SIT questions Togadia for role in 2002 Gujarat riots case

Gandhinagar, May 10 (ANI): Vishwa Hindu Parishad (VHP) leader Praveen Togadia appeared before a Special Investigation Team (SIT) on Monday for questioning in connection with his role in the 2002 Gujarat communal riots.

Togadia was accompanied by several VHP activists, who shouted ”Jai Shree Ram” slogans and sang bhajans outside the SIT office, till his questioning was completed.

Togadia was earlier asked to appear before the SIT on April 29, but failed to do so.

He was summoned by the SIT after it had questioned Gujarat Chief Minister Narendra Modi.

On April 28, the Supreme Court gave an additional 15 days to the SIT, to conduct an inquiry against Modi and 62 others in connection with post-Godhra riots, and to submit its final report.

The Supreme Court had given the deadline to complete the inquiry into complaint of Zakia Jaffery in which she alleged that Modi, his cabinet colleagues, some police officials and senior bureaucrats aided and abetted the post-Godhra riots of 2002.

Zakia”s husband and ex-MP Ehsan Jaffrey was among the 69 killed during the 2002 riots in the Gulburg Society.

SIT has already recorded statements of a number of persons named in Zakia”s complaint, which include former Minister of State for Home Gordhan Zadafia, Bharatiya Janata Party (BJP) leader I K Jadeja, former BJP MLA from Lunawada Kalu Malivad and sitting MLA from Mehsana Anil Patel, former IPS officer R B Sreekumar, social activist Teesta Setalvad, IG Shivanand Jha, some other senior police officers and political leaders. Option of Modi being summoned remains open, says Nanavati Commission

Gandhinagar, Apr 1(ANI): The Nanavati Commission, which is probing the 2002 Godhra incident, on Thursday informed the Gujarat High Court that its decision to not summon Gujarat Chief Minister Narendra Modi was not the final decision.

The Commission was today responding to a notice sent by the High Court on March 22, in which it was asked from the Nanavati Commission to clarify whether it would summon Modi by April 1.

The High Court was acting on the petition filed by the Jan Sangharsh Manch (JSM), which had moved an application before the Nanavati Commission in April 2007 demanding that Modi be summoned for questioning.

Talking about today’s proceedings in the court, JSM lawyer Mukul Sinha said: “The proceedings were based on our request for the Chief Minister (Modi) to be summoned before the Nanavati panel.”

“In September 2009, the Nanavati Commission had declined to summon the Chief Minister, but today they have replied to the High Court’s notice saying their decision of not summoning Modi is not final and the option of him being summoned remains open,” Sinha added.

Sinha further informed that the next hearing regarding the issue would be on 17 June.

This would spell more trouble for Modi, who was questioned by the Supreme Court appointed Special Investigation Team (SIT) on March 27 for over five hours regarding his role in the 2002 Gujarat communal riots. (ANI)

Modi’s appearance before SIT shows nobody’s above law, says Moily

New Delhi/ Gandhi Nagar (Gujarat), March 27 (ANI): Union Minister for Law and Justice Veerappa Moily on Saturday said that even if the appearance of Gujarat Chief Minister Narender Modi before the Supreme Court appointed Special Investigation Team (SIT) was most unfortunate, it did reflect that all were equal before the law.

“It is most unfortunate that he landed himself into to that kind of situation. It is not desirable. But, unfortunately, it has happened. But that demonstrates the fact that nobody is above law. Rule of law is equal to every one as I have repeated there,” said M Veerappa Moily here.

To a poser on Modi questioning the validity of the SIT summons to him, Moily said that by doing so he was questioning the authority of the country”s apex court.

“No, it is for him to agitate before the court, that means he is questioning the authority of the Supreme Court to appoint an SIT. And SIT is empowered by the Supreme Court decision. That means he is questioning the Supreme Court. He should understand what he is doing,” he added.

In Gandhinagar, earlier in the day, Modi appeared before the before Special Investigation Team (SIT), appointed by the apex court to inquire into the communal riots of 2002 in the state, amid tight security.

Modi”s security and bomb disposal squad arrived before him at the premises from where SIT is functioning at Gandhinagar. The enquiry was on till 3.30 p.m. on Saturday.

