Lahore High Court issues notice to Zardari over holding two offices

Lahore, May 18 (ANI): The Lahore High Court (LHC) has issued a notice to President Asif Ali Zardari over the legality of holding two offices of interest.

Hearing a petition filed by the Pakistan Lawyers Forum (PLF) challenging the right of Zardari to hold on to the Pakistan People’s Party (PPP) chief’s post, the high court directed Zardari’s Principal Secretary to explain the legality of President dual posts.

“Since the president could not appear because of security reasons, the court asked his principal secretary to appear in court on May 25,” The Daily Times quoted PLF president A.K. Dogar, as saying.

Dogar said that though there was no constitutional bar on the President holding office in a political party, the Supreme Court had barred a president from holding a party post.

“Our Supreme Court judges decided in 1993 that the president should be non-partisan. He should not involve himself in political battles. He should shun politics but here he is a party head, which is illegal,” he said.

Meanwhile, Prime Minister Yousuf Raza Gilani has come out openly in favour of Zardari over the issue, saying there are no legal bar on holding two offices at a time.

President Zardari can keep two offices at a time and there is no constitutional or legal bar whatsoever, Gilani told media persons during a brief interaction here. (ANI)

Pak intelligence agencies warns of attacks on US citizens, ex-intelligence officials

Lahore, Mar.20 (ANI): Pakistani intelligence agencies have warned of terror attacks
on US citizens and former secret services officials.

According to intelligence reports, suicide bombers from Kohat region might use a black Honda city have entered the Punjab province to wreak havoc in the region targeting foreign nationals in particular.

The provincial Home Department has alerted all senior police officials of the region and has directed the concerned agencies to take immediate steps to prevent any untoward incident.

Punjab Police Inspector General (IG) Tariq Saleem Dogar has also been directed to provide foolproof security to US citizens and retired intelligence officials across the region, The Daily Times reports. (ANI)

Cases against Hafiz Saeed very weak, says his lawyer

Lahore/New Delhi/ Ashgabat, Sep.19 (ANI): A lawyer representing Jamaat-ud-Dawa (JuD) chief Hafiz Mohammad Saeed has said the two cases filed against his client are very weak and not sustainable in any court of law.

Saeed’s lawyer A K Dongar said the charges against his client were ridiculous.

Dogar was referring to the two cases filed by Faisalabad Police – one relating to his sermon at the Royalton Hotel in Faisalabad’s Canal Road on August 27, and second for a speech at an Iftar dinner at Peoples Colony, Jaranwala Road Faisalabad on August 26, where he urged people to launch a holy war against those who’ve suppressed their rights.

“I have gone through both the FIRs against Saeed thoroughly. The charges against my client are very weak. He has expressed his views like any other Pakistani,” claimed Dogar.

According to the TIMES NOW television channel, two cases were registered against Saeed and one against his close aide Abu Jandal at police stations in Faisalabad, some 100 kilometers from Lahore.

On Friday, Indian Home Minister P. Chidambaram said Islamabad must question Saeed, notwithstanding the fact that two cases had been filed against him that were not related to that tragic event.

Chidambaram said the authorities should avail the opportunity of questioning Saeed on the 26/11 episode also, once he is arrested.

“…I am told that it’s (FIRs agaisnt Hafiz Saeed) not related to the 26/11 attacks. Even if they apprehending him on some other charge, and use the opportunity to question him on his involvement in 26/11 attacks, that would be a significant progress in the case. I hope that they question him on 26/22 too,” Chidambaram told TIMES NOW after his US visit.

Insisting that Saeed should be tried for his involvement in the 26/11 terror attack, Chidambaram said: “There is no trial there. The trial has not started there. In fact, my complaint has been even before I visited the US, that we don’t have a date set for the trial and to best of the my knowledge, the first witness has not been examined.

Indian External Affairs Minister S.M. Krishna also asserted that the main agenda of his meeting with his Pakistani counterpart Shah Mehmood Qureshi in New York would be to pressurise Islamabad in taking action against perpetrators of last year’s Mumbai terror attack.

