning, putting an end to the stalemate over the formation of a new government in the State, BJP President Nitin Gadkari held meeting with Hemant Soren, son of Shibu Soren, the JMM chief, as well as Sudesh Mahato, chief of the All Jharkhand Students Union”s (AJSU) here on Saturday morning.

The leaders decided that the BJP, JMM and AJSU would be the three coalition partners to form the new BJP-led National Democratic Alliance (NDA) government in Jharkhand.

“We have had a healthy discussion with all the prominent leaders of the parties. We have decided to form the government under the leadership of the Bharatiya Janata Party because the state needs a strong coalition government. And we have tried to save the state from the President”s rule,” said Hemant Soren.

BJP spokesperson Ananth Kumar also told reporters that the party is hoping to form a stable government to keep the State away from President”s Rule.

“In Jharkhand, under a BJP-led government and NDA rule, we are expecting to form a stable government. We have to form and run a progressive government. All the coalition parties have also decided that we will finish the remaining tenure. And we hope to run a people”s government,” Kumar said.

BJP will choose the new chief minister for the State.

The leaders of the coalition parties, however, will meet on May 10 for further discussions in this matter.

It may be recalled that the BJP had withdrawn support to Shibu Soren”s JMM-led coalition government in Jharkhand on April 28 after he voted for the Congress-led United Progressive Alliance government during a cut motion brought up by the opposition in Lok Sabha on April 27.

Shibu Soren and Hemant Soren had subsequently written apology letters to BJP leaders, expressing their preference at remaining aligned with the BJP.

BJP leadership had recently held talks with its Jharkhand allies – the regional Jharkhand Mukti Morcha (JMM), All Jharkhand Students Union (AJSU), the Janata Dal (United), and others.

The JMM-BJP coalition government was formed in Jharkhand about four months ago. (ANI)

DU has violated radioactive waste rules: Centre

New Delhi, May 7 (ANI): The Union Government on Friday said that Delhi University had violated rules by selling scrap containing radioactive material.

Making a statement in the Lok Sabha, Union Minister of State for Science and Technology Prithviraj Chavan assured members that those responsible for the violation would not be spared.

“Mistake was made by the University in not adhering to rules and its own undertaking to atomic energy authorities that the device, which was used by its Chemistry Department, would not be re-sold,” Chavan said.

He said the DU authorities did not follow rules and asserted that responsibility will be fixed.

“No guilty person will be spared, I assure you,” Chavan said.

He asserted that all the 19 nuclear plants generating electricity in the country were completely safe and mechanisms would be strengthened in the field of atomic research and medical use as “some lessons have been learnt” from the accident in which one person died.

Chavan informed the House that the Delhi Police had upgraded the FIR in the case after one person died.

The Delhi Police is investigation at “criminal negligence” part in the radiation caused by Cobalt-60.

Chavan argued the need to put in place a law on fixing compensation in the case of accidents involving radioactive leakages as there was a “void”.

Asserting that the radiation incident “has nothing to do” with any of the Department of Atomic Energy (DAE) facilities or activities, he said the Atomic Energy Regulatory Board (AERB) had a complete inventory of all radioactive sources in the country.

There were 10,000 sources with about 3,000 institutions and licenses were given to users which were “very responsible,” Chavan said.

He said the incident was caused by “unauthorised disposal” of the Gamma Cell by Delhi University as scrap in violation of the Atomic Energy Safe Disposal of Radioactive Waste Rules and the Atomic Energy (Radiation Protection) Rules. (ANI)

Decision on caste based census soon: PM

New Delhi, May 7 (ANI): The Prime Minister, Dr. Manmohan Singh on Friday assured Parliament that his government would soon take a decision on a caste-based census.

“I am aware of the views of the members of Parliament belonging to all sections. I assure you that the Cabinet will take a decision shortly,” Dr. Singh said.

Dr. Singh’s statement mollified agitated opposition members, who had forced an adjournment of the House earlier after Union Home Minister P Chidambaram virtually ruled out inclusion of caste in the ongoing census exercise.

The debate on the matter had seen members cutting across party lines favoring caste-based census.