Modi, 59, senior leader of the Bharatiya Janata Party (BJP) is the first-ever Chief Minister of any state to be called for questioning in a criminal complaint of mass murder after he and his administration were accused of aiding and abetting riots in one area of Ahmedabad.

The Supreme Court appointed SIT to inquire into the 2002 Gujarat riots that claimed lives of more than 2,500 lives required Modi to appear before it for questioning on Sunday (March 21). However, Modi did not turn up for the questioning by the SIT members on Sunday.

The summons followed a petition filed by Zakia Jaffrey, widow of Ehsan Jaffrey, a former Congress party legislator, who was allegedly burnt alive during the riots in what has come to be known as the Gulbarg Society massacre on February 28, 2002.

The Hindu-Muslim clashes in the western state of Gujarat killed more than 2,500 people displaced some 200,000 and orphaned about 400 children.

The reprisal attacks by a group of Hindus broke loose after suspected Muslim attackers torched a train carrying Hindu pilgrims on February 27, 2002, killing 59 Kar Sevaks (devotees) in a Gujarat town. (ANI)

Pravin Togadia not allowed to visit Kandhamal

Bhubaneswar, March 16 (IANS) The local administration in Orissa’s Kandhamal district has not allowed the proposed visit of Vishwa Hindu Parishad (VHP) leader Pravin Togadia to the area later this week, officials said.

The VHP leader was scheduled to go to visit Kandhamal during his visit to the state on Thursday.

‘We have decided not to allow VHP leader Pravin Togadia to visit the district as the district is fast turning normal after the communal riots in 2008. His visit would not be good at this moment,’ Kandhamal District Collector Krishna Kumar said.

‘We know that every time he comes, he gives provocative speeches. Anticipating trouble, we have not allowed his visit to the district,’ he said.

On the other hand, the VHP leaders have strongly opposed the administration decision, saying that that it is ‘undemocratic’ not to allow Togadia to visit the district.

‘We are yet to get in writing that the district administration has not allowed the visit. We will strongly protest the decision,’ VHP state unit secretary Gouri Prasad Rath said.

Veraval riots: Nanavati Commission not to issue notice against Modi

Ahmedabad, Sep.19 (ANI): In a major reprieve for Gujarat Chief Minister Narendra Modi, the Justice Girish Thakorlal Nanavati Commission on Saturday confirmed that it would not be issuing any notice to him in connection with the communal riots in Veraval.

However, the commission has asked the State Government to give it transcripts of the conversations that took place prior to the riots, during the riots and in its aftermath.

The commission has so far given a clean chit to Modi in the post-Godhra events. The Nanavati Commission said there was no evidence to show there was lapse in Modi’s or his ministers’ role in providing protection, relief and rehabilitation to the victims of communal riots or in the matter of not complying with the recommendations and direction given by the National Human Rights Commission.

Communal attacks on Muslims took place in Gujarat between February and May 2002.

The riots occurred after the burning of the Sabarmati Express. According to official figures tabled in the parliament, more than a thousand people were killed (790 Muslims and 254 Hindus) in the violence after the train incident. More than two hundred and fifty thousand people were displaced (about 200,000 Muslims and 40,000 Hindus).

Organizations such as Human Rights Watch criticized the Indian government for failure to address the resulting humanitarian condition of people, “overwhelming majority of them Muslim,” who fled their homes for relief camps in the aftermath of the events.

Many of the investigations and prosecution of those accused of violence during the riots have been opened for reinvestigation and prosecution. According to an official estimate, 1044 people were killed in the violence, including those killed in the Godhra train fire. Another 223 people were reported missing, 2,548 injured, 919 women widowed and 606 children orphaned. About 100,000 Muslims and 40,000 Hindus were in relief camps. (ANI)

Chidambaram visits Kandhamal victims in relief camps

Phulbani (Orissa), June 26 (ANI): Union Home Minister P.Chidambaram on Friday visited Kandhamal riots victims in the Government run relief camps here.

Chidambaram, who is taking stock of the law and order situation in Orissa, today visited the Government run relief camps in Mandaika, Rahikola, Tinigia and Tikabali in Kandhamal district.

He assured the riot victims that action would be taken against the culprits involved. Chidambaram asked them to think of starting their life afresh.

