Delhi High Court says judges asset declaration covered under RTI

New Delhi, Sep.2 (ANI): The Delhi High Court has on Wednesday said that the Chief Justice of India is a public authority under the RTI Act, which means that asset declaration is covered by the RTI under Section 8 1 (A).

This comes after SC judges had decided tp make their assets public. The only question was whether judges would entertain questions from the public under the RTI act.

A petition was filed by the apex court in the Delhi High Court challenging the Central Information Common Order which had questioned whether the judges revealed their assets to the Chief Justice of India.

Political parties and legal experts last week had welcomed the move of the Supreme Court judges to make public the details of their assets.

Union Law and Justice Minister M. Veerappa Moily said: “If they have come forward to disclose it, it is welcome. It is for the judges to decide how it should be done because what is best in the interest of the judges, they are the best judge.”

Welcoming the move, BJP spokesperson Ravi Shankar Prasad said: “I am afraid that this decision could have been taken earlier and the unfortunate controversy over the last couple of months could have been avoided.”

Congress spokesperson Abhishek Singhvi said the judiciary has avoided “further needless controversy”, but it could have been avoided if the decision was taken earlier, he said.

“It is a question of public perception and public confidence, trust, faith and in that light it is a step in the right direction,” he said.

Describing it as a very good decision taken by judges, Former Attorney General and constitutional expert Soli Sorabjee said: “I think it is a very good development. It”s better late than never.”

“I am sure their initial reluctance not to declare assets was not because they had anything to hide. They had misgivings that it may be misused,” he added.

Senior lawyer Harish Salve said: “The whole controversy had become very unsavory with this kind of suggestions that judges have something to hide they want to be above the law. I am so happy that the Supreme Court has risen to the occasion.”

Senior advocate Prashant Bhushan said the move would also now encourage the High Courts judges to make public their assets.

“It is absolutely a welcome move and I am sure it will also encourage the judges of the High Courts to publicly declare their assets and force the government to put up assets of government servants on public website which can be accessed by the people,” Bhushan said.

Terming the decision as “excellent”, senior advocate K K Venugopal said: “I think it is the greatest step that the judiciary could take because it has cleared all the clouds which have been hanging over the issue.” (ANI)

The Grand Slam winner was present at the wrap party of Common’s new flick, “Just Wright”, at Greenhouse earlier this week, and proceeded to spend all night with him.

“They were having fun, dancing, and affectionate,” the New York Post quoted a witness as saying.

Other celebs present at the party were Rihanna, Robin Thicke, and Common’s co- star Queen Latifah.

Seven rare Brazilian simians stolen from Kolkata zoo recovered from Durg

Durg (Chhattisgarh), Aug 30(ANI): Seven of the eight Brazilian Common Marmosets, stolen from the Alipore Zoological Garden in Kolkata were recovered from Chhattisgarh’s Durg district on Saturday.

Acting on a tip-off, Chhattisgarh Police nabbed a person, Raju Singh Soikia, here and rescued seven marmosets, it is believed that one of the stolen eight died.

“We trapped Raju by disguising ourselves as monkey buyers and told him to meet us. We then arrested him from the meeting point. After interrogation he told us that he and his friend in collaboration have committed this crime,” said Dipanshu Kabra, Superintendent of Police of Durg.

Kabra further said that these were rare species, which were used for genetic research as they are genetically close to human beings.

He also informed that the accused Raju and his friend Bobbai were planning to take the marmosets to Pune or Mumbai, where they could sell them at a good price.

However, the accused Raju denied all the allegations and said that he was innocent, and his friend Bobbai had committed the crime.

“I have not committed this crime. My dealer told me to keep the monkeys in my house for few days. He told me that he would collect them later. But, when the theft news was in the newspapers I contacted him. He told me not to worry as he had a license for this business. He deals in the birds which made me think that he is saying the truth,” Raju said.

Kabra also said that Bobbai, the key figure in the racket, is still absconding and Kolkata police are on the lookout for him. (ANI)

Bihar students form human-chain to spread awareness about swine flu

Patna, Aug. 29 (ANI): Students of a biotechnology college in Bihar formed a human chain on Saturday (August 29) to create awareness about H1N1 influenza virus, commonly known as swine flu.

Students carried placards giving information pertaining to precautions and cure of the disease.

“Common people should know what’s swine flu and what are the precautions and cure that we can take so that we can’t have this type of disease. And also the people who are suffering from this disease swine flu, we are also making an awareness camp for that type of persons so that they can know how they can get the permanent cure for the swine flu,” said Anjali Sharma, a participant in the human chain.

Even though no causalities have taken place in Bihar due to swine flu but two positive cases have been reported in the state.

Fear of the swine flu has gripped various parts of the country.