Earlier, Union Home Minister P Chidambaram said that the question of caste not being included in the Census was a matter of policy which has been followed since Independence.

“After Independence, as a matter of policy, the question relating to caste, other than Scheduled Caste and Scheduled Tribe, was not included,” Chidambaram said.

“The main objective of the Population Census is to do an accurate de-facto headcount of the usual residents in India on the deemed date i.e. 00.00 hours on March 1, 2011, based on universally applied scientific demographic tools, we have an estimate of what the population of India will be on that day,” he added.

Replying to a short duration discussion in the Lok Sabha, Chidambaram stressed on the need to lay down specific parameters for conducting the census.

Information relating to the caste of each member of the household was last collected and published in detail in 1931.

Chidambaram said caste was not included in the last Census of 2001 also.

“I may point out that the records show that an attempt was made by the Ministry of Social Justice to include caste as one of the questions that should be canvassed during the 2001 census. However, the Government of the day – the NDA Government – did not take a decision to that effect and maintained the policy that has been in force since 1951,” he said.

Quoting a member’s statement during the debate Chidambaram said: “Caste is a divisive factor and that we are nowhere near establishing a casteless society.”

Chidambaram said the Registrar General of India has also pointed out a number of logistic and practical difficulties in canvassing the question of caste while conducting the census.

“The enumerator is not an investigator or verifier. And, it must be clearly understood, that the enumerator has no training or expertise to classify the answer as OBC or otherwise,” he said.

“As Honorable Members are aware, there is a central list of Other Backward Classes and State-specific lists of Other Backward Classes. Some States do not have a list of OBCs; some States have a list of OBCs and a sub-set called Most Backward Classes,” he added.

For the Census 2011, over 21 lakh enumerators, mostly primary school teachers, have been selected and trained to ask the question and record the answer as returned by the respondent.

He further said that the Registrar General has also pointed out certain open-ended categories in the lists such as orphans and destitute children.

“Names of some castes are found in both the list of Scheduled Castes and list of OBCs. Scheduled Castes converted to Christianity or Islam are also treated differently in different States. The status of a migrant from one State to another and the status of children of inter-caste marriage, in terms of caste classification, are also vexed questions,” Chidambaram said.

“The Registrar General has also pointed out that, assuming that it is desirable to canvass the question of caste, further issues will arise regarding the methodology, avoiding phonetic and spelling errors, stage of canvassing, maintaining the integrity of the enumeration, doing an accurate headcount of the population etc,” he added.

Chidambaram said that in this connection, members must keep the distinction between ‘enumeration’ on the one hand and ‘compilation, analysis and dissemination’ on the other.

“It has been pointed out that the census is meant to collect ‘observational data,’ he said.

The census is done under the authority of the Census Act, 1948.

Census 2011 will be the 15th national census since 1872 and the seventh since Independence.

Population census is the total process of collecting demographic, economic and social data. What is published as the Census data are only aggregates; the information relating to the individual is confidential and not shared with anyone or any authority.

Census 2011 will be conducted in two phases – the first phase is called the House listing and Housing census and the second phase is called the Population Enumeration.

The questions to be canvassed during the two phases were decided on the basis of suggestions made during the data users’ conference, experience of past censuses and the recommendations of the Technical Advisory Committee (TAC) comprising eminent demographers, statisticians, social scientists and senior officers representing different Ministries and Departments of the Central Government. Uproar in Parliament over Nuclear Liability Bill

New Delhi, May 7 (ANI): The controversial Civil Liability for Nuclear Damage Bill was introduced in the Lok Sabha on Friday, amidst a walkout staged by opposition.

As Minister of State for Science and Technology, Prithviraj Chavan sought permission to introduce the Bill, CPI (M) members Basudeb Acharia and Ramchandra Dome, BJP leaders M M Joshi, Yashwant Sinha and CPI leader Gurudas Dasgupta said the proposed Bill would violate Article 21 of the Constitution, a fundamental right that guarantees right to life.

They said the Bill also compromises the right of victims to approach courts for enhanced compensation.