Krishna said this while speaking to media persons at Turkmen capital Ashgabat during his visit to that country on Friday.

“I cannot spell out what exactly I can expect from such meetings. But this much I can assure that my attempt would be to impress upon the Pakistan foreign minister the desirability of taking action against the brains behind the Mumbai attack,” said Krishna.

The Foreign Ministers of India and Pakistan and diplomats of the two nuclear-armed rivals are scheduled to meet in New York next week on the sidelines of the 64th session of the UN General Assembly. (ANI)

Dr A Q Khan clarifies

Islamabad, Aug.28 (ANI): Pakistan’s former chief nuclear scientist A Q Khan has given a clarification to the recent spate of reactions to his article on the importance of computer technology.

The News quotes him as saying: “The acknowledgement as to the source was put at the end of Part II because it was originally written as one long article. Had Mr Dogar, who initiated this controversy, waited for the second part (Part I clearly said “To be continued”), all this would have been avoided.”

“However, I would like to point out that a newspaper article is not the same as a research paper in a reputed magazine, which does, indeed, require full referencing. Since I had been receiving numerous requests from students to write on this topic I used notes I had made about seven years ago from various well-known university syllabuses, not even remembering which notes were from which university.”

“I did not go online to any source. Obviously the syllabuses have not changed much in all these years! I purposely left the text in the same simple-to-understand original language because it was meant for students and laymen, not professionals. A university brochure is neither someone’s personal intellectual property, nor does it require referencing,” Khan says further.

“My friend and former colleague, Engineer Nasim Khan, provided information on various related American websites with comments-what is wrong with that? Those who insinuated negatively about his professional capabilities are ignorant and disparate,” he concludes. (ANI)

JuD has links with Al-Qaeda: Pak Attorney General

Islamabad, May 30 (ANI): Pakistan Attorney General Sardar Latif Khosa has said that the Jamaat-ud-Dawa (JuD) has links with Al-Qaeda, and at least one of the culprit involved in the November 2008 Mumbai attacks is associated with the JuD, The News reports.

Presenting secret documents before the Lahore High Court (LHC) with regard to the house-arrest case of JuD chief Hafiz Mohammad Saeed, Khosa said the documents were related with the national security, and therefore is being tabled in a closed door session.

Saeed’s counsel AK Dogar, however, objected to close door proceedings of the court and demanded that the documents should be presented in an open session and in the presence of Saeed.

Earlier, the LHC preserved its verdict in the Saeed detention case saying it would be made public later.

It may be noted that Khosa recently told the LHC that the government had ‘enough material’ against the JuD leaders to prove that they have been involved in terror activities, but it could not produce it before a court of law. (ANI)

Pak Supreme court asked to book Musharraf on ECL

Islamabad, Apr. 14 (ANI): The Supreme Court of Pakistan has been asked to place former President General (r) Pervez Musharraf’s name on the Exit Control List (ECL) by booking him in a treason case for abrogating the Constitution and damaging the judiciary.

In his petition under the original jurisdiction of the Supreme Court on fundamental rights, Advocate Fazal Ellahi Siddiqui has also requested to overturn the Court’s judgment validating the November 3, 2007 emergency rule.

He also accuses former chief justice Abdul Hameed Dogar and 43 other judges of aiding and abetting the subversion of the Constitution by taking oath under the PCO courts.

It is third such petition that demands annulment of emergency rule following the reinstatement of Chief Justice Iftikhar Mohammad Chaudhry.

Siddiqui’s petition holds Musharraf, Zardari, the army chief, former chief justice Dogar and Justice (retd) Mohammad Nawaz Abbasi as respondents.

“The Americans, like in Musharraf’s time, have also been given a free hand by President Zardari and fundamental rights of the people are being violated daily in tribal areas. A large number of people have suffered tremendous losses because of US drone attacks,” the Dawn quotes Siddiqui’s petition, as saying.