India recorded its first H1N1 case in the southern city of Hyderabad in May and since then the virus has spread across the country.

The H1N1 virus, commonly known as swine flu, emerged in April in the United States and Mexico, and has spread internationally.

The World Health Organisation (WHO) has termed H1N1 swine flu as unstoppable because many countries are not keeping a track and precise count of the virus cases. (ANI)

Common ancestor of humans and monkeys evolved from primates in Asia

Washington, July 1 (ANI): A new fossil primate from Myanmar suggests that the common ancestor of humans, monkeys and apes evolved from primates in Asia, not Africa, as was earlier believed by researchers.

A major focus of recent paleoanthropological research has been to establish the origin of anthropoid primates (monkeys, apes and humans) from earlier and more primitive primates known as prosimians (lemurs, tarsiers and their extinct relatives).

Prior to recent discoveries in China, Thailand, and Myanmar, most scientists believed that anthropoids originated in Africa.

Earlier this year, the discovery of the fossil primate skeleton known as “Ida” from the Messel oil shale pit in Germany led some scientists to suggest that anthropoid primates evolved from lemur-like ancestors known as adapiforms.

According to Dr. Chris Beard, a paleontologist at Carnegie Museum of Natural History in Pittsburgh, Pennsylvania and a member of the international team of researchers behind the Myanmar anthropoid findings, the new primate, Ganlea megacanina, shows that early anthropoids originated in Asia rather than Africa.

These early Asian anthropoids differed radically from adapiforms like Ida, indicating that Ida is more closely related to modern lemurs than it is to monkeys, apes and humans.

The 38-million-year-old Ganlea megacanina fossils, excavated at multiple sites in central Myanmar, belong to a new genus and species.

Heavy dental abrasion indicates that Ganlea megacanina used its enlarged canine teeth to pry open the hard exteriors of tough tropical fruits in order to extract the nutritious seeds contained inside.

“This unusual type of feeding adaptation has never been documented among prosimian primates, but is characteristic of modern South American saki monkeys that inhabit the Amazon Basin,” said Dr. Beard.

“Ganlea shows that early Asian anthropoids had already assumed the modern ecological role of modern monkeys 38 million years ago,” he added.

Ganlea and its closest relatives belong to an extinct family of Asian anthropoid primates known as the Amphipithecidae.

Two other amphipithecids, Pondaungia and Myanmarpithecus, were previously discovered in Myanmar, while a third, named Siamopithecus, had been found in Thailand.

A detailed analysis of their evolutionary relationships shows that amphipithecids are closely related to living anthropoids and that all of the Burmese amphipithecids evolved from a single common ancestor. (ANI)

Nepal alliance parties form taskforce for govt formation

Kathmandu, May 27 (ANI): A joint meeting of the 16 out of 22 parties supporting the UML-led government on Wednesday decided to form a taskforce to made suggestion regarding the set up of the new government and the ministerial portfolios in the new cabinet.

The parties decided to from a taskforce to study the issues after the meeting held this morning failed to reach a consensus on the issues.

The taskforce includes the coalition leader CPN-UML and its probable allies, the Nepali Congress, the Madheshi Janadhikar Forum and the Tarai Madhesh Loktantrik Party. The taskforce will also finalise the government’s Common Minimum Programme (CMP). 50-point CMP of the government was distributed in the meeting.

However, the task to finalise the CMP has been given to the taskforce after some leaders complained that the CMP was incomplete.

The parties have also suggested Prime Minister Madhav Kumar Nepal to revert the decision of the Maoist government to terminate army chief Rookmangud Katawal and appoint Kul Bahadur Khadka as acting chief.

As proposed by the UML, the parties agreed to end the winter session of the parliament early.

Similarly, the parties have urged Speaker Subash Nembang not to table the resolution registered by the Maoists at the parliament secretariat before the parliament for discussion, Nepalnews eported. (ANI)

Monkeys and humans share ‘diet control’ habits

Washington, May 20 (ANI): In a new research, behavioural ecologists working in Bolivia have found that wild spider monkeys control their diets in a similar way to humans, contrary to what has been thought up to now.

Rather than trying to maximize their daily energy intake, the monkeys tightly regulate their daily protein intake, so that it stays at the same level regardless of seasonal variation in the availability of different foods.

Tight regulation of daily protein intake is known to play a role in the development of obesity in humans, and the findings from this research suggest that the evolutionary origins of these eating patterns in humans may be far older than suspected.

The research also provides valuable information about which trees are important for the monkeys’ diet, which is relevant to conservation.

In addition, it may help to improve the care of captive primates, which can be prone to obesity and related health problems due to their diet.

