Option of Modi being summoned remains open, says Nanavati Commission

Gandhinagar, Apr 1(ANI): The Nanavati Commission, which is probing the 2002 Godhra incident, on Thursday informed the Gujarat High Court that its decision to not summon Gujarat Chief Minister Narendra Modi was not the final decision.

The Commission was today responding to a notice sent by the High Court on March 22, in which it was asked from the Nanavati Commission to clarify whether it would summon Modi by April 1.

The High Court was acting on the petition filed by the Jan Sangharsh Manch (JSM), which had moved an application before the Nanavati Commission in April 2007 demanding that Modi be summoned for questioning.

Talking about today’s proceedings in the court, JSM lawyer Mukul Sinha said: “The proceedings were based on our request for the Chief Minister (Modi) to be summoned before the Nanavati panel.”

“In September 2009, the Nanavati Commission had declined to summon the Chief Minister, but today they have replied to the High Court’s notice saying their decision of not summoning Modi is not final and the option of him being summoned remains open,” Sinha added.

Sinha further informed that the next hearing regarding the issue would be on 17 June.

This would spell more trouble for Modi, who was questioned by the Supreme Court appointed Special Investigation Team (SIT) on March 27 for over five hours regarding his role in the 2002 Gujarat communal riots. (ANI)

Veraval riots: Nanavati Commission not to issue notice against Modi

Ahmedabad, Sep.19 (ANI): In a major reprieve for Gujarat Chief Minister Narendra Modi, the Justice Girish Thakorlal Nanavati Commission on Saturday confirmed that it would not be issuing any notice to him in connection with the communal riots in Veraval.

However, the commission has asked the State Government to give it transcripts of the conversations that took place prior to the riots, during the riots and in its aftermath.

The commission has so far given a clean chit to Modi in the post-Godhra events. The Nanavati Commission said there was no evidence to show there was lapse in Modi’s or his ministers’ role in providing protection, relief and rehabilitation to the victims of communal riots or in the matter of not complying with the recommendations and direction given by the National Human Rights Commission.

Communal attacks on Muslims took place in Gujarat between February and May 2002.

The riots occurred after the burning of the Sabarmati Express. According to official figures tabled in the parliament, more than a thousand people were killed (790 Muslims and 254 Hindus) in the violence after the train incident. More than two hundred and fifty thousand people were displaced (about 200,000 Muslims and 40,000 Hindus).

Organizations such as Human Rights Watch criticized the Indian government for failure to address the resulting humanitarian condition of people, “overwhelming majority of them Muslim,” who fled their homes for relief camps in the aftermath of the events.

Many of the investigations and prosecution of those accused of violence during the riots have been opened for reinvestigation and prosecution. According to an official estimate, 1044 people were killed in the violence, including those killed in the Godhra train fire. Another 223 people were reported missing, 2,548 injured, 919 women widowed and 606 children orphaned. About 100,000 Muslims and 40,000 Hindus were in relief camps. (ANI)

Gujarat HC judge declines to hear case against Modi

Ahmedabad, July 7 (ANI): A Gujarat High Court judge has declined to hear a case challenging a probe by the Special Investigation Team (SIT) against state Chief Minister Narendra Modi and 62 others in the 2002 post-Godhra riots.

Citing personal reasons, Justice H N Devani in the High Court said: “Not before me”.

The court was scheduled to hear the case as SIT officials, complainant Zakia Jafri and social activist Teesta Setalvad have already filed their replies.

The writ petition was filed on June 5 by former BJP MLA from Lunavada, Kalu Maliwad against the probe being conducted by SIT with regard to a complaint made by widow of ex-MP from Congress Ahsan Jafri.

In her complaint Jafri ‘s wife alleged that Modi, his cabinet colleagues, police officials and senior bureaucrats aided and abetted post-Godhra riots.

Jafri was killed with 38 persons in Gulberg society in 2002.

The Supreme Court had ordered the SIT to probe the complaint within three months and submit its report. Maliwad, who was acquitted, has said that the Supreme Court directed the SIT to look into Jafri’s complaint. (ANI)

Gujarat plans to build 1460 km gas pipeline

Gandhinagar, June 30 (IANS) The Gujarat government is planning to build a 1,460-km pipeline for the transportation of gas from the Krishna-Godavari (KG) fields off the Andhra Pradesh coast to other parts of the country.

The state government has submitted a proposal in this regard to the Petroleum and Natural Gas Regulatory Board (PNGRB), a senior official in the department of energy here said.

