Lawsuit against Apple, AT&T can remain as class action:AP

(Reuters) – A monopoly abuse lawsuit against Apple Inc (AAPL.O) and AT&T Inc’s (T.N) mobile-phone unit can continue as a class action against the two companies, the Associated Press reported, citing a federal judge.

AT&T, the biggest U.S. phone company by revenue and the exclusive U.S. provider for iPhone, has come under withering criticism from iPhone users over its network quality since the smartphone went on sale in 2007.

The agency said an amended complaint filed in June 2008 deals with Apple’s practice of “locking” iPhones with AT&T’s network and its control over the applications that can be installed on its smartphone. The lawsuit also consolidates those filed by iPhone buyers starting in late 2007.

Parts of the lawsuit that deal with violations to antitrust law can continue as a class action, Judge James Ware of the U.S. District Court for the Northern District of California said in court documents filed on July 8, AP said.

Reuters was not able to contact Apple and AT&T out of regular U.S. office hours.

The lawsuit — which includes any iPhone buyer with a two-year AT&T agreement since June 2007 — also says Apple secretly made AT&T its exclusive iPhone partner in the U.S. for five years, dampening competition and driving up prices.

Early in June, AT&T announced plans to stop offering its unlimited pricing plan for new subscribers to its mobile data services, in an effort to improve the speed of its network by cutting down on network-clogging downloads. [ID:nN02173229]

According to the lawsuit, consumers found themselves locked into a five-year relationship with AT&T, AP said.

The lawsuit seeks an injunction to keep Apple from selling locked iPhones in the U.S. and from determining what iPhone programs people can install. Taiwan’s HTC Q2 profit up about 33 pct y/y

July 6 (Reuters) – Taiwan smartphone maker HTC Corp (2498.TW) reported an around 33 percent rise in second-quarter profit, it said on Tuesday.

HTC’s unaudited net profit in April-June was T$8.64 billion ($268 million), the company said in a statement, without giving further details.

In the same period a year earlier, it had reported an audited net profit of T$6.5 billion.

Sales reached T$23.86 billion in June.

Nikkei flat in choppy trade; Softbank up on iPhone

June 24 (Reuters) – Japan’s Nikkei was flat in thin, choppy trade on Thursday as short-covering petered out, with charts showing further gains were likely to be difficult.

But Softbank Corp (9984.T) became the second-biggest contributor to the Nikkei 225 as Apple Inc’s (AAPL.O) iPhone 4 made its global debut, with fans pouring into Softbank outlets and Apple’s flagship Japan store. [ID:nTOE65M07U]

Softbank is the exclusive iPhone operator in Japan.

Major iPhone 4 ordering agonies persist

After a day when some customers gave up trying to buy a new iPhone 4, both AT&T and Apple continued to have major problems handling online orders Tuesday night.

As of 8:30 p.m. ET, AT&T’s Web site was returning an error during the part of the ordering process when a current customer’s account is checked to determine whether he or she is eligible for a new iPhone at the subsidized prices of $199 for a 16GB model or $299 for the 32GB device.

“There was a problem with your request,” the error message reads. “P1015: We’re sorry, but we are experiencing a system error that prevents us from completing your request. For non iPhone related upgrades, please call Customer Care at 1-888-867-4384 and provide the error number at the beginning of this message.”

Order attempts at Apple’s online store at 8:30 p.m. ET were also stymied, as they have been for much of the day.

There, the message popped up during the upgrade eligibility check, which Apple directs to AT&T’s servers. “Your request couldn’t be processed,” Apple’s message read. “We’re sorry, but there was an error processing your request. Please try again later.”

At best, online ordering was spotty all day Tuesday . Although some managed to make it through the several screens at ATT.com or Apple.com to successfully reserve an iPhone 4, many others did not.

Scot Finnie, Computerworld’s editor-in-chief, spent more than 12 hours trying to order an iPhone 4 at Apple’s and AT&T’s sites, but each time encountered a glitch that blocked him from completing the transaction.

A Computerworld reader reported an even more troublesome issue.

“I placed my order over the Web at between 4 and 4:30 a.m. ET, expecting that I would beat the rush,” said the Reverend Dennis Hoffman in an e-mail to Computerworld. “My problems have come, in part, through my bank and its fraud protection system. I was contacted by my bank to confirm whether or not I had made three (3) transactions. All of them were AT&T’s attempt to ding my account for the $300 charge for the phone.”

Hoffman’s bank contacted him because repeated and identical charges are flagged by its anti-fraud system.

“I remain, as of this writing, understandably unsure as to whether my order is truly in the system, and watching my account for more than one draft of the charges for the phone,” Hoffman continued. “AT&T is not the ‘new face of inept.’ …They remain the continual and reigning champ of inept.”

The ordering fiasco is yet another black eye for the iPhone’s exclusive U.S. carrier.

