Pak Punjab Govt has ‘confidential evidence’ against Saeed, withdraws case

Islamabad, July 14 (ANI): The government in Pakistan’s Punjab province has decided to disassociate itself from the Jamaat-ud-Dawa chief Hafiz Muhammad Saeed case and filed a plea for its withdrawal.

On Monday, the provincial government informed the Supreme Court that it has challenged the release of Saeed due to certain “confidential evidence” against him.

According to Punjab Advocate General Raza Farooq, Saeed was put under house arrest on the directive of the federal government, which failed to provide solid evidence to maintain his house arrest.

Therefore, Farooq said the Punjab Government has decided to disassociate itself from the case and a petition for withdrawal has been filed with the Supreme Court.

Farooq on Monday told the three-member bench hearing pleas against a Lahore High Court (LHC) decision to release Saeed and Colonel (retired) Nazir Ahmed that Saeed was detained under Section 3 of the Maintenance of Public Order Ordinance 1961.

However, Section 3 was not mentioned in the detention order. The three-member bench consisting of Chief Justice Iftikhar Muhammad Chaudhry, Justice Muhammad Sair Ali and Justice Jawwad S Khawaja, asked the Punjab AG to satisfy the apex court, the Daily Times reports.

The AG said there was sufficient evidence against Saeed, but it could not be made part of the case record because it was confidential.

Farooq also submitted that it was binding on the government to implement resolutions adopted by the UN.

He said the detention of Saeed had become necessary, as the UN had levelled allegations that Saeed was linked to Al Qaeda and was allegedly involved in some terror-related incidents at an international level.

The Pakistan and the Punjab Governments, through their petitions, requested the court to set aside the LHC decision of ending the detention of Saeed and Col (retired) Nazir Ahmed.

The petitions claimed the LHC had not considered the sensitivity of the case, especially in light of the prevailing security situation. (ANI)

LTTE’s Black Air Tigers behind Colombo aerial strike

Colombo, Feb 21 (ANI): The Liberation Tigers of Tamil Ealam (LTTE), on Saturday claimed responsibility of Friday night’s aerial strikes on a main revenue department building near the Sri Lankan Air Force Headquarters in Colombo.

In a statement released on its website, the LTTE said the strikes were suicide attacks carried out by its ‘Black Air Tiger’ squad.

They also released photographs of the two Black Air Tigers, Col. Roopan and Lt. Col. Siriththiran with LTTE leader Velupillai Prabhakaran before embarking on their mission.

The attack claimed the lives of two persons and injured 54.

“The aircrafts dived into Sri Lanka Air Force (SLAF) Headquarters in Colombo and into the SLAF base at Katunayaka at around 0915pm(local time) last night carrying out successful air raids,” a pro-LTTE website reported.

However, Government defense spokesman Keheliya Rambukwella has claimed that both LTTE aircrafts were chased and destroyed shortly after the bombings.

A Defense ministry statement on Friday had said the second aircraft was disabled by the anti air gunfire reportedly and crashed on the Inland Revenue building.

The military has recovered the remains of the aircraft and a body of the LTTE pilot from Katunayake area.

It has informed that the pilot, whose body was found intact, had a large quantity of explosives and bombs inside the aircraft. (ANI)

Apex Court dismisses PIL challenging ATS probe into Malegaon blast

New Delhi, Jan.27 (ANI): The Supreme Court on Tuesday declined to entertain a public interest litigation (PIL) challenging the probe by Anti-Terrorist Sqaud (ATS) of Maharashtra Police into the Malegaon blast case and the arrest of persons including Sadhvi Pragya Singh Thakur.

“We cannot entertain such a petition,” a Bench headed by Chief Justice K G Balakrishnan said.

Advocate Kaushal Kishore Chaudhary, in its petition, had questioned the entire probe in which a serving Army officer Lt. Col Srikant Purohit and Retd. Major Ramesh Upadhaya have been arrested.