The petition said it had become a common phenomenon that the army intervened after every eight to 10 years, amended the Constitution to suit its needs and eventually to get its acts of omissions and commissions validated by the courts and parliament.

“The military commanders consider that the public will weep and wail for a few days, but after that they have to reconcile to the fait accompli,” the petition said. (ANI)

JuD chief Hafiz Saeed challenges his detention in Lahore High Court

Lahore, Apr. 5 (ANI): Challenging their detention, Jamat-ud-Dawa chief Hafiz Muhammad Saeed and his three associates have filed a petition in the Lahore High Court.

Saeed, Colonel (r) Nazeer Ahmad, Abdul Rehman and Ameer Hamza filed the petition under Article 199(1bi) of the constitution, the Daily Times reports.

The leaders of the banned organization have asked the court to determine if they were being held in custody in accordance with the law, their counsel AK Dogar said.

Dogar claimed that the detention of his clients, which was ordered by the Home Department on January 9 and again on March 9, was without lawful authority and of no legal effect.

In the petition, Dogar submitted that Hafiz Saeed had been earlier arrested during the Musharraf regime, but was released by the orders of the LHC.

There was no on the record allegation against the petitioner or his organization, he added.

Furthermore, the counsel noted that the LHC had also observed that Dawa had never been involved in any terrorist activities in Pakistan, and no FIR had ever been registered against Dawa or any of its detained members.

“Dawa was an independent organization with no links with Lashkar-e-Tayyaba,” he stated.

Dogar requested the court to issue a habeas corpus direction, which would require the respondents to present the petitioners before the LHC. (ANI)

Chaudhry officially takes charge as Chief Justice of Pakistan

Islamabad, Mar.22 (ANI): Justice Iftikhar Muhammad Chaudhry took over the charge as Pakistan’s Chief Justice (CJP) on Sunday here.

According to The News, a statement released by the Supreme Court has confirmed that Chaudhry has officially taken the charge.

Chaudhry, right after taking the charge approved setting-up of a five-member bench in Principle Seat in Islamabad, and also a Shariat Appellate Bench.

According to sources, the Supreme Court will mostly hear petitions related to criminal and civil cases.

“The purpose is to dispose of criminal matters, especially the pending cases of convicts and undertrail prisoners, so as to grant relief to prisoners, who are languishing in jail,” sources said.

Meanwhile, reports filtering from different sources added that the outgoing Chief Justice, Abdul Hameed Dogar may be appointed as Pakistan’s ambassador to the Saudi Arabia.

The post has been lying vacant after the completion of Admiral (retired) Shahid Karimullah’s term. (ANI)

Zardari urges Pakistan to “move on”

Islamabad, Mar. 21 (ANI): Pakistan President Asif Ali Zardari has urged the nation to forget the recent political crisis, and said the restoration of the sacked judges offers an opportunity to move on.

“We welcome all the judges to their pre-November 3, 2007 positions. It is time to look forward and build on what has already been achieved, it is time to forget the past and it is time to move on,” the Daily Times quoted Zardari, as saying.

At a farewell dinner for outgoing Chief Justice of Pakistan Abdul Hameed Dogar, Zardari said he would always bow to the judges, regardless of whether he was the president or an ordinary citizen.

“I wish to commend Chief Justice Dogar and wish him good luck in the future. My lords, you have seen me appearing and bowing before you in courts. Today, as I stand here as the President of Pakistan, I once again bow before the majesty of your lordships,” he said.

Zardari also said he had witnessed state institutions repeatedly being pushed back in Pakistan, but they always bounced back.

“It has been our vision that the institutions grow and gain strength through evolution and continuity,” he said, adding it was unfortunate that some people were critical of this view.

The prime minister, Senate chairman, National Assembly speaker, federal ministers, Supreme Court judges, services chiefs, chairman joint chiefs of staff committee, parliamentarians and several senior government officials attended the dinner. (ANI)

Sacked judges to resume their positions on March 22

Islamabad, Mar. 18 (ANI): The Pakistan Government has notified that all sacked judges of the Supreme Court and the high courts, including Iftikhar Muhammad Chaudhry, will resume their earlier positions from March 22.