The proposed pipeline, from Mallavaram in Andhra Pradesh and to Bhilwara in Rajasthan, will transport gas from the fields of Gujarat State Petroleum Corp Ltd (GSPCL).

The pipeline will pass through major cities like Warangal, Amaravati, Nagpur, Bhopal, Indore, Udaipur and Godhra in Gujarat, the official said.

GSPCL, which won the KG exploration block in 2003 through a competitive bidding, has so far drilled 15 wells, out of which 11 wells are discovery wells.

Three wells have shown no gas flow and one is yet to be tested, the official said.

Gujarat High Court names nine judges for 2002 riot cases

Ahmedabad, May 8 (ANI): The Gujarat High Court has designated nine judges for as many special fast track courts to carry out the trial in the 2002 post-Godhra riot cases being probed by the Supreme Court-appointed Special Investigation Team (SIT).

Out of the nine special courts, four will be in Ahmedabad, two each in Mehsana and Anand, and one in Himmatnagar of Sabarkantha district.

According to the court’s order, additional sessions judge P R Patel has been designated to conduct the trial in the Godhra train carnage case that will be held in the premises of the Sabarmati Central Jail here.

Judge S H Vora and additional sessions Judge Jyotsna Yagnik will be presiding over the trial of Naroda Gam and Naroda Patiya cases respectively.

Judge B U Joshi has been designated as judge for the special court dealing with the Gulberg Society massacre case, where Congress ex-MP Ehsan Jaffery was killed.

Justices B N Kariya and S C Srivastava will handle the two cases in Mehsana district.

Judges S Y Trivedi and R M Sarine will conduct the trial in two cases in Khambodaj and Ode of Anand district respectively.

Judge H P Patel will oversee the Prantij taluka riot case of of Sabarkantha district where some British nationals were also killed. The special court will be based in Himmatnagar, the district headquarters.

On May 1, the Supreme Court ordered day-to-day hearing of the Gujarat riot cases by fast track courts in the state.

While vacating its stay order of November 21, 2003, the apex court directed that witnesses be provided security for their safe passage and if necessary at their place of living during the trial.

The court said the SIT would act as a nodal agency to decide as to which witnesses in the case should be given protection and relocated. The apex court also gave liberty to the SIT to recommend cancellation of bail if it is considered necessary. (ANI)

Congress welcomes Supreme Court’s order lifting stay on Gujarat riots trial

New Delhi, May 2 (ANI): The Congress Party has termed the Supreme Court’s order lifting the stay on trial of Gujarat riots cases as “historic.”

“This is one of the most historic orders of the Supreme Court. It gives a ray of hope to the victims of both the incidence at Godhra train as well as what happened after it. At last, the people of Gujarat and the people of the country are thankful to the court for continuing to live up to the expectations of the people,” said Kapil Sibal, party’s senior leader on Friday. eanwhile, the BJP termed the judgment as normal procedure of court to promote justice.

“This judgment only promotes and benefits the course of justice. Our party has already stated that it welcome the judgment,” said senior BJP leader, Arun Jaitley.

On Friday, the apex court ordered a retrial of the Gujarat riots cases by fast track courts.

The apex court also directed that the trial would not be shifted out of Gujarat.

Besides, it also ordered the filing of additional chargesheets against new accused named by the Special Investigating Team (SIT).

Advocate files contempt petition against Modi on Godhra remark

New Delhi, May 1 (ANI): An advocate filed a petition before the Supreme Court on Friday seeking contempt proceedings against Gujarat Chief Minister Narendra Modi for his remarks in connection with the probe ordered against him and others for post-Godhra riots.

Prashant Bhushan, who has been assisting the Court as amicus curiae in the matter of Jakia Nasim, wife of former Congress MP Ehsan Jafri, alleged that Modi had suggested the Supreme Court-ordered probe was a conspiracy of the Congress party.

It may be recalled that Jakia Nasim has accused the Gujarat Government of not entertaining her complaint relating to Jafri, who was killed in the 2002 riots.

An apex court bench headed by Chief Justice K G Balakrishnan has said that it will hear the contempt petition next week.

Modi said on Tuesday that he is ready to go to jail if his involvement in the 2002 Godhra riots is proved.

“I will abide by the Supreme Court directives and fully cooperate in any probe. I am willing to go to jail if my involvement is proved by the Special Investigation Team (SIT) in the post-Godhra riots,” he said at an election rally in Anand, Gujarat.