“I am sorry that certain things happened last year and you have been brought to these camps. But you must go back to your villages. I am here to tell you, don’t fear,” Chidambaram said.

Nearly 1500 people, mostly tribals are living in relief camps set up after a series of communal riots which followed the killing of VHP leader Swami Laxmananda Saraswati in August last year, in Kandhamal district.

Meanwhile, in the wake of increased Maoist activities, the Orissa Government has urged the Centre to deploy paramilitary personnel. The State Government has also asked for helicopters and grants for setting up a anti-Naxal training centre.

During the meeting with the Union Home Minister P Chidambaram, state government officials sought seven more battalions of the Central Reserve Police Force, and Indian Police Service (IPS) officers to train men of the state police,

Hundreds of Muslims to attend Lord Jagannath Yatra in Ahmedabad

Ahmedabad, June 21 (ANI): Hundreds of Muslims will mark their presence on the occasion of scheduled Lord Jagannath Rath Yatra or, chariot procession to be carried out here on Wednesday (June 24) and display a gesture of brotherhood and communal harmony.

These resident Muslims are eager to be present during the 132nd Rathyatra of Lord Jagannath, Subhadra and Balram and get a glimpse of the chariot procession.

On Saturday, a group of Muslims here presented a souvenir of Lord Jagannath’s chariot to the priest of Jagannath temple, ahead of the scheduled Rath Yatra or chariot procession.

“Despite communal riots of 2002, the Muslims of Ahmedabad are eager to participate in the chariot procession. It shows that they are emotionally attached to this procession,” said Badruddin Sheikh, a religious Muslim leader.

The procession is scheduled to take place amidst tight police security in the communal sensitive areas of the city.

“This procession will take place in a peaceful atmosphere. The Muslim community will extend full cooperation to this procession. The Muslim community is also concerned about the law and order situation and the successful conclusion of the celebrations during this festival. That is why we came here to hand over this (memento),” said Mohammad Hussein Sheikh, President, Ahmedabad Muslim Graduate Association.

Supreme Court orders retrial of Gujarat riots by fast track courts

New Delhi, May 1 (ANI): The Supreme Court on Friday ordered a retrial of the Gujarat riots cases by fast track courts.

The apex court also directed that the trial would not be shifted out of Gujarat.

Besides, it also ordered he filing of additional chargesheets against new accused named by the Special Investigating Team (SIT).

On April 27, the apex court asked the SIT to probe the role of 64 people, including that of Gujarat Chief Minister Narendra Modi in the cases.

The apex court order was passed in response to a petition filed by Congress parliamentarian Ehsaan Jaffery.

The court asked the SIT to submit the report within three months.

The order came over two months after Gujarat High Court Judge A. S. Dave declined to hear a SIT petition that challenged the anticipatory bail granted to State Minister Maya Kodnani and the former VHP leader Jaydeep Patel in connection with the Godhra case.

The SIT had moved the Gujarat High Court and challenged the anticipatory bail granted by a lower court to Kodnani and Patel, in the post-Godhra and Naroda Gram riot cases.

The apex court had constituted a five-member SIT to re-investigate the post-Godhra communal riots.

The SIT is reinvestigating into nine post- Godhra riot cases and was expected to submit its report to the apex court by February 15.

Several prominent leaders like, Maya Kodnani of BJP and Jaydeep Patel of Vishwa Hindu Parishad are at the center of investigation, following many witnesses naming them in their statements in the Naroda Gam riot case.

The SIT had filed a 300-page supplementary chargesheet against 24 people in the Naroda Gam case in which 11 people, belonging to the minority community, were killed by a mob during the riots.

The accused include, Fula Vyas of VHP, local BJP leader Jitendra Patel and ex-BJP municipal councilor Ashok Patel.

The SIT has also filed a second charge sheet in Naroda Patiya case against 15 accused, where over 80 people were killed during the Godhra riots.

The third chargesheet in the Gulburg society case, named some VHP and BJP leaders in the list of absconders among the 14 accused, where 38 people were killed.

The five-member SIT team is headed by R. Raghavan, and includes former Deputy General of Police C.D. Satpathy and three Indian Police officers-Geetha Johri, Shivanand Jha and Ashish Bhatia.