Leader of Opposition Sushma Swaraj said her party had conveyed to Prime Minister Dr. Manmohan Singh that the Bill should be amended but the government was adamant on introducing it in the present form.

“It”s illegal and unconstitutional,” said Yashwant Sinha.

He also accused the government of acting under US pressure.

The passage of the Bill is considered important for starting nuclear commerce between India and international community.
It also paves the way for appointment of claims commissioner and establishment of nuclear damage claims commission.

Earlier, the government had listed the bill for introduction on March 15, but had to defer it at the last moment after it realised that it did not have the requisite numbers to see its introduction in the Lok Sabha.

In the present form, the Bill limits liability to the operator for each nuclear incident at Rs 500 crore, which is the main issue of contention. (ANI)

Nuclear Liability Bill to be introduced in Parliament today

New Delhi, May 7 (ANI): The UPA Government is likely to introduce the controversial Civil Liability for Nuclear Damage Bill in the Lok Sabha on Friday, the last day of the current Budget session.

The Bill is listed in the schedule of business for the Lower House for today.

It is expected that the government would refer it to a Parliamentary Standing Committee after winning a trial of strength in Lok Sabha during opposition-sponsored cut motions.

The Left is likely to ask for a division when the government introduces the proposed legislation.

BJP stages demo before parliament over misuse of CBI by Centre

New Delhi, May 6 (ANI): The Bharatiya Janata Party (BJP) on Thursday staged a protest before Parliament charging Union Government with misuse of the Central Bureau of Investigation (CBI).

It said the UPA Government was using the CBI in cases of disproportionate assets against several politicians.

The demonstration was staged in front of the Mahatma Gandhi statue inside the Parliament complexes.

Leader of Opposition in the Lok Sabha Sushma Swaraj alleged that the CBI is being used to target opposition parties.

“We were observing for many days that the CBI was working as an agent for the ruling party instead of being a just and independent body. It worked to defend the people of the ruling party and attack the people of the opposition parties,” Swaraj said.

“It was deliberately harassing some parties to please the ruling party. The biggest example of this was seen when cut motion was brought up in Parliament. So to protest against the conspiracy of the CBI against the opposition parties, we have staged the demonstration today, “ she added.

Leaders of the National Democratic Alliance and its members of both Houses of Parliament took part in the protest.

Earlier in the week, the BJP had accused the CBI of acting at the behest of the Central Government in the Gujarat’s Sohrabuddin Sheikh fake encounter case.

The party also accused that the UPA Government was using the CBI to give a bad name to the democratically elected Narendra Modi Government of Gujarat.

The BJP had earlier alleged that government had misused the CBI to speed up or slow down disproportionate assets cases against Samajwadi Party (SP) chief Mulayam Singh Yadav, Rashtriya Janata Dal (RJD) chief Lalu Prasad and Bahujan Samaj Party (BSP) chief and Uttar Pradesh Chief Minister Mayawati. The three parties voted with the government in the recent cut motions moved by the BJP and Left parties. (ANI)

BJP tenders apology over ‘Gaddar’ remarks in Parliament

New Delhi, May 6 (ANI): The Bharatiya Janata Party (BJP) on Thursday tendered an unconditional apology for alleged remarks made by its member Ananth Kumar in the Lok Sabha against Rashtriya Janata Dal (RJD) chief Lalu Prasad.

On Wednesday, certain words used by Kumar during his speech on Census 2011, resulted in a heated debate between him and Lalu Prasad.

As soon as the House met for the day, Leader of Opposition Sushma Swaraj submitted the apology.

“I unconditionally apologise for the remarks made by Ananth Kumar yesterday,” she said.

When Prasad sought to intervene, Swaraj said in a lighter vein, “I also apologise on behalf of Laluji also.”

“There is a lot of important business to be done in the House. I appeal to members to help in the smooth running of the House,” Swaraj added.

Kumar, who was present in the House, however, did not say anything on the matter.

On Wednesday, Kumar had insisted that he had not made the remarks against Prasad and would neither apologise nor withdraw them.

“I will neither apologise nor withdraw my comments,” Kumar had said.

Swaraj said Kumar has not denied using both “Gaddar ” and “rashtravirodhi” words during his speech.