Last Sunday, AT&T had to apologize to tens of thousands of Apple iPad 3G owners after a hacking group said it had scraped more than 100,000 e-mail addresses from the carrier’s servers using an automated script.

The hackers and AT&T have traded accusations since last week over the incident, which the FBI is probing.

Also last week, AT&T’s account management site collapsed for several hours after Apple CEO Steve Jobs announced that the carrier would waive contract requirements to allow more customers to upgrade to the new iPhone 4.

AT&T spokesman Mark Siegel declined to comment on his company’s problems today, but promised that it would release a statement later Tuesday.

Nikkei claws higher after key support level holds

June 8 (Reuters) – Japan’s Nikkei average rose 0.2 percent on Tuesday in choppy trade after a key support level held, with short-covering emerging a day after the benchmark suffered its biggest one-day fall in 14 months.

China Foxconn worker falls to death, 7th this year

A worker was killed after falling from a Foxconn dormitory in southern China, the seventh employee to die this year after falling from buildings at the world’s top contract maker of cellphones, state media reported on Saturday.

Foxconn, whose clients include Apple and Sony Ericsson, has faced criticism over the welfare of its employees after the spate of apparent suicides.

Police were investigating whether the latest death was suicide, the official Xinhua news agency said. A total of nine Foxconn workers have plunged from buildings in 2010, it said, adding that two of them did not die.

The Taiwanese firm has a sprawling factory base in Shenzhen, near Hong Kong, where an estimated 300,000 workers churn out products for the world’s leading computer and phone companies in round-the-clock shifts.

Liam Gallagher promises not to get into films

London, May 15 (ANI): Former Oasis singer Liam Gallagher, who is working on new film ‘The Longest Cocktail Party’, claims he will never get completely absorbed into films.

However, the rock star, whose new production company, In 1,is backing the movie, admitted that he could not let go an opportunity to be part of the biopic based on Richard DiLello”s memoir.

He was present at the Cannes Film Festival with Andrew Eaton of Revolution Films, who will collaborate on the project, which charts the “wild rise and fall” of the record company at the end of the 1960s.

“I”m not going into films, this is the last thing for me. I mean I”m not going to get sucked into that. I”m going to do this one thing because I like it, and I”ve got the opportunity to do it, and Andrew”s going to make it happen, and that”s it,” the Mirror quoted Gallagher, as saying.

DiLello worked as the resident “House Hippie” at Apple, which signed artists such as James Taylor, Mary Hopkin and Badfinger, from 1968 to 1970.

Gallagher added that the memoir had held “biblical” meaning for his former Oasis bandmates. (ANI)

London, April 30 (ANI): American actress Gwyneth Paltrow says that the best way to deal with kids’ tantrums is to use earplugs.

The 37-year-old actress who has revealed the secret of successful parenting has two kids, daughter Apple, soon to be 6, and son Moses, 5.

Married to Coldplay lead singer Chris Martin, Paltrow feels that the best way to cope with the problem is block your ears, reports The Daily Express.

“They’re kids and they have to do what they have to do,” Paltrow said.

Even without iPhone, AT&T can thrive-Barron’s

NEW YORK, April 25 (Reuters) – Concerns over the loss of AT&T’s (T.N) exclusive pact with Apple Inc (AAPL.O) are overshadowing AT&T’s ability to sell other services to its customers, Barron’s reported in its April 26 edition.

The telecom company, which posted better-than-expected quarterly earnings last week, is the exclusive carrier for the iPhone. Most analysts expect this to continue until 2011.

In the meantime, investors should not overlook the company’s ability to sell data, broadband, voice and other services to home and wireless customers, the financial newspaper reported in its “Plugged In” column.

AT&T and other phone companies have also been hurt by the slowdown in the number of customers buying lucrative, long-term contracts. But AT&T said its revenue per user from data and other services continues to rise, which will compensate for slower contract growth.

UPDATE 2-Softbank shares fall as phone limits may be lifted

TOKYO, April 5 (Reuters) – Shares of Softbank Corp (9984.T) slid more than 3 percent on Monday on news Japan’s government planned to make it easier for mobile phone users to switch operators while keeping the same phone.

The move to lift restrictions blocking the use of different SIM cards in a mobile phone is expected to encourage some subscribers to switch to NTT DoCoMo (9437.T), which has the strongest coverage area, and hurt iPhone provider Softbank, whose network is not as strong.

“Many users switched to Softbank from Docomo when iPhone was launched (in Japan), but lifting the lock on SIM cards could be a good opportunity for Docomo to win back users,” said Hironobu Sawake, a telecoms analyst at J.P. Morgan.

Daisuke Iwai, an official at Japan’s communications ministry, said that the government planned to work with mobile phone operators to lift the lock on SIM cards, but that the timing of such a move and other details had yet to be decided.