Each chapter in the report is being carefully drafted and separate reports are being prepared for each of the nine cases. (ANI)

Ram Temple row comes off the backburner in Ayodhya

Ayodhya, Apr 22 (ANI): Construction of controversial Ram Temple is occupying centre stage in Ayodhya, which votes on Thursday.

Reviving the issue, the Bharatiya Janata Party (BJP) has said it will construct the temple at its site in Ayodhya.

Hanuman Yadav, a caretaker of temple construction workshop, said he was confident that the temple would be built if the BJP got absolute majority.

“Temple would be constructed when our government comes in majority. The temple would be definitely constructed,” he said.

After winning the general elections in 1999, the BJP was forced to abandon plans of constructing the temple by its coalition allies.

Devotees, who visit the site, say they will vote for any party that backed temple construction at the site.

“We will vote for the party that will construct the temple,” said Kalpna Ben, a devotee from Jalgaon in Maharashtra.

Hashim Ansari, president of Babri Mosque Reconstruction Action Committee, said that the BJP’s aim was just to politicise the issue, but not construct it.

“Advani’s aim is not to construct a temple but to play politics,” Ansari said.he demolition of the 16th century mosque on December 6, 1992, triggered off nationwide communal riots that took a heavy toll of human life.

The ramifications of that movement are still being felt. Senior BJP leader L K Advani is among those accused of inciting communal passions by making inflammatory statements.

Orissa wants central forces to stay on in Kandhamal

Bhubaneswar, April 20 (IANS) The election in Orissa’s troubled Kandhamal district went off peacefully last week, but state authorities want the central forces deployed in the communally-sensitive region to stay on for a while longer, officials said Monday.

The central government wants to withdraw the 45 companies of paramilitary forces, including the forces deployed in Kandhamal after the communal riots last year. It wants the forces to move to West Bengal where elections will begin April 30, said Inspector General of Police (Law and Order) Arun Sarangi.

‘We have asked the centre to keep at least 15 companies of forces in Kandhamal district,’ Sarangi told IANS.

At least 40 companies of paramilitary forces were deployed in Kandhamal, about 200 km from here, after the communal riots in August and September last year in which 38 people were killed.

‘By April, around 22 companies were withdrawn and 18 are still deployed in the district,’ said District Collector Krishan Kumar.

‘We want them to stay for the time being,’ he said, adding that many people were still staying in relief camps.

‘We have asked the government to extend the stay of at least 15 companies of forces for some more time,’ Kumar added.

Kandhamal witnessed widespread communal violence after the murder of Vishwa Hindu Parishad (VHP) leader Swami Laxmanananda Saraswati and four of his aides Aug 23.

At least 38 people – most of them Christians – were killed in the state and thousands of people were forced to flee their homes after their houses were attacked by mobs.

Elections for one Lok Sabha seat and three assembly constituencies in the district were held April 16. The polls went off peacefully with nearly 66 percent voter turnout, the collector said.

Kandhamal villagers still living in fear

Kandhamal, Apr 16 (ANI): Shadow of last year’s communal riots still looms large over villagers in Kandhmal in Orissa, making them ask for security on the polling day.

Though the people are coming back to their villages, they are still living under a shadow of fear.

And with the elections due to be held on April 16 in the state, they want proper security arrangements from the administration to be safe enough to cast their votes.

“We want to cast our votes, but we are scared to do so. Our polling booth is five kilometers away from our village. We are under threat and the government is not providing us protection in our village. If the CRPF or police will provide us security, then we are ready to go and vote, otherwise we can’t,” said Duryodhan Mallick, a resident.

The police on their part have taken strict security measures and are promising to ensure free and fair polls in the region.

“We have made proper security arrangements which include mobile patrolling, area domination, special operations in Maoist infested areas and security arrangements for voters residing in relief camps. EXTRA: ‘Talking loudly’ is not the issue, says Indian premier

New Delhi – As the decibel level rises in the run-up to India’s general elections, Prime Minister Manmohan Singh, in his sharpest reaction to Bharatiya Janata Party (BJP) leader LK Advani’s charge that he was a weak premier, said Friday that he should be judged by his actions and not his speech. “One cannot be judged strong or weak by merely talking loudly,” Singh told journalists in Delhi.