Addressing a press conference, Federal Law Secretary Agha Muhammad Rafique narrated two separate notifications from the Law and Justice Division announcing the move.

“The president of Pakistan is pleased to restore Justice Iftikhar Muhammad Chaudhry, the deposed CJP (chief justice of Pakistan), to the position he was holding immediately before November 3, 2007. He will assume office of CJP on March 22, after the retirement of CJP Abdul Hameed Dogar on March 21,” the Daily Times quoted one notification, as saying.

Another notification said other sacked judges would assume office with immediate effect.

According to the notifications, the reinstated judges of the Supreme Court are: Justice Javed Iqbal, Justice Khalilur Rehman Ramday, Justice Raja Fayyaz Ahmed and Justice Chaudhry Ijaz Ahmad.

The reinstated judges of the High Courts are: Justice Khawaja Muhammad Sharif, Justice Ijaz Ahmed Chaudhry and Justice Iqbal Hameedur Rehman, Justice Mushir Alam and Justice Maqbool Baqar, and Justice Ejaz Afzal Khan.

However, the law secretary told reporters the sacked judges would not be administered a fresh oath. (ANI)

Zardari says he was waiting for Dogar’s retirement to reinstate Chaudhry

Islamabad, Mar 17 (ANI): President Asif Ali Zardari has said that he was only waiting for the retirement of present Chief Justice Abdul Hameed Dogar before restoring Justice Iftikhar Muhammad Chaudhry as the country’s Chief Justice.

“I never said that I am against Justice Iftikhar. I was only waiting for the retirement of Justice Abdul Hameed Dogar, who took oath as the Chief Justice in the Musharraf regime. Dogar will retire on March 21 and Iftikhar Muhammad Chaudhry will become the chief justice again in his place,” Zardari said.

“I had made it clear on March 9, 2008 after signing the Murree Declaration that no sitting judge would be disturbed. I said it in the presence of Nawaz Sharif to the media and that was why I never disturbed Dogar,” The News quoted him, as saying.

“It was a small thing, but this small thing exposed many big people,” he said.

Zardari was more concerned about some people from his own party who resigned from their ministries last week rather than his political brother Nawaz Sharif.

Zardari said the political crisis was over, but Pakistan was still facing an economic crisis and terrorism.

Justice Iftikhar Chaudhry was twice removed in the last two years was restored twice. It’s a record in the world judicial and legal history.

His first removal resulted in the launching of a movement for the independence of the judiciary, which was initiated by the lawyers, the media and the civil society. The political parties later joined this movement. (ANI)

Chief Justice Dogar may be appointed Pakistan’s new CEC

Islamabad, Mar 17 (ANI): Pakistan’s new Chief Election Commissioner could be appointed after a notification about the reinstatement of Chief Justice Iftikhar Mohammad Chaudhry is issued.

Sources indicated the possibility of present CJ Abdul Hameed Dogar being made the CEC after his retirement on March 21.

The office of the Chief Election Commissioner has fallen vacant with retirement of Qazi Mohammad Farooq.

However, a senior PML-N leader said that recent developments might force the government to avoid appointing a “highly controversial” person as CEC.

“The CEC has to be an impartial person with an impeccable reputation. A controversial CEC must not be replaced by another controversial person,” the Dawn quoted him, as saying.

Legal experts, however, say that Justice Dogar qualifies for the post. Under Article 213 of the Constitution, the president has the discretion to appoint the CEC.

The only qualification required for the post is to be a sitting or former judge of the apex court, or a high court judge qualified to be appointed as a Supreme Court judge.