However, Swaraj maintained that Kumar had not used these two words against Prasad.

She said there was a misunderstanding among the Samajwadi Party (SP), the RJD and other members.

“But one should understand the context in which Kumar mentioned them. Our notice demanding a discussion on Census was against the column ”nationality as declared” in the National Population Register (NPR) form. Gaddar word per se is unparliamentary but not in this context,” Swaraj said.

On Wednesday evening, the Lok Sabha was adjourned twice, after Kumar and Prasad had a strong exchange over Bangladeshi’s being registered as Indian citizen in the current Census.

Kumar drew the attention of the House to the alleged activities of Bangladeshi refugees and the attempt by illegal migrants to register themselves as Indian citizens.

He asked whether members of the House are with pro-Nationals or with anti nationals, and alleged that the Bangladeshi effort was not happening without the support of some politicians.

This agitated Prasad so much so that he tried to walk over to Kumar, but SP chief Mulayam Singh stopped him. (ANI)

MPLADS constitutionally valid, says Supreme Court

New Delhi, May 6 (ANI): In landmark judgement, the Supreme Court on Thursday upheld the constitutional validity of the MP’s Local Area Development (MPLAD) Fund.

A Constitutional Bench of the apex court consisting Chief Justice of India K G Balakrishnan and Justices R V Raveendran, D K Jain, P Sathasivam and J M Panchal delivered the judgement while setting aside a petition filed by Jammu and Kashmir Panthers Party president Prof Bhim Singh.

In his petition, Singh had questioned the constitutional validity of the MPLAD fund and stated that the MPLAD fund has lead to a lot of corruption.

In 1999, the MPLADS was challenged on the ground that it intruded into the autonomy and functioning of local authorities – village panchayats and municipalities – created under a constitutional amendment.

In 2006, a three-Judge Bench had referred the matter to a five-Judge Constitution Bench saying important questions of law needed to be settled.

After pending adjudication for years, a constitution Bench of the apex court had reserved its verdict in November 2009 on the issue.

The Court had to conduct some more hearings after the Union Government requested permission to make more submissions.

Under the MPLAD Fund, members of both Lok Sabha and Rjya Sabha gets two crore in each fiscal, which could be used for both planned as well as unplanned projects.

The MPLAD Fund was the brainchild of the then Prime Minister P V Narasimha Rao. In 1993, Rao’s Government allotted one crore to each MPs for development activities in their respective constituency.

In 1998, the NDA Government led by A B Vajpayee hiked the MPLAD fund to two crore.

In April this year, the Planning Commission had rejected the proposal of some MPs to enhance MPLAD funds to Rs five crore from Rs two crore.

The scheme had come under judicial scrutiny in the wake of a sting operation “Duryo-Dhan” in 2005 that had shown some MPs demanding money from contractors to award work for projects under MPLAD scheme.

The expose had led to the expulsion of the members from both the Houses of Parliament.

The MPLAD scheme was in the news also in 2006 following allegations that trusts run by Election Commissioner Navin Chawla”s family got funds from the scheme. (ANI)

CPI-M seeks apology from Trinamool over unparliamentarily language against its leader

New Delhi, May 5 (ANI): The Communist Party of India-Marxist (CPI-M) on Wednesday sought an apology from the opposition Trinamool Congress over the alleged derogatory remarks made by its leader Sudip Bandyopadhyay against CPI-M leader Basudeb Acharia inside the Parliament.

“From the very beginning we have seen whenever we try to say anything inside the House, immediately all the Trinamool members shout, and interrupt, disturb so they are doing this thing from very beginning,” said CPI-M leader Basudeb Acharia.

“Strategy, we will ask, request the Speaker to ask him to apologise,” he added.

Meanwhile, CPI-M State Secretary Biman Bose said the Parliament should deal with the matter.

“Actually this issue has to be dealt with by the parliament and the custodian, they are to look after the issue seriously,” said Bose.

Controversial remarks disrupted Parliament on Wednesday leading to adjournments of each of the Lok Sabha and the Rajya Sabha, with an angry opposition seeking an apology.