Asked about his reaction to Advani’s repeated charge that he was a weak and puppet prime minister, Singh, said: “Using harsh language does not solve any problems. It accentuates conflict.”

Referring to Advani’s challenge to face him in a US-style presidential debate, Singh said he could not match the BJP leader in public speaking.

“I am not a good speaker, but I take decisions,” he said. “I believe that the proof of the pudding is in the eating. What is the record of Advani?”

He said the BJP, under Advani’s leadership, had not allowed parliament – where debate should take place – to function, adding that he had no desire to do Advani the honour of debating him as if he were an alternative prime minister.

Singh also questioned Advani’s role during the demolition of the Babri mosque in Ayodhya town of Uttar Pradesh state in 1992 by Hindu fanatics. The incident was followed by widespread communal riots.

“What is the record of Advaniji?” Singh asked, referring to Advani using a Hindi suffix of respect. “He was present at the time when Babri Masjid was demolished. If he was a strong leader, he would have staked his reputation in preventing the carnage.”

India’s general elections are scheduled to be held in five phases beginning Thursday.

Singh is the prime ministerial nominee of the incumbent United Progressive Alliance led by the Congress Party while Advani is his rival from the BJP-led opposition National Democratic Alliance.

3 fronts party hard in Orissa

Orissa is up for grabs. Clearly, that’s what the leaders of all three coalitions vying for power both at the Centre and state – assembly polls are being held too – believe.

Ever since the BJD decided to break its alliance with the BJP in early March, leaders of the UPA, NDA and Third Front have been converging here as never before. All believe the state is in political flux and if only they put in the effort, they can win a majority of the 21 Lok Sabha and 147 assembly seats.

The political onslaught on the state reached a fever pitch on Wednesday as NCP chief Sharad Pawar finally took the step of addressing four rallies together with Chief Minister Naveen Patnaik and holding a press conference in the company of CPM leader Sitaram Yechury as well. Elsewhere Congress leader Rahul Gandhi addressed meetings in Kalahandi and Kandhamal, while Gujarat Chief Minister Narendra Modi descended on Sambalpur and Rourkela, promising to make Orissa as vibrant as Gujarat if the state voted for the BJP. While Pawar was careful not to attack the Congress, Patnaik had no such compulsions and sought to recall Orissa’s ‘dark days’ when the party ruled.

Rahul returned the compliment in Kandhamal charging the BJD leader with not only having failed to implement centrally funded welfare schemes, but also destroying peace. “We have to keep both the Congress and the BJP at bay,” said Naveen Patnaik, “to protect the interests of the people of Orissa.

” “Orissa was once a peaceful state, but that is no longer true,” said Rahul in Kandhamal. “The government has presided over the torture of people and communal riots in the name of religion.

” “The BJD betrayed us without any provocation,” thundered Modi in Sambalpur. He is making his second campaign trip to Orissa, having addressed four rallies on Sunday.

“But we will emerge triumphant because we believe in development. Orissa has far more natural reserves than Gujarat, and yet it has lagged behind.

There is not a taluka in Orissa from where people have not gone to Gujarat seeking employment. We want to bring about such a change that people from Gujarat will want to go to Orissa to work.

Sonia launches campaign with Pawar, attacks communal parties

Sakoli (Maharashtra), April 10 (IANS) Congress president Sonia Gandhi Friday teamed up with Nationalist Congress Party (NCP) chief Sharad Pawar to launch a joint poll campaign in Maharashtra and hit out at saffron parties saying people did not want forces that propagated communalism.

Sharing a dais with Pawar in this town in Vidarbha region, the first joint rally of the two leaders, Gandhi said the nation faced a major threat from communal forces that must be defeated.

Though she did not name any party in her brief speech, she said: ‘The country is well aware who are the leaders and the forces who spread venom among the people with the speeches.’

Addressing a rally in this town about 900 km from state capital Mumbai, the Congress chief said people in the country were aware of the designs of parties rooted in communalism, casteism and regionalism. The town is considered a bastion of the Bharatiya Janata Party-Shiv Sena combine.

‘They no longer want such parties whose leaders incite communal riots with their speeches and even treat terrorists like guests and send them to Afghanistan.’

She also listed as an achievement the farm loan waiver schemes announced by the United Progressive Alliance (UPA) government last year, considered a crucial electoral plank in the eastern Maharashtra region where many farmers have committed suicide.