Justice Dogar, if appointed, will be the second Chief Justice of Pakistan to become the CEC after retirement, the first being Justice Irshad Hassan Khan. (ANI)

Nawaz Sharif calls off ‘Long March’

Islamabad, Mar.16 (ANI): Former Pakistan Prime Minister and Pakistan Muslim League-Nawaz (PML-N) chief Nawaz Sharif on Monday called off the ‘Long March’ of opposition politicians and lawyers after incumbent Prime Minister Yousuf Raza Gilani announced that deposed Chief Justice Iftikhar Muhammad Chaudhry would be reinstated on March 21 after present Chief Justice Dogar retires.

In an address to the nation, Gilani declared that President Zardari had agreed to most of Nawaz Sharif’s demands.

Gilani also ordered all political party activists and lawyers arrested over the past week to be released.

“The compromise formula has been worked out with Zardari,” Gilani said.

The announcement followed late night meeting between Gilani and President Zardari on crucial issues responsible for the current political crisis triggered by a confrontation between the ruling PPP and opposition PML-N. (ANI)

Sharif ready to give another “five years” to Zardari if he fulfils promises

Lahore, Mar. 14 (ANI): Pakistan Muslim League-Nawaz chief Nawaz Sharif has opened the door for reconciliation with President Asif Ali Zardari, by saying that he was ready to give Zardari “the next five years if he delivers on his pledges”.

“There is no need for back channel diplomacy or private and secret dialogue. I have not slammed my doors on dialogue. If Zardari showed sincerity, I am ready to give him another five years (after his tenure expires),” The Daily times quoted Sharif, as saying.

The former Pakistan Prime Minister also said that he was ready to work with Zardari as a team, if he reinstates sacked judges and fulfils his promise of an independent judiciary.

“I have no personal enmity with Zardari. If he shuns vested interest and sincerely fulfils his promises to reinstate judges and restore an independent judiciary, I am ready to cooperate with him. There is a massive trust deficit– he has to remove it,” Sharif said.

He said he was not trying to topple the government, but was only working to strengthen democracy.

He claimed that had his party accepted a ‘deal’ offered by Zardari and supported an extension in Chief Justice Abdul Hameed Dogar’s tenure, the Punjab government would not have been removed and the SC would not have disqualified him from contesting polls.

Sharif also said that Zardari sent Maulana Fazlur Rehman and Asfandyar Wali Khan to him to ‘buy time’ to consolidate his position in Punjab and at the Centre instead of settling differences. (ANI)

Zardari resorting to adventurism like Musharraf, says Sharif

Lahore, Mar 13 (ANI): PML-N chief Nawaz Sharif has regretted backing President Asif Zardari, saying that the PPP co-chairman is resorting to adventurism like former military ruler Pervez Musharraf.

In an exclusive interview with Waqt News, Sharif said: “We sincerely backed the PPP and Zardari, but they stabbed us in the back. I was got disqualified from those courts which aren’t even accepted by the people.”

The former premier said Zardari had offered PML-N president Shahbaz Sharif to follow the policy of give and take, adding “Shahbaz was asked to back extension in the tenure of (Chief Justice of the Supreme Court) Justice (Abdul Hamid) Dogar and in return, “we will save you from being declared ineligible from holding any public office and contesting elections.”

Sharif further said the situation of the country would not change unless the state institutions were reformed, the mess created by the dictator was cleared and the rule of law was ensured.

He said he wanted to know why Musharraf had not been held accountable for the chaos created by him (Musharraf). The state of affairs would further deteriorate if status quo was maintained, Sharif stated.

The PML-N chief said he was not talking of agitation but he fully backed peaceful Long March launched by the lawyers’ community. It were the government circles which were giving wrong colour to the black coats movement and were resorting to harsh tactics to stop this, he regretted.

Sharif reminded that when he was in power, he had not stopped Benazir Bhutto from holding Long March, and said he was even today in favour of solving the problems and issues through parliament, but “Zardari does not want to allow the parliament to make such decisions.”

He alleged that the President had made the parliament a powerless institution, reminding that Zardari had himself promised to abolish the Article 58(2)b of the Constitution after becoming President but so far he had not done away with this.