“The criminals like Quattrocchi are getting bail, and Indians are being put into jails. I am ready for any challenge and would not kneel down,” Modi had said.

The SIT had filed a 300-page supplementary chargesheet against 24 people in the Naroda Gam case in which 11 people, belonging to the minority community, were killed by a mob during the riots.

The accused include, Fula Vyas of VHP, local BJP leader Jitendra Patel and ex-BJP municipal councilor Ashok Patel.

The SIT has also filed a second charge sheet in Naroda Patiya case against 15 accused, where over 80 people were killed during the Godhra riots.

The third chargesheet in the Gulburg society case, named some VHP and BJP leaders in the list of absconders among the 14 accused, where 38 people were killed.

The five-member SIT team is headed by R. Raghavan, and includes former Deputy General of Police C.D. Satpathy and three Indian Police officers-Geetha Johri, Shivanand Jha and Ashish Bhatia.

Media persons attacked in Gujarat by BJP activists

Ghatlodia (Gujarat), Apr 28 (ANI): Bharatiya Janata Party (BJP) activists allegedly attacked media persons and caused damage to their belongings in Ghatlodia area of Gandhinagar, the parliamentary constituency of the party’s prime ministerial candidate L K Advani from Gujarat.

They were angry over the Supreme Court’s directive to probe into role of Gujarat Chief Minister Narendra Modi and others in the post-Godhra riots case in .

The attack took place ahead of the arrival of Advani and Modi.

Immediately after the attack, media persons decided to boycott the rally and demanded an apology from the BJP leaders.

On Monday, the Supreme Court asked the SIT to probe the role of 64 people, including that of Modi in the post-Godhra riots cases.

The apex court order was passed in response to a petition filed by Congress parliamentarian Ehsaan Jaffery.

Ex-IPS man who fought rioters now in BJP

Retired IPS officer A I Saiyed, who had a brush with the rioting mobs in the 2002 post-Godhra violence in Ahmedabad, has joined the Bharatiya Janata Party (BJP).

A day after joining the party, reportedly on the invitation of the BJP Gujarat president, Purshottam Rupala, Saiyed said, “I have received over two dozen phone calls greeting me for the bold initiative I have taken.” But why the BJP, that too at this juncture? He said the party is better than the Congress to join hands “at this juncture”.

“People are happy at this development and even met me personally. But their names cannot be revealed now,” he said when asked about the reaction from his community, adding, he would rope in more members from the community.

A 1978-batch IPS officer, Saiyed retired as an Additional Director General of Police and currently lives in the Muslim-dominated ghetto of Ahmedabad city- Juhapura. A native of north Gujarat, Saiyed said he joined the BJP as he was impressed by Chief Minister Narendra Modi’s administrative acumen.

When Saiyed was the Joint Director of the Gujarat Police Academy in 2002, during the riots, a mob of around 1,000 people had stopped his official car and tried to attack him after spotting his nameplate on his uniform. He remembers that his driver, a Hindu, had raced the car away to safety.

Saiyed said the incident has no bearing on his joining the BJP, and that he is willing to do any work that would be given to him in the coming days of election campaign, including canvassing for Patan BJP candidate Bhavsinh Rathore among local Muslims.

“I have done so much for all communities during my service that my presence itself in the area will be good enough for the people to vote for our candidate,” said Saiyed, who feels the dual policies of Muslim leaders pushed him to the BJP. Talking of ideology? “The Congress has an ideology, but only on paper,” he said

What will he gain from joining the BJP and what was his expectation, especially when the top BJP leaders openly tell Muslims that they could join the party at their own risk and peril without expecting anything? Saiyed responded to this saying he was not expecting any favours. “Expecting things like a party position or ticket is not my nature,” said Saiyed, whose entry to the BJP was cleared at all the levels after a prolonged process.

Welcoming this, BJP’s minority cell convener Sajjad Heera said it was a sign of the party gaining acceptance among “good Muslims” and this would improve the party’s image among the community members soon.

Maya takes on Cong, SIT; says riot probe biased

Dr Maya Kodnani, former minister in the Modi government and an accused in the 2002 Naroda Patiya riot case, on Thursday alleged that the investigation carried out by the Supreme Court-appointed Special Investigation Team was biased. Terming her arrest as a political conspiracy, Kodnani accused the SIT of working at the behest of the Congress.

Kodnani levelled these allegations while talking to the media after she was produced before the Metropolitan Court by the SIT. The court extended her police remand for three more days along with that of former VHP general secretary Jaydeep

Patel.