Discussing the UPA government’s achievements in the past five years, Gandhi heaped praise on Prime Minister Manmohan Singh.

This was echoed by Pawar, who in his short speech urged the people to vote the UPA back to power in the next elections.

‘We are confident that the UPA will return to power and continue to work for the development of the country,’ he said.

He also recalled the contributions made by the party candidate Praful Patel in the development of Vidarbha region and at the centre. Senior NCP leader and Civil Aviation Minister Praful Patel, who is contesting the Bhandara-Gondia Lok Sabha seat, was also present.

The Congress and the NCP are hoping that the joint two-day campaign by their leaders would help them perform better in the elections. In the last elections in 2004, the Congress-NCP could bag only one of the 11 seats in Vidarbha with the rest going to the BJP-Shiv Sena alliance.

The Congress and NCP will have four joint rallies across Vidarbha, culminating in a road show in Nagpur. The joint ventures are expected to send out the right signals of unity to their cadres.

Relations between the two parties have been under stress with Pawar attending a meeting of the Left and the Biju Janata Dal, both opponents of the Congress in Orissa, leading to speculation that the NCP was charting its own course in the elections.

On Saturday, Gandhi is scheduled to address a rally in Ramtek followed by a road show in Nagpur.

Maharashtra has 48 Lok Sabha seats and goes to the polls over three phases on April 16, 23 and 30.

Pawar and Patnaik finally share dais

The Third Front got a leg-up on Wednesday when Sharad Pawar addressed four joint NCP-BJD-Left rallies in Orissa. Last week, the NCP chief had cancelled his trip to Bhubaneswar at the last minute to address a similar rally, citing a technical snag in the aircraft after Congress leaders raised objections to his trip.

With Pawar sitting besides him, Orissa chief minister and BJD president Naveen Patnaik stated the obvious in his address: the UPA has already been weakened along with the NDA and people should therefore vote for regional parties which will play an important role in government-formation at the Centre after the polls. Going for the jugular, Naveen reminded people of the “dark days” of Congress rule in the state, when politicians “hankered after power and money without bothering about the state’s interests”.

Pawar recalled his association with the late Biju Patnaik and how Naveen could only accomplish “Bijuda’s dreams”. He refrained from criticising the Congress or UPA, but congratulated Naveen for ending his alliance with the BJP. “The state has suffered due to communal riots,” said Pawar.

“The poor have suffered, the farmers have suffered and the weaker sections have suffered. Naveen realised this and ended the alliance with the BJP. Naveen also showed a new road by bringing all secular forces together in the state.

” Naveen said, “To keep the Congress and the BJP at bay, we have entered into seat-adjustment with the NCP, CPI and CPM. Orissa is a backward state and the government’s cooperation is necessary” “In the name of national interests, parties such as the BJP and the Congress have always ignored our state interests,” he added. “The BJD has always fought to protect the state’s interests and it will do so in the future.

” He said everyone had the right to live in peace. “In the name of religion, killings have taken place in Orissa which are not acceptable to a civilised society,” he said.

“The BJP was trying to divide the society. The voters should give a befitting reply to BJP’s communal politics”.

Though no national-level Left leader was present at the rallies, there were plenty of red flags at the venues and the CPI’s election symbol could be seen on the dais. Local Left leaders addressed the meeting before Pawar’s arrival.

Rahul Gandhi to address rally in riot-hit Kandhamal today

Kandhamal, Apr. 8 (ANI): Congress General Secretary Rahul Gandhi will address a rally in Orissa’s riot-hit Kandhamal District today.

During his visit, Rahul will attend meetings at Baliguda in Kandhamnal and Dharmagarh in Kalahandi districts.

The district administration has strengthened security at Baliguda, the epicentre of last year’s communal riots.

According to sources, the BJP has decided to bring Gujarat Chief Minister Narendra Modi to divert the people’s attention from Rahul’s address on the same day.

Kandhamal District witnessed the killing of several Christians and the burning of several houses and churches following the murder of VHP leader Laxmanananda Saraswati.

On August 25, a 29-year-old Catholic nun was allegedly raped and a priest assaulted at Baliguda during a shutdown in Orissa. (ANI)