Dr Annika Felton, a Departmental Visitor at the Fenner School of Environment and Society, The Australian National University, Canberra, Australia, spent a year in the Bolivian rainforest, familiarizing the Peruvian spider monkeys to her presence and then observing their feeding habits.

She followed 15 individual monkeys (7 adult males, 8 adult females), conducting continuous observations of the same animal from dawn to dusk, and following each of the monkeys for at least one whole day a month.

During observations, she recorded everything they did and ate and for how long.

Where possible, she counted every fruit and leaf they ate, and collected samples of what they had eaten from the actual trees the monkeys had chosen.

The samples were then dried and sent to the laboratory in Australia where they were analysed for their nutritional content.

It is unusual for a study of feeding habits in wild primates to be conducted in this detailed way.

It enabled Dr Felton and her colleagues to calculate how much an individual monkey had consumed and the nutrients involved.

According to Dr Felton, “We found that the pattern of nutrient intake by wild spider monkeys, which are primarily fruit eaters, was almost identical to humans, which are omnivores.”

“What spider monkeys and humans have in common is that they tightly regulate their daily protein intake, that is, they appear to aim for a target amount of protein each day, regardless of whether they only ate ripe fruit or mixed in other vegetable matter as well,” she said. (ANI)

Common anti-viral drug holds promise to treat cancer

Washington, May 14 (ANI): A common anti-viral drug called ribavirin may prove to be beneficial in the treatment of cancer patients, according to a groundbreaking Canada-wide clinical trial.

Led by Dr. Katherine Borden, at the Institute for Research in Immunology and Cancer (IRIC) of the Universite de Montreal, the study has shown that that ribavirin suppresses the activities of the eIF4E gene in patients.

The eIF4E gene is dysregulated in 30 percent of cancers including breast, prostate, head and neck, colon and stomach cancer.

While Borden and her team monitored molecular events in trial patients, Dr. Sarit Assouline of the Segal Cancer Centre, Jewish General Hospital, led the clinical part of the trial.

The integration of these two teams made it possible to rapidly move from a research lab to patient tests.

The study team targeted the gene by giving trial participants a mimic of its natural target, ribavirin.

“Our results are the first to show that targeting eIF4E in humans is clinically beneficial. We also found that ribavirin not only blocks eIF4E, it has no side effect on patients,” said Borden.

In the trial, the researchers studied patients with M4/M5 acute myeloid leukaemia who had undergone several other treatments that had previously failed.

“We had striking clinical improvements with even partial and complete remissions,” said Assouline.

Dr. Wilson Miller, director of the Clinical Research Unit, Jewish General Hospital, and co-investigator in the trial added: “It’s rare that discoveries in basic research move to clinical so quickly and successfully.”

Borden explained: “Combination therapy with chemotherapeutic agents may enhance the efficacy of this treatment. Trials in the near future are planned to overcome this and we are looking forward to more complete remissions. We also hope to test whether ribavirin is as effective in the treatment of other cancers with dysregulated eIF4E. Our laboratory studies suggest this is likely.”

Dhanbad villages now have electricity

Dhanbad (Jharkhand), May 1 (ANI): Villagers in Dhanbad have been immensely benefited by the Central Government sponsored rural electrification scheme.

The Central Government launched the project named Rajiv Gandhi Grameen Vidyutikaran Yojana.

Neelmani Singh, assistant engineer, Damador Valley Corporation said that this project had cost 500 million US Dollars in Dhanbadh and the work continues in 8 eight blocks of Dhanbad.

“The project is divided into two packages: A and B. The package A covers 11 lines, which are for domestic consumption. The package B covers the substations,” said Singh.

Villagers like Sahir are a happy lot as their children can study courtesy the electricity from this programme.

“We have benefited a lot with electrification. Our children can study due to electricity which has been provided to us courtesy the Rajiv Gandhi Rural Electrification programme,” said Sahir.

The Central Government contributes ninety per cent of the capital cost of the programme.

The CAT is the premiere admissions test used in the selection process for admission to the Indian Institutes of Management, a network of India’s most prestigious business schools based in Ahmedabad, Bangalore, Calcutta, Indore, Kozhikode, Lucknow and Shillong.

Of the 250,000 students that take the exam each year, ultimately just over 1,500 are admitted to one of the IIMs. It is therefore one of the most competitive and high profile admission exam administrations in the world, requiring tight execution and secure exam delivery.

For the first time in history, instead of testing only one day a year, candidates will be able to test during a 10-day testing window across 23 Indian cities where secure computer-based testing centers specially prepared for the CAT exam are strategically positioned throughout the country.

The longer window and wider availability will provide candidates greater flexibility when choosing a testing date, time or location as well as near-ubiquitous access to testing locations. In addition, computerization of the CAT will result in faster score processing, enabling the IIMs and more than a hundred other Indian business schools that rely on the results to more quickly make their admissions decisions.