Giving a political tone to her arrest, Kodnani said she has been subjected to atrocities, and that the people of the country, particularly the women, would give a fitting reply to this in the Lok Sabha elections.

She further said: “Yesterday, SIT chief R K Raghavan and C V Satpathy (an SIT member) were in their office. We tried to represent certain issues to Raghavan thrice, but he refused to meet us. This shows the prejudice with which the SIT is functioning.” “However, we have full faith in judiciary and are confident that we’ll come out of the case innocent,” she added.

Even Patel accused the SIT of conducting one-sided investigation. He also expressed his faith in judiciary, saying he was confident of coming out clean in the case.

The two leaders were produced before the magistrate in a packed courtroom.

When they were brought out, a number of people shouted slogans in their support.

Kodnani and Patel are accused of leading rioting mobs in the Naroda Patiya and Naroda Gam areas on the city’s outskirts, where 106 people were killed on February 28, 2002.

A number of witnesses in the case have stated to have seen them Patel near the rioting site, distributing inflammable material and weapons to the rioters.

Cong hits back at arrested minister, says state govt picked SIT members

REACTING to Maya Kodnani’s allegations that the Special Investigation Team (SIT) is working at the behest of the Congress, party’s Gujarat unit president Siddharth Patel said she levelled these charges to hide names of the ‘real people’ behind her arrest.

Patel said: “The SIT, probing some of the post-Godhra riot cases afresh, was constituted by the Supreme Court. The Gujarat government selected officers to SIT. So, how can the Congress be responsible for that?”

“The affidavit against Kodnani in the Sessions and Gujarat High Court was filed by the SIT. Also, her anticipatory bail was cancelled after SIT’s petition in the high court,” he said, adding: “So, it is quite obvious who are the real people behind this. Where does the Congress have a hand in this? Everything has been done by the Gujarat government.”

Kodnani, a BJP MLA, had resigned from the post of state minister after the Gujarat High Court cancelled her and co-accused Jaideep Patel’s anticipatory bail last week.

Ahmedabad court extends police remand of Mayaben Kodnani, Jaideep Patel till April 4

Ahmedabad, Apr 1 (ANI): A local court here on Wednesday extended the police custody of former Gujarat Minister of State for Women’s Welfare, Mayaben Kodnani, and Vishwa Hindu Parishad leader, Jaideep Patel, till April 4.

Metropolitan Magistrate G M Patel extended their police custody after the Special Investigation Team (SIT), appointed by the Supreme Court to probe some of the riot cases afresh, asked for further remand.

On March 29, Kodnani and Patel were remanded in four-day police custody in connection with the 2002 post-Godhra riots case.

Kodnani and Patel’s anticipatory bail was cancelled by Gujarat High Court, after which they had surrendered before the SIT.
Kodnani, who was Minister of State for Women and Child Welfare and Higher Education in the Narendra Modi Government, had resigned from her post shortly after the High Court order.

Kodnani, a three-time MLA from the Naroda constituency, is an accused in the Naroda Gam and Naroda Patiya massacre cases in which around 95 people were killed in the communal violence of 2002. (ANI)

Gujarat HC rejects Maya Kodnani’s bail plea

Ahmedabad, Mar 27 (ANI): The Gujarat High Court has rejected the anticipatory bail of Gujarat Women Development and Child Welfare Minister Maya Kodnani.
Kodnani, who is accused for having led a mob in the post-Godhra riots in 2002, had seeked a stay in the judgement for a period of six weeks.

The Gujarat high court on Monday had reserved its order on the application filed by the Special Investigation Team (SIT) challenging the anticipatory bail granted to Kodnani, and VHP leader Jaideep Patel.

Justice DH Waghela also heard the applications filed by three witnesses of the 2002 riots cases seeking to join as party in the application submitted by the SIT.

Appearing for the witnesses, lawyers Mukul Sinha and SH Iyer submitted that 28 people affected by the riots had filed complaints before the police in 2002 when they were in the Shah Alam relief camp, out of which two had named Kodnani and around 20 had named Patel.

The lawyer submitted that the police had omitted the names of the two leaders in the clubbed FIR.

The SIT also refuted allegations raised by Kodnani’s counsel, Mahesh Jethmalani, that the SIT had been working with “mala fide” intentions to tarnish her image.