Sharif explained that Long March was not an agitation; rather it was an effort to change the destiny of the country, to help give justice to the masses, to alleviate poverty and to make Pakistan a true Pakistan as envisioned by Quaid-e-Azam Muhammad Ali Jinnah and Allama Iqbal. (ANI)

LHC issues notice to Govt. on Governor’s rule in Pak Punjab

Lahore, Mar 6 (ANI): The Lahore High Court on Friday admitted petitions challenging governor’s rule in the Punjab for hearing.

Justice Asif Saeed Khosa said the court has also issued notices to the Attorney General of Pakistan and Advocate General of Punjab for subsequent proceedings.

According to The dawn, these petitions were filed in LHC by A. K. Dogar and Tariq Aziz Advocate. The petitions challenge the legitimacy of governor rule in the province.

Justice Khosa has forwarded the petitions to the Chief Justice of the Lahore High Court with the request that a large bench should be constituted in order to hear the petitions.

After Shahbaz Sharif’s disqualification, President Zardari enforced governor rule in Punjab. Salman Taseer is the provincial chief executive of the state.

The petitioners have said that the conditions in the province were not such as would justify the enforcement of governor rule.

They also pointed out that governor rule is imposed at a time when the constitutional machinery fails.

The petitioners said that the constitution protects the fundamental rights of the citizens, whereas, governor rule denies these fundamental rights.

They also said that governor rule in the province should be declared null and void. (ANI)

Zardari ready for reconciliation with Sharif

Islamabad, Mar.6 (ANI): Pakistan President Asif Ali Zardari has said that he is ready to mend ways with former Prime Minister and Pakistan Muslim League -Nawaz (PML-N) chief, Nawaz Sharif.

In a meeting with Awami National Party (ANP) leader Asfandyar Wali Khan and Jamiat Ulema Islam (JUI) chief, Maulana Fazlur Rehman, Zaradri asked the PML-N to restrain itself from attacking the government, and added that he was ready to think about confidence building measures with Sharif.

According to sources, Zardari said he was ready to show flexibility and wanted reconciliation rather than confrontation.

After their talks with the President, both Asfandyar Wali Khan and Fazlur Rehman are expected to meet Nawaz Sharif to convey Zardari’s message.

Both leaders also met Prime Minister, Yousuf Raza Gilani and informed him about the latest developments.

According to a statement released by the Presidency here, Zardari had discussions with the JUI and ANP chiefs’ about the current political scenario in the country and the situation in the Frontier Province.

According to sources, the leadership of JUI and ANP, working as mediator, has asked Zardari to reinstate the Punjab Government by lifting the Governor Rule, and has also urged the PML-N to accept the restoration of judiciary without Justice Chaudhry Iftikhar and Justice Abdul Hameed Dogar.

Meanwhile, Prime Minister Gilani has commended Khan and Rehman for promoting a politics of reconciliation and tolerance in the country.

“Only through this policy, democracy and state institutions can be strengthened in the country,” The Nation quoted Gilani, as saying. (ANI)

Shahbaz says Dogar offered Nawaz scrapping of disqualification case

Islamabad, Feb 4 (ANI): Pakistan Punjab province Chief Minister Shahbaz Sharif has said that Chief Justice Abdul Hameed Dogar had offered PML-N chief Nawaz Sharif scrapping of the case regarding his disqualification on showing flexibility over judges issue.

Shahbaz said that PML-N would not accept judges who flourished under a dictator’s umbrella.

He threatened to launch a public struggle if he was disqualified, The Nation reported.

To a question about his resent meeting with President Asif Ali Zardari, he said: “Both the PPP and the PML-N have struggled and paid a lot for democracy in the country and I have asked him (Zardari) to brush off misunderstandings and follow the Charter of Democracy (CoD) to bring the country on track.”

Shahbaz further said that rift between the two leading parties could have been avoided if any of the signed agreements were honoured.

Commenting on 17th Amendment and Presidential powers, Shahbaz said that President Zardari had pledged on these two issues but things had not yet been done as promised. (ANI)