Now, ultra small, energy efficient computer chip

Washington, Apr 23 (ANI): Scientists from University of California, Davis have developed an ultra small chip that provides breakthrough speeds for a variety of computing tasks.

The 167-processor chip, known as AsAP, is fully reprogrammable, extremely energy-efficient, highly configurable. It can be widely adapted to a number of applications.

The maximum clock speed for the 167-processor AsAP is 1.2 gigahertz (GHz), but at slower speeds its energy efficiency soars.

Moreover, twelve chips working together could perform more than half-a-trillion operations per second (.52 Tera-ops/sec) while using less power than a 7-watt light bulb.

“A battery powering this chip will typically last from several times to 75 times longer than it would under the same workload when powering some of the common commercially available digital signal processing chips,” said Bevan Baas, associate professor of electrical and computer engineering and leader of the design team.

“At the same time, with our targeted applications, we’re getting several times to 10 times better speed than what is currently available – all with a much smaller chip.

“To the best of our knowledge, this is the highest clock-rate processor chip designed at any university,” Baas added.

The chip, built with industry-standard fabrication technology and design tools, embodies a number of novel architectural and circuit features, Baas explained.

The scientists have written a number of software applications for the chip, which has been fabricated by the international electronics company STMicrotronics. Some of them are Wi-Fi receiver and several complex components of an H.264 video encoder.

Number of young women diagnosed from chlamydia, a common sexually transmitted disease increasing

Recent study revealed that the number of U.S. women ages 16-25 screened for chlamydia has increased from 25 percent to 43 percent during 2000-2006. Research team at the U.S. Centers for Disease Control and Prevention reported that there are still far too few women being screened.

Researchers wrote in the report that Chlamydia trachomatis infection is the most common bacterial sexually transmitted disease (STD) in the United States, with more than 2.8 million new cases estimated to occur each year.

Chlamydia can lead to pelvic inflammatory disease, infertility, chronic pain and ectopic pregnancy, which is a pregnancy outside the uterus, if not treated with antibiotics. It often causes few or no symptoms. Chlamydia can be passed to a newborn and can cause pneumonia and conjunctivitis, or pink eye. Both men and women can be infected by this sexually communicated disease.

Research team led by Dr. Karen Hoover studied the records of public and private health plans representing more than 40 percent of the U.S. population for the study.

Researchers said: “During 2007, approximately 1.1 million cases of chlamydia were reported to CDC; more than half of these were in females aged 15 to 25 years.”

FX Real Estate and Entertainment Inc. (NASDAQ: FXRE) announced that on April 8,
2009 it received notice from The NASDAQ Stock Market (“NASDAQ”) indicating that,
as of December 31, 2008, FXRE is no longer in compliance with NASDAQ`s
continuing listing requirement of a minimum of $10,000,000 in stockholders`
equity.

Under the NASDAQ Marketplace Rules, FXRE is permitted to submit to NASDAQ a plan
to regain compliance with NASDAQ`s continued listing criteria. However, based on
FXRE`s deteriorating financial condition, FXRE has determined that it will not
be able to regain compliance. As a result, FXRE has provided notice to NASDAQ of
its intent to voluntarily delist its common stock from NASDAQ. On or about April
24, 2009, FXRE will file a Form 25 with the Securities and Exchange Commission
relating to the delisting. The delisting is expected to be effective 10 calendar
days after filing the Form 25. FXRE anticipates that the last day of trading for
its common stock on The NASDAQ Global Market will be on or about May 4, 2009.
FXRE will seek to have its common stock quoted on the Over-The-Counter Bulletin
Board shortly after the date of delisting from The NASDAQ Global Market, though
FXRE cannot provide any assurances in this regard.

FXRE further announced that on April 9, 2009, as a result of its Las Vegas
subsidiaries continuing to be in default under the $475 million mortgage loan
secured by their Las Vegas property, the first lien lenders sent a Notice of
Breach and Election to Sell, which initiates the trustee sale procedure against
the Las Vegas property to satisfy the principal amount of $259 million and other
obligations owed to them under the mortgage loan and secured by the property.

Under Nevada law, the Las Vegas subsidiaries have the legal right to cure the
default during a 35-day redemption period that expires on May 18, 2009 or else
the Las Vegas property may be sold thereafter in accordance with Nevada law (the
process takes approximately 120 days) in a trustee sale to satisfy the first
lien lenders` obligations secured by the property. Neither FXRE nor its
subsidiaries are able to cure the default. Consequently, FXRE and the Las Vegas
subsidiaries are considering all possible legal options, including bankruptcy
proceedings. FXRE cannot guarantee to what extent, if any, such actions may be
viable or effective.