Mallika Sarabhai to contest against Advani from Gandhinagar

Ahmedabad, Mar 20 (ANI): Renowned dancer and social activist Mallika Sarabhai has said that she would contest in the general elections as an independent candidate from Gandhinagar.

This is the constituency from where Bharatiya Janata Party (BJP) ‘s L K Advani was elected in the previous elections and is again contesting this time, also as the party’s prime ministerial candidate.

Sarabhai, who had posed stern opposition to the Hindu rightist factions in Gujarat, said that for the past several years she had been prompted by a host of her well-wishers to enter the political arena and contest in the elections.

“When my friends, admirers, and my social activist friends told me that the time has come to enter politics, so I thought hard. Today, I decided to contest as an independent candidate in Gujarat,” said Sarabhai.

Further, she noted that the place she will represent the ‘secular forces’ and is no way scared to fight against a seasoned politician and tough contender like Advani.

“It is my privilege that from where I am contesting also happens to be the constituency in which the prime ministerial aspirant is also a candidate,” added Sarabhai.

Sarabhai was in the forefront in lashing out at Gujarat’s Chief Minister Narendra Modi by blaming him for inciting the post-Godhra communal violence of 2002 in Gujarat. (ANI)

Congress demands removal of Gujarat minister

New Delhi, Mar. 16 (ANI): A group of Congress MLAs from Gujarat met with President Pratibha Patil in New Delhi on Monday to demand immediate removal of Gujarat cabinet Minister for Higher Education Maya Kodnani.

Kodnani, who is the Women and Child Welfare Minister in the Narendra Modi’s Government, is accused for having led a mob in the post-Godhra riots in 2002.

The delegation sought President’s intervention in case the State government does not take any appropriate action against Kodnani.

“We have requested the President that if the Gujarat Government doesn’t take any action then according to the Constitution, the President must force the Gujarat Government to take right action and remove her (Kodnani) from the minister’s chair,” Congress Chief, Gujarat, Siddharth Patel told reporters after meeting the President.

The MLA’s further alleged that despite the Special Investigation Team (SIT) having declared Kodnani as an offender in an affidavit submitted to the Gujarat High Court, Modi Government has not removed her from the Cabinet.

Kodnani obtained an anticipatory bail from a lower court, which has now been challenged in the Gujarat High Court by the Special Investigation Team. (ANI)

Putting behind 2002 riots, Muslim voters in Gujarat move on to development

Ahmedabad, Mar 5 (AN): Though unable to forget the riots of 2002, the Muslim voters in Gujarat have decided to take it in their stride and move on to development.

Mufti Shabbir Ahmed Siddiqui, the chief of Ahmedabad’s Jama Masjid said, “What happened in 2002 cannot be forgotten easily, but it is time to move on.”

“No doubt, atrocities were committed against us in 2002. But I am sure, that will not happen in the future either. Today people of all religions are progressing and everybody is happy. Gujarat is doing well,” Siddiqui added.

Other Muslims living in the state also feel that the environment is peaceful and conducive for co-existence of various religions.

“We cannot forget nor will anyone in the coming generations. But the Narendra Modi government has done a lot for the state. A lot of development is taking place, children are getting education and things are good,” said Mohammed Ashraf, a Businessman.

Modi is accused of encouraging communal riots in 2002 in which between 1,200 and 2,500 people were killed, most of them Muslims.

The riots followed an incident of the burning of train in Godhra in which 59 Hindu pilgrims were killed. (ANI)

Godhra riots: Gujarat HC issues notice to Maya Kodnani

Ahmedabad, Feb 24 (ANI): The Gujarat High Court on Tuesday issued notice to state minister Maya Kodnani on an application filed by the Special Investigation Team (SIT) seeking cancellation of her anticipatory bail.

The Court has also issued notice to Vishva Hindu Parishad (VHP) leader Jaideep Patel and asked the two to explain the reason for not admitting a petition and fixing the hearing for March 2.

The petition has come up before Justice D. H. Waghela as earlier Justice A. S. Dave had refused to take up the case.

Kodnani is accused in Naroda Patiya and Naorda Gam case, while Patel is accused in the Naroda Gam case.

In Naorda Patiya case, 95 people were killed and 38 injured while in Naroda Gam case, 11 people were died and nine injured during the post-Godhra riots.

SIT had claimed in an affidavit that Maya was instigating the mob to commit crime. It has also been revealed that she distributed swords among the mob.

SIT was formed by the Supreme Court to reinvestigate nine post Godhra riot cases in Gujarat. (ANI)