The petitioner sought a judicial inquiry into the entire incident, alleged that the apex court guidelines were not abided by while arresting the accused, including Dayanand Pandey and Sameer Kulkarni and Sham Lal Sahu.

The petition alleged that the entire sequence of event was a result of conspiracy between ATS and Maharashtra government with a sole aim of vote bank politics by terming the Malegaon blasts as a product of ‘Hindu Terrorism’.

The petitioner alleged that the criminal law, constitutional mandate and the Supreme guidelines that parents or the relatives of persons, who are picked up by investigators, should be intimated had not been followed by the ATS while detaining Sadhvi and other co-accused.

Besides, the petition also challenged the decision to invoke the stringent law the Maharashtra Control of Organised Crimes Act (MCOCA), alleging that it was a “politically motivated” case lodged with the aim of garnering minority votes. (ANI)

Court to decide on validity of invocation of MCOCA in Malegaon blast case

Mumbai, Jan.21 (ANI): A special Maharashtra Control of Organised Crime Act (MCOCA) court will give its order over the validity of invocation of stringent provisions of MCOCA in the Malegaon blast case here on Thursday.

Special MCOCA Judge Y. D. Shinde, who was expected to pass the order on Wednesday, adjourned it till Thursday stating that the court needs to peruse the chargesheet.

On Tuesday, the Anti Terrorism Squad (ATS) filed its chargesheet against 14 accused in the Malegaon bomb blast case charging them under MCOCA, Unlawful Activities (Prevention) Act (UAPA), Indian Penal Code (IPC), Arms Act and Explosive Substances Act.

Defence lawyers, however, had argued that before the court takes cognisance of the chargesheet, it should first look into the merits of invocation of MCOCA on the accused in the case.

MCOCA was invoked after one of the accused Rakesh Dhawde was chargehseeted in two other cases.

Advocate Shrikant Shivde representing Lt. Col Prasad Purohit, who had been accused as the main conspirator in the chargesheet, had argued that both the chargesheets against Dhawde were filed after the Malegaon blast on September 29.

“Dhawde was arrested and produced before a court in Nashik on November 15, 2008. On the same day, the prosecution filed a supplementary chargesheet against him in the 2004 Jalna blast case,” Shivde said.

He stated that the court had, however, taken cognisance of that chargesheet only on November 28 while the prosecution invoked MCOCA in the Malegaon case on November 20.

Another accuse Sadhvi Pragya Singh Thakur’s case is being represented by Advocated Mahesh Jethmalani in the court.

“Technically, prior to invocation of MCOCA, Dhawde had no chargesheet against him. Before invoking MCOCA in the case, the prosecution should have submitted the two orders passed by the court while taking cognisance of the two chargesheets against Dhawde,” Sadhvi’s lawyer Mahesh Jethmalani aruged.

Special public prosecutor Rohini Salian, however, argued Dhawde had committed more than one offence and sanction for invocation of MCOCA was given after the competent authority, a senior IPS officer, perused the papers. (ANI)

Government asks Pak to focus on dismantling terror

New Delhi, Jan 20 (ANI): Minister of State for External Affairs Anand Sharma on Tuesday asked Pakistan not to make attempts to distract India at this stage when the world is watching its action to dismantle terror.

Asked about reports that Pakistan might seek custody of Col. Purohit in connection with Samjhauta Express case, Anand Sharma said, ” There should not be any distraction or deflection at his stage when the whole world is watching actions by Pakistan to dismantle terror infrastructure.

“I think we are talking here about the Mumbai carnage conceded by the organizations, which have been identified as Pakistan nationals,” Sharma added.

Reacting over Pakistan’s offer to India to join the probe in to the Mumbai attacks, Sharma asked Pakistan to make full disclosure of its investigation on Mumbai attacks while adding, “We should bring to justice those who are responsible for masterminding the carnage in Mumbai.” (ANI)