The Nikkei newspaper reported over the weekend that the government would outline guidelines in the next few months and implement the change by the end of the year, aiming to boost competition and lower fees for consumers. [ID:nTOE63200G]

Currently, mobile phone handsets in Japan are developed exclusively for a particular service provider. By removing limits on SIM card use, callers will be able to switch phone operators without changing handsets.

“Network quality would become very important if the lock on SIM cards is lifted. Softbank, which has made it a priority to make profit and loan payments, would need to invest more on its network,” J.P. Morgan’s Sawake said.

Softbank last week lifted its capital expenditure for the 2010/11 financial year to 400 billion yen ($4.24 billion) from the around 300 billion yen previously planned. Most of the increase is likely to go to network building, said Softbank spokesman Fumihiro Ito.

Shares of Softbank, Japan’s No. 3 mobile phone operator, which has benefited from its status as the sole provider of Apple’s (AAPL.O) iPhone in Japan, slid 3.6 percent to 2,253 yen. Industry leader DoCoMo gained 0.3 percent to 143,500 yen.

Second-ranked KDDI (9433.T), which uses a different communication standard from Docomo and Softbank, rose 0.3 percent to 481,500 yen. The benchmark Nikkei average .N225 advanced 0.5 percent.

Spokesmen from both Softbank and DoCoMo said they would consider lifting SIM locks if that would please customers.

Taiwan’s HTC says Apple suit not affecting operations

(Reuters) – Taiwan’s HTC Corp, the world’s No.5 smartphone maker, said on Friday a lawsuit against it by Apple Computer was not affecting operations.

“It’s part of business,” Chief Executive Peter Chou told reporters at a news conference where HTC launched new smartphones. “We need to face it and everyone can talk it through.”

Last month, Apple sued HTC, accusing it of infringing 20 hardware and software patents related to the iPhone. The U.S. International Trade Commission (ITC) has started to investigate whether HTC has infringed Apple’s patents, the ITC said in a statement on its website.

HTC ranks behind Nokia Oyj, Blackberry maker Research in Motion, Apple and Motorola Inc in the global smartphone rankings, according to research firm IDC.

Amazon, publishers strike e-book pricing deal: report

(Reuters) – Online retailer Amazon.com Inc has struck deals with two publishers on the pricing of electronic books, the Wall Street Journal reported on Wednesday.

CBS Corp’s Simon & Schuster and News Corp’s HarperCollins will be allowed to set their own prices for e-books under their agreement with Amazon, the report said.

Amazon, Simon & Schuster and HarperCollins did not respond to requests for comment.

While some new best sellers will be priced at $9.99, most will be priced at $12.99 to $14.99, the report said. Many older books will cost less than $9.99.

The publishers’ deal is similar to the one they reached with Apple Inc for the iPad tablet. Apple is positioning the iPad, which goes on sale on Saturday, as a competitor to Amazon’s Kindle e-reader.

Apple will sell e-books for the iPad through its iBookstore application.

Gwyneth Paltrow dismisses US move rumours

London, Mar 24 (ANI): Gwyneth Paltrow has slammed rumours that she is moving to New York with her family.

The Hollywood actress has claimed that they are staying in London.

The California-born star moved to Britain when she married Coldplay frontman Chris Martin in 2003, and the couple is now parents to Apple, five, and Moses, three.

Recently, rumours started making rounds that Paltrow was planning to return to her native U.S. to avoid uprooting her family up every time she films movie roles there.

However, she has insisted that she and her family are happily settled in the U.K.

“I am so not moving back to New York. We are all very happy in London – it”s a great place to live and work and raise a family,” the Daily Express quoted her as saying. (ANI)

Madge rediscovers love for Britain

London, Mar 23 (ANI): Queen of Pop Madonna is said to have rediscovered her love for Britain while preparing to direct her new film ‘W.E.’

Madonna, 51, will be directing the movie, which is about the 1930s tale of Edward VIII abdicating the throne to marry his forbidden lover, American divorcee Wallis Simpson.

She will be staying in Marylebone for six-months this summer, as filming gets underway.

“The Big Apple hasn’t gone sour. M has just rediscovered her interest in Britain,” the Sun quoted a source as saying.

“She still owns her place in Marylebone and will be moving back there. She’s going to be filming her new movie about Wallis Simpson in London so it made sense for her to move back.

New York, March 17 (ANI): Rumours of Ryan Reynolds and his wife Scarlett Johansson hitting splitsville have been dismissed after the couple were said to be eyeing a permanent move to New York.

A source close to the actress claimed the couple had reached an agreement to keep a lid on their relationship since it began in April 2007.

“People have been saying that they are on the rocks because they haven”t been spotted together recently, but that”s only because they are both busy working,” the New York Daily News quoted the source as saying.

“She”s been doing up to eight shows a week on Broadway, and he”s been shooting the ”Green Lantern” in New Orleans. It”s been tough, but they”re making it through just fine,” the source added.
